Correctional services such as treatment authorities and officers follow up with individuals on parole. Probation officers are not that different from parole they meet with the offenders and assist them, probation officers assist in court associations and implement other court linked tasks. They compose reports, behavior background investigation, and commend probation or jail time for criminals. Probation representatives manage criminals tried for certain misdemeanors and felonies to guarantee that the probationer meets the terms with a court’s probation instructions. Different from parole, circumstances of probation are set by the court of law that holds legal control over the offender’s status.
According to research “Probation may be imposed for misdemeanors and felonies except murder, treason, armed robbery, criminal sexual conduct in the first or third degree, certain controlled-substance offenses, or felonies in which a firearm was used” (Michigan.gov,2016). I had the opportunity to conduct a phone interview with Caleb Justice; a corrections officer from the Federal correctional Institution in Terre Haute, Indiana. Caleb is a veteran of the United States Marine Corps, where he served four years on active duty as a machine gunner. During his four years he deployed on a Marine Expeditionary Unit (MEU) as well as to Nowzad and Musa Qala Afghanistan. After serving honorably Caleb decided to take his skill set to the civilian sector and began seeking employment in the Criminal Justice System.
Parole is a controversial issue because its vase ways to debate the challenges and problems that will exist. It’s like a side effect to medication based on one’s effectiveness belief. In like manner, the public media allows others who aren’t immediately effected to become tertiary, and secondary victims. It is the door to open opinions. An inmate is released from a sentence given parole and then assigned a parole and probation officer. The one thing that will make probation and parole successful is the supervision of the program and rehabilitation or residential treatment center. This will support the goal to maximize the good behavior and minimize the harmful behaviors of individuals. Probation is a good program because it’s a form of rehabilitation that gives inmates elevate space to obey rules and regulations. On the contrary, probation is risky just like any new diet plan that people use to
All the laws, which concern with the administration of justice in cases where an individual has been accused of a crime, always begin with the initial investigation of the crime and end either with imposition of punishment or with the unconditional release of the person. Most of the time it is the duty of the members of constituted authorities to inflict the punishment. Thus it can be said that almost all of the punishments are an act of self-defense and an act of defending the community against different types of offences. According to Professor Hart “the ultimate justification of any punishment is not that it is deterrent but that it is the emphatic denunciation by the community of a crime” (Hart P.65). Whenever the punishments are inflicted having rationale and humane factor in mind and not motivated by our punitive passions and pleasures then it can be justified otherwise it is nothing but a brutal act of terrorism. Prison System: It has often been argued that the criminals and convicted prisoners are being set free while the law-abiding citizens are starving. Some people are strongly opposed the present prison and parole system and said that prisoners are not given any chance for parole. Prisons must provide the following results: Keep dangerous criminals off the street Create a deterrent for creating a crime The deterrent for creating a crime can be justified in the following four types Retribution: according to this type, the goal of prison is to give people, who commit a crime, what they deserved Deterrence: in this type of justification, the goal of punishment is to prevent certain type of conduct Reform: reform type describes that crime is a disease and so the goal of punishment is to heal people Incapacitation: the...
The most important thing is giving his or her parolee a drug test every month they come in for a checkup. They are a special type of psychologist that can read body language. They have multiple tasks to do on a daily basis. They also need to write a summary on their parolee every month that could help them with court and if they ever have problems in the future. It can also give them an advantage against the judge or anybody in the court with whoever is going against them.
Prisons and correctional facilities in the United States have changed from rehabilitating people to housing inmates and creating breeding grounds for more violence. Many local, state, and federal prisons and correctional facilities are becoming more and more overcrowded each year. If the Department of Corrections (DOC) wants to stop having repeat offenders and decrease the volume of inmates entering the criminal justice system, current regulations and programs need to undergo alteration. Actions pushed by attorneys and judges, in conjunction current prison life (including solitary confinement), have intertwined to result in mass incarceration. However, prisoner reentry programs haven’t fully impacted positively to help the inmate assimilate back into society. These alterations can help save the Department of Corrections (DOC) money, decrease the inmate population, and most of all, help rehabilitate them. After inmates are charged with a crime, they go through the judicial system (Due Process) and meet with the prosecutor to discuss sentencing.
Programs such as parole and probation have been introduced as alternatives to incarceration. These programs are designed for offenders who are not considered a hazard to society. Parole is typically granted towards the end of a sentence and probation commonly in place of one, but because the organization is overloaded, financially unstable, and carelessly managed, it often operates as well as a feeder organization, guaranteeing prison cells will not be unoccupied for long. Actually, according to a report compiled by the Pew Center for the States parole violators accounted for over a third of all prison admissions in 2005 and "half the US jai...
Correctional institutions in the country have made rehabilitation a top priority. Most prisons offer substance abuse, domestic violence, anger management, and sex offender treatment programs. All programs are staffed by a wide variety of counselors, certified instructors, and doctors. Correctional employees are required to attained training and some are selected to become certified in some of the counseling fields as well. "Research conducted by Doris MacKenzie and others find that rehabilitation programs that have shown to be effective" (Miceli,
They combine current and past criminal information on inmates from police and judicial sources into complete legal reports which assist Parole Board Members with parole decisions. Officers supervise those who are approved to be released on parole and work with other state agencies and community resources to build intervention programs which facilitate the parolee's successful integration back into society. The officer may perform random drug testing, monitor employment history and meet weekly or bimonthly with the offender to guide the parolee's observance of parole conditions
Unfortunately, the criminal justice system is a vital piece of today’s society. Without it, the public would be free to do whatever they choose with no real consequence to negative actions. According to the Bureau of Labor Statistics, roughly 3 million workers were employed in the criminal justice field in 2015 (Occupational Employment, 2016). This is made up of countless different agencies, including law enforcement, corrections, homeland security, and many more. Corrections is a key element in the criminal justice system, which has its own unique functional philosophy, administrative structure and functions, theoretical assumptions that govern its existence, organizational mission, goals and objectives, and division of responsibilities.
Prisoners serving life sentences for first degree murder should not receive parole hearings after fifteen years since they have not served an appropriate amount of time for the crime, the victims’ family deserves justice and closure, and criminals who are released on parole pose a huge threat on the community. Criminals serving life sentences for first degree murder have been convicted of unlawfully killing that is willful and premeditated. In other words, the murder was immoral and planned out. Most of the time the murderer knows the victim personally, which means they know the victims’ family and workplace. So after the murder has occurred, it really surprises the family knowing who intentionally killed their loved one, which really takes a toll on them.
With the substantial increase in prison population and various changes that plague correctional institutions, government agencies are finding that what was once considered a difficult task to provide educational programs, inmate security and rehabilitation programs are now impossible to accomplish. From state to state each correctional organization is coupled with financial problems that have depleted the resources to assist in providing the quality of care in which the judicial system demands from these state and federal prisons. Judges, victims, and prosecuting attorneys entrust that once an offender is turned over to the correctional system, that the offender will receive the punishment in which was imposed by the court, be given services that aid in the rehabilitation to those offenders that one day will be released back into society, and to act as a deterrent to other criminals contemplating criminal acts that could result in their incarceration. Has our nations correctional system finally reached it’s critical collapse, and as a result placed or American citizens in harm’s way to what could result in a plethora of early releases of inmates to reduce the large prison populations in which independent facilities are no longer able to manage? Could these problems ultimately result in a drastic increase in person and property crimes in which even our own law enforcement be ineffective in controlling these colossal increases of crime against society?
A correctional officer is apart of a staff in a detention center, prison, or a jail that sets to accomplish the goals of the institution’s objectives by maintaining control and order within the prison (Seiter, 2011). While the role of a correctional officer is very crucial within a prison, depending on the unique role to a specific location, it is important that we understand that these humble and quiet guardians are in the correction facilities. Between the different criminal justice facilities, the mission and goals between them are vastly different, although there is very little contrast in the roles that correctional officers play in these facilities. Correctional officers are solely in charge of the direct and constant supervision of prisoners and administering the security procedures and protocols within a facility. These officers also need to be extremely well informed in the technical and interactive realm of the prison system as daily interactions with the inmate population requires them to have strict adherence to policies and a sharp attention to
To support reintegration, correctional workers are to serve as advocates for offenders in dealing with government agencies assisting with employment counseling services, medical treatment, and financial assistance. They argued that corrections focal point should be increasing opportunities for the offenders, to become law abiding citizens and on providing psychological treatment. This model of corrections advocates avoiding imprisonment if possible for the offender and also in favor of probation, therefore offenders can obtain an education and vocational training that would help their adjustment in the community. In the community model corrections advocated for inmates incarcerated to spend very limited time in prison before been granted parole.
Parole in America's criminal system is one of today's most controversial and debated topics in the field of criminal justice between those who believe it should be eliminated and those who believe it serves a necessary purpose. Parole is the release of a prisoner before they have served their entire sentence. While under supervision of a parole officer, if any wrongdoing occurs, the officer has the authority to recommend a return to prison considering the violation. There are pros and cons to parole and the argument against it that are very convincing. However, in my own point of view, the elimination of parole was the right choice.
Throughout the years we have noticed a pattern in prisons. Cells are becoming overcrowded with the increase of crime. With this come budgetary problems. Many alternatives have been created to decrease overcrowding in prison. Many social agencies have and are still being used in replacement of jail time for criminals whose crime is not as extreme. The effectiveness of probation and parole can be extremely questionable. This paper will serve to convey the reasons why Probation and Parole is not effective. The question here is whether the lack of Probation and Parole staffing and its diversity and lack of specialization affects recidivism of offenders.
