In the beginning there was closed source software and it was good for a while. What is closed source software exactly? Closed source software is the idea that no one can view yet alone change the source code of the software. Source code is the building blocks of software. On the other hand, there is open source software. There are three certain rights that people have with open source software. These rights are: “The right to make copies of the program and distribute those copies, the right to have access to the software’s source code, and the right to make improvements to the program.” (Behlendorf 172) These rights are the foundation of open source. The rights of open source software do not apply to closed source software. Mainly, these rights do not apply because one does not have access to the source code of closed source software. When one purchases closed source software, she is only buying a license to use the software. She is not purchasing the program itself, which is why she will not receive the source code. Open source software is also called free software. But, many are confused by what free software means. Does free mean freedom or free beer? In the case of open source software it means freedom. One is free to do with the software as he wishes. He can change how the software works and/or install the software on as many computers as he wants. It is possible to obtain open source software at no cost to the consumer. “Although it is possible for you to deploy Linux without paying licensing fees, this does not mean that Linux, or any operating system, is ‘free’ in the sense that there are no costs…” (Fink 8) Since one can copy open source software to multiple computer with only paying for, if at all, the software once, this is a much less cost than closed software where one has to purchase a license to use the software for each and every computer that is running that software. Open source software is better than closed source software.

The notion that software should be free is one that is highly critiqued within the technology industry. Free, as in the idea that users can obtain the source code for any given program, and modify and redistribute it as they like. Currently most all software produced is proprietary in nature. Corporations pay developers to create proprietary software that they then obstruct (so that no modifications can be made), and sell (to turn a profit). Most people who oppose this stance would say that standardizing a product wouldn’t cause anything but a monopoly. This is fiction because people choose products that are simply reliable and of good quality. The success of Microsoft’s operating system hasn’t been used to cause a monopoly in the browser marker, but to increase the quality of their software. As consumer interest in the Internet continues to grow, Microsoft’s role will be what it always has been. In the following paper I will be discussing the use of open source software as part of a larger project. Example uses of this include incorporating existing publicly available source code within another piece of software. Because the term open source has such broad implications, I will attempt to explain it within the context of this paper. Open source code comes with many different licenses such as GPL, BSD, and MIT. I will describe the most popular licensing options and how they differ. Many companies believe open source software projects have an immense lack of accountability; this is simply untrue. Lastly, open source software has recently received an abundance of attention in the media because of possible copyright violations. I will discuss some of the probable scenarios regarding copyright violations with open source and how to protect ones self. Throughout this paper, I hope to shed some light on the use of open source and how beneficial it truly can be to a company.

As illustrated above, open source licensing is becoming more and more dominant, especially as long as software is provided in a digital form. The purpose of this paper was to observe if and how the open source software licensing regime has challenged the protection granted to software under the intellectual property rights. In general, the outcome is that the distinct production and distribution model of open source licenses, while different, can be compatible with the legal framework of intellectual property rights protection and serve different purposes. However, a number of remaining uncertainties around the open source licenses leave room for improvements such as the possibility to make some adaptations to the license terms.
