Negligence is a tort law and it falls within the civil law which means a civil wrong has been committed (Tort and Negligence, 2012). The American civil justice system, defines the law of torts as situations that occur when the wrongful conduct of one party causes harm to another individual (WiseGeek, 2003). The responsible party fails to act as a reasonable person to someone to whom she or he owes a duty, as required by law under the circumstances. Negligent torts are not committed purposely, and there must be an injury that occurs from the breach of the duty (Negligent Tort Law, 2014).
A negligent tort is caused by negligent behavior, and this includes a person’s failure to practice due diligence and the negligence committed can be very costly to the company, and if a product manufacturer causes death or injury from using the company’s products, the end result will be legal action that is expensive and time consuming. From the act of negligence a company could publicly be exposed which could result in profit loss due to consumers being afraid or refuse to purchase the product, and the stock values could fall if the company is publicly traded. This can be very damaging for a business and could ultimately force the company to go out of business (Seaquist, 2012). Examples of tort law include assault, nuisance, assault, defamation, and trespass. To sum it all up a tort law case depends on breach of duty, and to prove negligence in a civil court, three elements have to be proven which duty, breach, are and damage (Tort and Negligence, 2012).

Medical malpractice is defined as “improper, unskilled or negligent treatment of a patient by a physician, dentist, nurse, pharmacist, or other health care professional” (Medical malpractice, n.d.). If a doctor acts negligent and causes harm to a patient, malpractice lawsuits arise. Negligence is the concept of the liability concerning claims of medical malpractice, making this type of litigation part of tort law. Tort law provides that one person may litigate negligence to recover damages for personal injury. Negligence laws are designed to deter careless behavior and also to compensate victims for any negligence.
General speaking, a tort of negligence is a failure of someone or one party to follow a standard of care which means failed to do what a reasonable person do or do what a reasonable personal would not do. From the interest perspective, the tort of negligent investigation is an offence against private interest of an individual, corporation or government due to the negligent investigation. Whether a tort of negligent investigation exists in Canada is related to whether investigators owe a duty of care to person being investigated and what is the standard of care. Hence, examining each further may be helpful to athletic administrators and staff in preventing civil tort law suits.
