Myanmar represents an important biodiversity reservoir with a great variety of different habitat types arising from its ecological diversity in Asia and Pacific Region. Diverse ecosystems with lots of genetic diversities can be found in Myanmar’s forests because of the tropical monsoon circulating system and its varied topography throughout the country. Among the 39 PAs, seven PAs have been recognized as ASEAN Heritage Parks (AHP). The 1994 Protection of Wildlife and Protected Areas Law focuses on the identification of nature reserves, establishment of zoological gardens and botanical gardens, protection of wildlife and wild plants, permission for hunting, research studies, permission to establish zoological and botanical gardens, registration, search, arrest and administrative action, and offences and penalties. Recently, Myanmar has formulated National Biodiversity Strategy and Action Plan (NBSAP) with the multi-consultation process. NBSAP is a comprehensive framework for biodiversity conservation, management and utilization in a sustainable manner, as well as to support the National Sustainable Development Strategy. Landscape fragmentation contributes to loss of migratory corridors, loss of connectivity and natural communities, which all lead to a loss of biodiversity for a region. Conservation of biodiversity must include all levels of diversity: genetic, species, community, and landscape (CNHP 1995). Each complex level is dependent upon and linked to the other levels. In addition, humans are linked to all levels of this hierarchy. A healthy natural and human environment go hand in hand (CNHP 1995). An important step in conservation planning, in order to guarantee both a healthy natural environment as well as a healthy human environment, is recognizing the most endangered elements.
A rainforest is an area of high, mostly evergreen trees with a high amount of rainfall. The biome is the earth’s oldest living ecosystem, being incredibly complex and diverse. The importance of the rainforest, is the huge biodiversity of the place due to the 80 – 90% of species that can be found there, even when it only covers 6% of the Earth’s surface. It is also often called the lungs of the planet, by absorbing carbon dioxide and producing oxygen upon which many species depend on. Rainforests also help stabilize the world’s climate and maintain the water cycle by producing rainfall all around the planet. Every year humans are cutting down more and more rainforest all around the globe. The reasons for this deforestation are to have grazing land for cattle, contraction of roads, extraction of energy and minerals and many more. Yet this report will focus on the monoculture of rubber tree plantations on previous rainforest land.

While the study recognizes that palm oil plantation increases deforestation and consequently reducing biodiversity, the authors argues that the demand for palm oil up to the year 2020 can be met without any reduction of forest cover through the improvement of yields and conservation of degraded land. The Convention on Biological Diversity (hereafter: “CBD”) is an international treaty adopted by United Nations Conference on Environment and Development, held at Rio de Janeiro in June 1992 and came into force on December 29, 1993. Initially when it came into force there were 168 members now it is 193 in total. The aim to protect biodiversity and the dramatic steps taken for conservation, sustainable use and the fair and equitable sharing of benefits attracted the world communities to become members (History of the Convention, n.d). In principle the convention on biological diversity changed the ownership concept of biodiversity protection i.e. (“common heritage of humankind”) to the “sovereign right” of each member country (Hirsch, 2012). It is the responsibility of the each member to develop and implement policies in a way that helps in the conservation and sustainable use of biological resources. It also recognizes the knowledge of local and indigenous people for conservation and sustainable use of biodiversity (Brahmi et al., 2004).The article 8(j) of CBD has an important provision which gives the member state rights to “respect, preserve and maintain” traditional style and knowledge about the conservation and sustainable use of biological diversity. The protection must promote the wider application of such knowledge and stimulate innovation and also ensure that the benefits are shared in fair and equitable manner to the communities.
