Areas such as skid-row are filled with people that are without the ability to function in normal society, and simply the fact that they exist is offensive to those that do operate within the normal realms of a community (Bittner, 1967). Due to the primitive nature of those individuals living in these chaotic areas, most officers feel it is necessary to enclose the area in which the behaviors occur to keep it from assimilating with “normal” society. The necessity to contain the areas similar to skid-row is the responsibility of the police, and with few governing superiors to mandate guidelines and the large amount of discretion allotted to police, they assume the peace keeping role and abandon the role of enforcer (Bittner, 1967). Maintaining peace is a difficult task in itself because of the uncontrolled way of life in skid-row. Police are sometimes stereotyped to be rugged, single minded enforcers who are insensitive to families in their most vulnerable state (Cross, Finkelhor, Ormrod, 2005). This would be an ideal approach to implement; however there seem to be difficult relationships between the two systems as they both hold different values and beliefs.
Within the Federal Government there are three main branches; “the Legislative, the Judicial, and Executive” (Phaedra Trethan, 2013). They have the same basic shape and the same basic roles were written in the Constitution in 1787.
We are all faced with articles and news reports detailing crime occurring all over the world, crime that affects all types of communities, crime relating to religious, gender and age differences to name but a few. I have always paid close attention to the punishments handed out to criminals, in which I always seem to find myself debating on whether these punishments have been fair or are un just.
This essay will discuss the role of the criminal justice professional in serving both individual and societal needs. It will identify and describe at least three individual needs and three societal needs, in addition to explaining the role of the criminal justice professional in serving each of these needs. Illustrative examples will be provided for support.
Over the next 10 years the criminal Justice system could entirely change with the passing of a major law, epidemic, or failed service. Consequently, every since 9-11 our justice system has become much more open minded. Therefore, resulting in the strict enforcement of laws to protect its citizens. Nothing ever stays the same for too long. Unfocused and indiscriminate enforcement actions will produce poor relationships between the police and community members residing in areas. Law enforcement should adopt alternative approaches to controlling problem areas, tracking hot persons, and preventing crime in problem regions. The criminal justice system is composed of three parts – Police, Courts and Corrections – and all three work together to protect an individual’s rights and the rights of society to live without fear of being a victim of crime. According to merriam-webster.com, crime is defined as “an act that is forbidden or omission of a duty that is commanded by public law and that makes the offender liable to punishment by that law.” When all the three parts work together, it makes the criminal justice system function like a well tuned machine.
The criminal justice system views any crime as a crime committed against the state and places much emphasis on retribution and paying back to the community, through time, fines or community work. Historically punishment has been a very public affair, which was once a key aspect of the punishment process, through the use of the stocks, dunking chair, pillory, and hangman’s noose, although in today’s society punishment has become a lot more private (Newburn, 2007). However it has been argued that although the debt against the state has been paid, the victim of the crime has been left with no legal input to seek adequate retribution from the offender, leaving the victim perhaps feeling unsatisfied with the criminal justice process.
Power conformity is parallel behavior to obtain rewards and avoid punishments from the larger group (Levy, 1). What the individual attempts to obtain are cues from the group to articulate the appropriate response in a situation. Individuals conform to these standards because they wish to achieve solidarity. Therefore, police solidarity effects the socialization process to the subculture and police work because new members are trying to increase their solidarity with the group. Encouraging individuals to conform and obey social norms can be done through formal and informal means. In criminal justice law enforcement officers are expected to reduce crime in an efficient manner and administrators are expected to produce more efficiency with less money. Individuals must be recognized in some manner in order to continue motivation for job performance. Administrators will need to continue to set reasonable goals for an organization. In the criminal justice system this can be done through showing officers the personal rewards they will receive for performance of their duties. When officers encounter citizens it is usually when the citizen is at their worst. The way an officer handles a situation may influence the offender to change his way of life and stay out of the criminal justice system in the future. The use of coercive authority by members of law enforcement is a widely debated issue both here in the United States and in countries around the world. Growing up in Haiti, I witnessed many instances of coercive, or excessive, tactics by authority figures. When a child would commit a crime, many times all of the kids in the neighborhood were punished, even if they had no part in or knowledge of the wrongdoing.
