Imagine a small boy looking out the window, who was riding passenger on his Godmothers lap unaware of the danger that awaited… in that split second his life changed forever. It was the time of year when three-year old Irvin traditionally went to visit his family out of country. During a car ride in Gurrero, Mexico, Irvin was sitting on his Godmothers lap when life suddenly flashed before his eyes, his family would've never been able to plan for what was coming… The vehicle Irvin was riding in was in a head-on collision, and Irvin was launched face first out of the front windshield and landed approximately thirty feet away. When Irvin was found he was unconscious with several broken bones and had a large laceration wound from skull, leading …show more content…
The accident was caused by a vehicle that police officials were pursuing who happened to turn into oncoming traffic and struck the vehicle Irvin was in head-on. The man in the opposite vehicle was pronounced dead on site and as for Irvin’s family they were lucky enough to be treated for a few broken bones and minor injuries. As for Irvin, he was not so lucky, the impact immediately broke his ribs, jaw, nose, and fractured his skull and left a huge wound on his face that caused him to need facial reconstruction surgery. Irvin was not seat belted and did not have proper protection in this type of an impact, therefore he was ejected face first from the vehicle, where he was found about thirty feet away from the crash site unconscious by the police officers who witnessed the accident and rushed him to the nearest hospital. The doctors attempted to stop the bleeding and save this child who was now in a coma, they were unable to reconstruct his face and just applied sutures for the time being. Although not all motor vehicle accidents result in fatality they can highly impact a persons’ life, not only physically but mentally as well. The Epidemiology of Child Motor Vehicle Crash Injuries and Fatalities study found, “Children represent 10-15% of overall traffic fatalities. Motor vehicle crashes remain the leading cause of death and disability for children and young adults.” It is important to always …show more content…
Irvin was flown to California where he met his mother and doctors performed several surgeries. Irvin had no feeling in his face and was unable to eat due to the severe trauma around his mouth. Irvin was in physical therapy for several years, and during that time he learned basic skills that came easy to other children. Irvin had approximately 7 laser and plastic surgeries on his face, therefore he basically lived in the hospital till the age of four. When Irvin was old enough to enroll in school it did not get easier for him, he endured severe bullying and treated like an outcast by his most of his peers. Experts who’ve evaluate the psychological effect following maxillofacial trauma states, “The face is often the seat of recognition for all human beings and living with a change in appearance of one’s face, as a result of an injury, disease, burns, or trauma is always a challenging task. Various medical, personal, social and psychological variables influence the process of adaptation.” Irvin’s life had been far from easy up to this point and he just wanted to feel normal, therefore his mother began enlisting him in program for children who have suffered serious facial disfigurements.
Statement of Assignment: You have asked me to prepare a legal memorandum on the question of whether our client can gain relief from intentional infliction of emotional distress occurring from witnessing a friend¡¦s child being injured by a vehicle that is out of control due to being driven at a high rate of speed through a school zone. Pursuant to your request, this memo includes an analysis of the relevant state and federal law.
If you have been injured in motor vehicle accident, your primary concern should be getting the proper medical treatment for your injuries.
The first thing that one needs to consider is the situation that victims are normally under. No one chooses to be in an accident, it is something that is unexpected. Because of that those who are affected are often not at a point financially where they can handle the results of the accident such as lost time at work, medical bills, and other associated cost. Worsening the situation is the fact that the injuring party in the accident often does not want to compensate the victims for their actions. This results in an even
About 4 years ago Johnathan was in a tragic car accident due to drinking and driving. He fell asleep at the wheel and drove his car underneath a parked 18 wheeler on the side of the highway. Johnathan not only put himself in danger, but also a friend of his that was passed out in the backseat. This caused Johnathan to have to have massive facial reconstructive surgery. Johnathan’s friend suffered minor injuries since he was lying down.
At Ten P.m on September 23, 2006, my mother Kelli Elizabeth Dicks was hit by a car on Route 146 southbound trying to cross the high speed lane. She was being picked up by a friend. Instead of taking the exit and coming to the other side of the highway, her ride suggested she run across the street. The impact of the car caused her to be thrown 87 feet away from the original impact zone and land in a grassy patch of land, her shoes stayed where she was hit. She was immediately rushed to Rhode Island Hospital where she was treated for serious injuries. When she arrived at the hospital she was rushed into the operating room for an emergency surgery. The amount of injuries she sustained were unbelievable. She broke 18 different bones, lacerated her liver and her spleen, ruptured her bladder, and she collapsed both lungs. When she went in for her emergency operation, and had her
An officer began a routine stop for someone exceeding the speed limit but the driver of the sports car they were trying to pull over speed up instead of slowing down. During the course of this chase the speeds of both the police car and the sports car rose to above 100 miles per hour. At the end of the high speed chase the officer lost control of their cruiser and ran up on a sidewalk hitting a pedestrian, ultimately killing the pedestrian. In the same moment hearing the commotion caused by this accident the sports car driver looked back and proceeded to crash the sports car. Following the impact the sports car driver was killed and now people are looking for a place to distribute the blame for these two deaths. It must be decided if the officer is at fault for these deaths and the best way for the police department to act following these deaths. The legal, ethical and moral aspects of each situation must be evaluated. After this evaluation is made decisions must be made that incorporate and satisfy all of these variables in a manner most favorable to the police department.
The young girl gazes at you helplessly from within the tangled wreckage. You witnessed the crash – a massive truck careened into a minivan as it passed on the highway, killing the driver on impact, and virtually tearing the girl in half. Now she hangs from the car, held together by the seatbelt. Her nervous system critically damaged, she can’t feel much pain, but she knows that her situation is not optimal, to say the least. She is six years old – she probably doesn’t understand the concept of death. As you stare equally helplessly into her fear stricken eyes, the only words that you can muster are: “Don’t worry, everything will be okay.”
Every 33 seconds, a child is involved in a car accident (Herrick). Do you have any younger siblings, cousins, nieces or nephews? Are any of these kids small or young enough to need some type of car seat or booster seat? I did research on the topic of child car seats and I believe that it is a very important topic. Today, I am going to try and persuade you that children should always be put in the proper safety restraint in a car.
People, like Brittany Leedham was fortuitous to survive from a teen car accident, but others like her boyfriend Zak Kerinuk was not able to come out of the crash alive. The event started the Saturday night after Thanksgiving, November 29th, 2008. Just in the year 2008 alone, a total of 3,118 teenagers in America died due to a result of a car accident. They were riding in a convertible Mustang GT going at 70 miles per hour when Zak swerved off the road, hitting a hackberry tree. The impact killed him as she struggled to survive, losing half of her own blood, her legs broke during the crash, as well as her pelvic bone as she called out for help. Looking back at the morbid crime scene and going back to the one spot where the event took place, Brittany could not look at the blood stained tree as the perpetrator of the crash. She states it was the “teenage sense of indestructibility.”
Reader! It has come to my attention that the human world has been thrown into major conflicts surrounding the ethics of restoring the function of the face, using microsurgery, to those with severe disfigurements (Lamparello). This revolution of the science that led to my creation has almost rendered me speechless! No longer will patients feel hideous in their own skin because of unforeseen circumstances. Oh, how it is a horrid life to live, to be unaccepted by your fellow man, no matter how much YOU try and assimilate! Facial reconstruction is an innovative process that can improve the self-confidence of those whom were born naturally disfigured or were disfigured later in their lifetime. Face transplantation implores my interest simply because of how close it pounds at my wretched heart. When I escaped to a land far from the accursed laboratory I was “born” in, I found documents belonging to my creator that detailed his disgusted thoughts during my creation and final “birth”. It was exceptionally difficult to study his horror-stricken account of my hideous appearance (Shelley 34). When he’d lain his eyes on his obsession for the first time, he promptly disregarded his previous claims of my
“In the front seat was Gregg, driving, Sarah, in the middle, and Robyn, on the passenger side. In the rear seat was Jeff, behind the driver, Haley, in the middle, and Rachel, on the passenger side. EVERYONE was wearing their SEAT BELTS, as is our family habit. EVERYONE walked away from this accident with only bruises. The only blood was Robyn had small nicks from glass in a couple of places on her right arm and right leg.
These 70 photographs serve as evidence to what happens in times when young and incident people get in the wreckage by a drunk driver. He was at the scene of a fender bender where 19-year-old Katie Lentd, caught in her ruined auto, was hit by a drunk driver. Sheriff 's deputy Richard Adair won 't overlook it when that fire chief swung to him in despondency . He was concerned. Because he was out of options. The tools weren 't working in a time of need. She had been trapped in her car for an hour with no hope of getting out. Katie Lentd had one request, to pray with the rescuers out loud. Everyone saw in amidst of the rows of corn, at the scene blocked off for nearly a mile, a man appears. He was dressed with a black priest 's shirt, with a white collar. He had a small little white container of anointment oil, that 's what it appeared to be. He inquired as to whether he could anoint the young lady in the auto. Whether it was a priest serving as an angel, or an actual angel, he was an angel to all those and to Katie. It is peculiar that with everyone seeing this strange man, there is not one picture of him. It’s important for reporters and documentary photographers to find at least one picture of David Muir because it makes the life experience more real
In October of 2013 my family’s lives and mine were turned upside down when my seven-year-old cousin was in an accident. My cousin fell through a sliding glass door and cut the main artery in his thigh. He was flown to the Stanford Lucile Packard Children’s Hospital (LPCH) where he spent the next four months having surgeries and fighting for his life. My family spent those four months traveling back and forth from Monterey to Stanford in order to help and support my cousin.
...well aware of the laws and consequences against drunk driving, especially after destroying families due to their carelessness decision. Victims’ families entire life’s are annihilated because of the sudden death of their loved one, and they are never going to be able to reclaim their normal life, while the offender after a few days in prison reclaims his normal life. As a result of the fragile criminal justice system everyday road users share the road with repeat offenders who are highly resistant to change their manner of conducting oneself despite their previous authorization..When an accident happens, fatalities that occur suddenly can be more difficult to deal with than anticipated death because members of the family are not well prepared. Sudden losses are even more difficult to process when a person is killed violently knowing that it could have been prevented.
Face injuries are quite common as a person's face can easily come in contact with the dashboard or the front seat. A person's face is not only susceptible to blunt trauma but also to objects in the car like airbags, windows, glass or side windows. Last but not least, you have to consider a car accidents attorney for pain and suffering and psychological injuries. Car accidents are traumatic--especially if a family has lost a loved one in death.
