Duty of care is the principle that counsellors should take reasonable care and skills in providing their service. Providing their support and using their knowledge and skills to the best of their abilities but within their ethical capabilities for the client.

The factors to take into consideration may include
Domestic violence - the child may have been exposed to domestic violence and as a consequence is at risk of serious physical or psychological harm 

Neglect or aduse - a parent or caregiver may have behaved in such a way that child has suffered, or is at risk of suffering, serious psychological harm

Legally the counsellor could be charged with sexual harassment or assault due to overstepping their professional ground, taking advantage of the clients vulnerable state and/or being sexually involved with a client. They may also face charges for overstepping their duty of care, this leading to a suspension or loss of their license to practice.
Ethically they have not followed the policies of their place of work and their employers are liable to report the them for allowing the development of their sexual
