The case between Terry and the state of Ohio presented major concern for the Fourth Amendment which deals with unreasonable searches and seizure without a warrant. On October 31, 1963, Officer McFadden stopped and searched John W. Terry, Richard Chilton, and another individual for weapons during a night in the state of Ohio because he suspected that they were planning on robbing a store because they kept walking up and down in front of the store. The officer approached them announcing that he was a police officer and decided to search them for weapons for his own safety. Terry which he claimed that his Fourth Amendment which protects all citizens from unreasonable search without a warrant was violated from the moment the officer searched him. Terry appealed the case to the Supreme Court in 1967. The case came also to be known as the “stop and frisk” case. The reason why the name was given is because the officers are only allowed to frisk suspects not search them. The differences between a pat down and a search is that in a pat down, the officer can only pad the individual for hard items they may have inside their pockets. The pat down is mainly to know if the suspect is carrying any weapon that they can use to harm the officer or any other person. Searching a suspect is a little different because that includes a thorough search like checking what is inside a purse or wallet. During a search, an officer could inspect soft things in the pockets of the individual like a small bag of drugs. During a pat down, the officer is not permitted to inspect soft items inside an individual’s pocket. Three police officers were looking for a bombing suspect at Miss Mapp’s residence they asked her if they could search her house she refused to allow them. Miss Mapp said that they would need a search to enter her house so they left to go retrieve one. The three police officers returned three hours later with a paper that they said was a search warrant and forced their way into her house. During the search they found obscene materials that they could use to arrest her for having in her home. The judicial system in America has always endured much skepticism as to whether or not there is racial profiling amongst arrests. The stop and frisk policy of the NYPD has caused much controversy and publicity since being applied because of the clear racial disparity in stops. Now the question remains; Are cops being racially biased when choosing whom to stop or are they just targeting “high crime” neighborhoods, thus choosing minorities by default? For many years prior to the ratifiation, people were smuggling goods because of the Stamp Act; in response Great Britain passed the writs of assistance so British guards could search someone’s house when they don’t have a good reason to. The NYPD don’t need a warrant, or see you commit a crime. Officers solely need to regard you as “suspicious” to violate your fourth amendment rights without consequences. The New York City Police Department enacted a stop and frisk program was enacted to ensure the safety of pedestrians and the safety of the entire city. Stop and frisk is a practice which police officers stop and question hundreds of thousands of pedestrians annually, and frisk them for weapons and other contraband. Those who are found to be carrying any weapons or illegal substances are placed under arrest, taken to the station for booking, and if needed given a summons to appear in front of a judge at a later date. The NYPD’s rules for stop and frisk are based on the United States Supreme Courts decision in Terry v. Ohio. The ruling in Terry v. Ohio held that search and seizure, under the Fourth Amendment, is not violated when a police officer stops a suspect on the street and frisks him or her without probable cause to arrest. If the police officer has a “reasonable suspicion that the person has committed, is committing, or is about to commit a crime” and has a reasonable belief that the person "may be armed and presently dangerous”, an arrest is justified (Terry v. Ohio, 392 U.S. 1, at 30).
The 4th amendment protects US citizens from unreasonable searches and seizures by the government. If it is violated by the government, all evidence found by the unlawful search and seizure must be excluded as per the exclusionary rule which serves as a remedy for 4th amendment violations. Before a remedy can be given for violation of the 4th amendment, a court must determine whether the 4th amendment is applicable to a certain case.
The stop-and-frisk policy could be considered a big controversy facing New York in recent times. The whole concept behind this stopping-and-frisking is the police officer, with reasonable suspicion of some crime committed or about to be committed, stops a pedestrian, questions them, then if needed frisks the person. This policy started gaining public attention back in 1968 from the Terry v. Ohio case. A police officer saw the three men casing a store and he believed they were going to rob the store; this led to him stopping and frisking them. After frisking them, he found a pistol and took the weapon from the men. The men then cried foul and claimed they were unconstitutionally targeted and frisked.
The amendment that raises my own eye is the Search and Seizures Clause of the Fourth Amendment. Like most of the Bill of Rights, the Fourth Amendment has its origins in 17th and 18th century, English common law. Unlike the rest of the Bill of Rights, the Fourth Amendment's origins can be traced precisely it arose out of a strong public reaction to three cases from the 1760s, two decided in England and one in the colonies. Two cases from England, “Entick vs. Carrington” and “Wilkes vs. Wood”, involved plaintiffs who produced pamphlets criticizing the government. During the arresting, officials seized books and papers from the plaintiff’s property. A court agreed that the officers’ actions constituted trespassing. The third case occurred within the colonies and involved “writs of assistance,” which permitted officials to search for smuggled goods without specify which house or what goods.
Law Enforcement policy is designed to help law enforcement agencies cut down on the amount of crime in communities and give structure to the agency. It also helps lessen the number of certain cases in certain areas, as well as from a certain group of people. There are several policies that I disagree with, but there is one policy I will be discussing. Law enforcement officers sometimes stop and frisk people based on gender, race, financial status, and social ranking. It is a very controversial issue because anything dealing with race and ethnicity can cause a lot of disagreement and discord. According to a New York judge on dealing with the stop and frisk laws, "If you got proof of inappropriate racial profiling in a good constitutional case, why don't you bring a lawsuit? You can certainly mark it as related . . . . I am sure I am going to get in trouble for saying it, for $65 you can bring that lawsuit" (Carter, 2013, pp.4). The stop and frisk law is one reason I do not believe in law enforcement profiling. Even though some law enforcement officers allow personal feelings and power to allow them to not follow policy, some policies are not followed morally because I do not feel that officers should be allowed to frisk someone who is innocent and has not committed a crime because it takes the focus off real criminals and onto innocent people; it causes emotional stress. I know because I have been through this several times.
The Fourth Amendment Reasonably states probable cause, which is a higher standard than the suspicion standard that applies to all non-intrusive searches.
The Due Process Clause of the Fourteenth Amendment states that no state shall deprive any person to life, liberty, or property without due process of the law. Kingsley claimed that pretrial detainees under the Due Process Clause had a liberty that consisted of freedom from the use of excessive force. Kingsley had to prove in court that Hendrickson used excessive force which was defined as force that is applied recklessly that is unreasonable in light of the facts and circumstances at the time (Kingsley v. Hendrickson, 2015). He had to prove that Hendrickson used force on him, that the use of force was unreasonable in light of the facts at the time, that the defendant knew the use of force could risk harm to the plaintiff, and that Hendrickson caused some pain to Kingsley (Kingsley v. Hendrickson, 2015). Kingsley failed to prove that Officer Hendrickson use of force was unnecessary thus losing his court case. The Due Process Clause of the Fourteenth Amendment protects pretrial detainees from the use of excessive force that would amount to punishment. Punishment couldn’t be proven without an expressed intent to inflict punishment. Without Hendrickson expressing his intent to punish, the court couldn’t prove that excessive force on Hendrickson to remove his handcuffs was used as
