INTRODUCTION: This case involved victim Rosa Hernandez being punched on the left side of her face, and punched on the left side of her back by her boyfriend, Francisco Valdez, during an argument. Hernandez did not sustain any visible injuries. Hernandez had a complaint of pain to the left side of her head and the left side of her back. Upon our arrival, I contacted Rosa Hernandez, who is Spanish speaking outside of room #104. Officer Cuevas #2077 and Officer Carranza #1266 (Unit #10) arrived on scene to assist. Officer Cuevas translated and the following is a paraphrased summary of our conversation: Hernandez said that she has been in a relationship with her boyfriend, suspect Francisco Valdez, for 1 year. Valdez lives in the Lincoln Hotel. Valdez asked Hernandez to come stay with him. She has been staying at the hotel for two days. On today’s date at approximately 12:40 PM they were inside room #104 arguing over luggage. Valdez did not want Hernandez's belongings all over his room. Valdez became upset and spoke negatively about Hernandez's mother and child (they do not have a child together). Hernandez does not remember exactly what Valdez said, but she became angry. Hernandez attempted to slap Valdez out of anger. Valdez caught her hand and punched her on the left side of her face and on the left side of her back, unknown. A well-nourished, well-developed Hispanic female named Anna Garcia standing at 65 inches, 165 pounds and in her late thirties was found dead in her house after her concerned neighbor Doug Greene was suspicions as to why she didn't take her dog out like she did normally, and why the dog was barking constantly for two hours. The police received a call from Greene on August 31st at 9:45 am and arrived at the crime scene at 9:56am.The police found Anna lying face down in the hallway. Authorities observed a pool of blood around her head and some vomit beside her. It was 73 degrees inside Anna’s house, while it was 92 degrees outside. Anna was last seen alive by her former husband, Alex Garcia the night before her death. Investigators measured her rectal temperature, and came to a conclusion that she died at 7:00 am in that same morning. A medical examiner was also called to perform an autopsy to see what really caused Anna's death.
Inside Lopez’ right front pant pocket, Investigator Weber found Lopez’ CA issued identification card F4297435 and a single “Toyota” car key. Investigator Weber palpated Lopez’ head and found it to be extremely soft to the touch and was very unstable. When Weber moved Lopez’ body and head, I saw a full thickness laceration approximately 4 to 6 inches to the top of Lopez’ head. Lopez’ left face was extremely swollen and it had multiple lacerations. Inside the puddle of bright red blood I saw multiple white matter tissue which based on my training and experienced, I recognized as brain matter. On March 31, 1992, he was convicted of second-degree murder. Finally, on April 22, 2008, he was found not guilty of the murder.
Happening in today’s society, there have been countless number of citizens being killed by law enforcement. Some situations may not cause for force and others may. This case can be a reference in regards to making sure that the force you use is appropriate for the situation. As for the justice system, it is all about being fair and listening to both sides and issuing out the right punishment if there is any. Many people in today’s time needs to get educated when it comes to the reason behind why law enforcement uses force to handle the situations they have to deal with. Victim Avina told me approximately five years, prior to getting married, Suspect Avina threw his dress shoe at her. The shoe hit Vicitm Avina is the stomach which did not cause any injuries. About two months ago, Suspect Avina attempted to push Victim Avina’s right shoulder. Victim Avina lend back and avoided the push but hit her right upper thigh against the living rooms coffee table. The impact later left a quarter size bruise. Victim Avina took a photograph of the bruise (see attached photo).
Ernesto Miranda from Phoenix, Arizona was a poor man. He was arrested due to circumstantial evidence from a woman that recognized him in a police lineup for violently assaulting her. A few short days later, Ernesto Miranda was charged with the rape and kidnapping of the woman. Once in police custody, he was interrogated for about an estimated time of two hours with no attorney present. The police officers that questioned him did not inform him of his Fifth Amendment rights in contrast to self incrimination and the Sixth Amendment right to have an attorney present in the mist of being questioned. During the Of Mice and Men debate, it considered the following case: George Milton’s decision to shoot Lennie Small was morally justified. Before the trial started, I voted for the motion because I agreed that it was right to kill Lennie. I chose to side with the proposition team because of several reasons. First of all, I placed myself in George’s feet, the killer of Lennie, and thought about what I would’ve done in his situation. I concluded that I would’ve done the same exact thing as he did. George was the only person who truly cared for Lennie and has always stick by his side through thick and thin. He wanted what was best for Lennie and chose the best idea available at the time, which was unfortunately to shoot Lennie in the back of the head. If he didn’t allow Lennie a peaceful death,

Even though the woman racially discriminated him only based on the way he looked, he did not argue, was still polite and finished his job without saying a word. This is a trait of Hispanic and Latino American populations, Ritter and Graham wrote that “Hispanics tend to avoid conflict and criticism and prefer smooth relations based on politeness and respect” (Ritter & Graham, 2017, p. 152). To this point, I noticed something else again from the same individual. When he had the discussion with Farhad, a Persian store owner that hired him to fix a lock on a broken door, the audience could see that he did not want to argue and just wanted to leave, that is why he left without asking for the money. This episode of the movie was closely related to the characteristic about Hispanic and Latino American population that I mentioned previously. On the other hand, the movie contradicts this because in the first scene the Hispanic woman looked like she was looking for a discussion with the person that crashed into her. An additional characteristic that I noticed that the woman did not have in relation with her culture was the eye contact with the policeman, at the very beginning of the movie. Police corruption, misconduct, and brutality in the United States have been issues since the creation of watch system in the United States (Grant& Terry, 2012). New policy and training is now in place and the corruption, misconduct, and brutality has gone down since the beginning of policing. This is a huge issue that impacts all police organizations in the United States. The extent of police corruption, misconduct, and brutality is hard to track in the United States. A lot of these crimes go unreported, tossed aside, or the officer responsible gets little or no punishment. This is huge issue in the United States criminal justice system.
It took a bit of thought to come up with something that I could change about myself in this project. I do not mean there are not things to change, there definitely are. But, I find myself usually catering to my family when it comes to my behavior, their wants and needs. I decided to try to make my mornings more efficient with the way I start the day because that usually is the only time I have to myself. I chose to drink more water and do yoga each morning to center myself. I was hoping that by doing so would also help with weight loss without focusing strictly on that.
Police brutality is an act that often goes unnoticed by the vast majority of white Americans. This is the intentional use of “excessive force by an authority figure, which oftentimes ends with bruises, broken bones, bloodshed, and sometimes even death” (Harmon). While law-abiding citizens worry about protecting themselves from criminals, it has now been revealed that they must also keep an eye on those who are supposed to protect and serve.
