In her essay “A Feminist Defense of Abortion” Sally Markowitz addresses the Autonomy defense as not being feminist in nature. She comes to this conclusion by recognizing that the right to bodily autonomy is not just a female right but a right that is innate for every person, male or female. Markowitz then asserts that the human right to bodily autonomy in regard to abortion should not be a gender neutral defense. Many feminists have come to the conclusion that the Autonomy Defense works against women in the courts as it shifts the focus away from gender inequality. Feminists have adopted the belief that sometimes gender should be relevant in claiming rights. To fail to claim a right on the basis of gender in the situation of abortion would obscure the relationship between reproductive practices and their oppression.
In order to understanding how women have been discriminated against we must know the history behind the most controversial topic in women’s rights, abortion. For decade’s legal scholars, social movement activities, and historians, have agreed whether women actually had rights when it came to abortions and understanding the pro-life feminist reform. In Mary Zeigler, "Women's Rights on the Right: The History and Stakes of Modern Pro-Life Feminism.” Pro-life advocates have argued that “abortions cause more to the woman rather than help them.” (Zeigler233) One of the most popular known cases is Gonzales v. Carhart which attempted to justify abortion restrictions on the very basis of the physical or psychological harms that could or assumed to be caused or produced by the actual procedure.(Zeigler234) However, women protective claims, only one part of larger strategy that this Article calls prolife feminism. In this crisis of citizenship, with no one quite sure of where s/he stands in relation to the norm, and everyone forced into an identity politics, the fetus represents the ideal citizen - utterly vulnerable and in need of government protection. Pro-life arguments describing fetuses as the ultimately silenced, victimized minority capitalize on the shifting meanings of citizenship to find a place for the fetus within it. By mixing the language of minority politics (asserting distinct identities of classes of people who are victimized by society) and Reaganite ideology (affirming the politicization of the private sphere overseen by the government (Berlant, 3), the pro-lifers constructed the fetus as an image of perfect vulnerability: "the unprotected person, the citizen without a country or a future, the fetus unjustly imprisoned in its mother's hostile gulag" (Berlant, 97). The fetus's vulnerability and minority status speaks to the plight of the newly distinguished class of normative citizens (usually white, straight, middle-class men).
No other element of the Women’s Rights Movement has generated as much controversy as the debate over reproductive rights. As the movement gained momentum so did the demand for birth control, sex education, family planning and the repeal of all abortion laws. On January 22, 1973 the Supreme Court handed down the Roe v. Wade decision which declared abortion "fundamental right.” The ruling recognized the right of the individual “to be free from unwanted governmental intrusion into matters so fundamentally affecting a person as the right of a woman to decide whether or not to terminate her pregnancy.” (US Supreme Court, 1973) This federal-level ruling took effect, legalizing abortion for all women nationwide.
The article “Women of Color Deserve a Voice in the Debate over Planned Parenthood” by Ijeoma Oluo, states that women of color have the right to become pregnant, right to prevent pregnancy, and the right to raise the baby. The battle over abortion rights is more heated than it has been in decades. This is a dangerous problem, because women of color are being ignored by many in the mainstream abortion rights movement, they are also being exploited by the anti-abortion movement.
Feminist Theory is an aspect of considering feminism as having been based on socio-phenomenon issues rather than biological or scientific. It appreciates gender inequality, analyzes the societal roles played by feminists in a bid to promote the interests, issues and rights of women in the society. In 2000 the United Nations Populations Fund (UNFPA) defined reproductive rights as "the basic rights of couples and individuals to decide freely and responsibly the number, spacing and timing of their children; to have the information and means to do so; and to have the right to make decisions concerning reproduction, free of discrimination, coercion or violence."[1] Traditionally society defines reproductive rights in the context of one's being able to make decisions about his or her own reproduction; other individuals, unrelated to that person, were not considered as being involved in the decision. With the onset of in vitro fertilization (IVF) in 1978, reproductive processes have become more complicated. For example, in gestational surrogacy a surrogate mother, not genetically related to the embryo, is brought into the process of reproduction. This technique allows infertile couples to carry a child or children in the womb of a carrier, rather than in the womb of the biological mother.[2] As a result of this ethically controversial technology, society must modify its reproductive rights. In vitro fertilization (IVF) alone will not solve people's reproductive problems and protect everybody's rights. Society, therefore, must distinguish whose rights-the rights of biological parents or those of the surrogate mothers-should be protected.
Since the early 1970’s abortion has been an important issue to the United States (Tietze 1). The problem begins with whether it is the woman’s choice to keep or terminate her pregnancy or the government’s choice. When this problem happens, a woman loses her right as a person. Most women argue about this issue, but if you look at it, it is the woman’s body, and she should do with it as she pleases. I believe that if a woman, under the right circumstances, should be able to make her own choices in life and not be influenced by family or the government.
The battle for women’s reproductive rights is similar to the struggle for African Americans to have “the full liberty of speech in public and private” as Dredd Scott found out in 1865 when he petitioned for his personal freedom from slavery and lost. Moreover women’s reproductive rights are akin to defending the rights of racial equality, civil rights, desegregation, same sex marriage, and universal human rights. Every individual should have the right to choose how to live his or her private life in today’s society without governmental interference or control.
Feminism is a perspective not a research method, meaning there are multiple ways to approach the study of women (Reinharz, 1992). However, a central goal of feminist empiricism, standpoint epistemology, and post-modernism methodologies is that women's lives are important and must understand women from their perspective and in context (O’Donnell, 1985, in Reinharz, 1992). Feminist methodologies all share a dedication to move the focus from the masculine perspective to incorporating both men and women to advance knowledge (DeVault, 1996). Therefore, it is research about women but also for women. It aims to identify various intelligences, the different ways of knowing, and to give a say to the silent voices (DeVault, 1996). Feminist methodologies have opened society’s eyes to a new and innovative way of carrying out research, and have influenced other fields and the way research is formulated. It has also challenged societal norms by questioning patriarchy and traditional notions.
