Mental Health Probation Mental health probation is for offenders who have severe and persistent mentally illness (Delisi,
& Conis, 2013). This probation tries to decrease recidivism, but the probation officer does hold the malefactor accountable for their crime(s). The probation also tries to lower the cost of protecting the community while utilizing a cost effectiveness and getting the offender treatment.
Mental health probation helps with the long-term security for the offender, and helping them become a productive, law abiding, and furnish positive relationships with their friends, their family, and also with the community they live in. It is a process that the juvenile has to comply with for an informal probation other than going to jail, and conditions are set by the court (Torbet, 1997). The juvenile probation is called the workhorse (Delisi, & Conis, 2013). The juvenile probation system has programs to help with issues for the juveniles and their families. There is a team of people in the court system who all work together to help and treat juveniles with serious mental issues. The team is comprised of judges, juvenile probation department, county medical hospital, District attorneys office, and the public defenders office. A juvenile can stay in jail depending upon the seriousness of the crime they have committed. The offenders that get on juvenile probation is, of course, juveniles, low-level offenders, first time offenders, ones who commit property crime, person offenses, public disorder, and drug violations (Butts, J., et al, 1995). It is an alternative to juveniles who commit harsher crimes (Delisi,

Sex-offenders have to attend treatment, can be put on electronic monitor, submit to a polygraph test, give probation officer home address, register as a sex-offender, and has to let the Department of Public Safety know if they move or change their address. There is no drinking or drugs, they may have to give up their computers, tell sex partners about their history, and some even chemically castrated. Sex-offenders may have more than two probation officers or parole officers. An unit team will monitor and help to rehabilitate the offender. The sex-offender will have a curfew and have to pay fines and restitution. One of the fasting growing juvenile treatment and interventions programs are known as teen courts. Teen courts serve as an alternative juvenile justice, to young offenders. Non-violent, and mostly first time offenders are sentenced by their peers’ in teen courts. Teen courts also serve as juvenile justice diversion programs. Teen courts vary from state to state, and sometimes within the same state. With this program, all parties of the judicial setting are juveniles with the exception of the judge. Each teen court, is designed specifically to meet the needs of the community it serves. Teen courts were created to re-educate offenders throughout the judicial process, create a program with sanctions that will allow the youth not to have a juvenile record, and to also instil a sense of responsibility.

The process of transferring juveniles to adult courts has shown no effects on decreasing recidivism or a deterrent outcome. Waiver as it is known has three means by which a juvenile can be transferred to an adult court. Judicial waiver offenses, statutory exclusions, and concurrent jurisdiction are the three methods in which a waiver can occur. This research will describe each one of these methods with detail. It will also provide statistical facts showing why waiver can be a very debatable topic within the juvenile criminal justice system. In its totality it will discuss the arguments for and against waiver.
The Juvenile Justice System in the State of Texas celebrated its 100 Birthday in 1999. Many people believe that the Juvenile Justice system is equal to the adult system and that juveniles are punished as adults are but that is not always the truth. The Texas Juvenile System is made up of a mixture of the Criminal Law and the Civil Law. It is governed by The Juvenile Justice Code which is called the Title 3 of Texas Family Code. The only similarities that are shared with the Adult system are that it also refers to the Texas Penal Code and the Code of Criminal Procedures for rules. The steps of The Court Procedures are: If a child is arrested, they are detained in a child facility, a child is not bonded out but most go before a judge. Once before the judge, it is decided if a petition will be filed depending upon the severity of the offense. The child can then make his or her pleading if the child wishes to plead not guilty a jury child can be requested. Even if there is a jury trial, only the judge can determine the punishment. The judge is also limited to the punishment that he or she can sentence because of the Juvenile Code’s Progressive Sanction Levels. This is the method which the Juvenile system uses to rank crimes.

After careful consideration and great thought this is the route I decided to take. I believe that parents play a great role in some of the decisions their children make. The decisions children make today are a reflection of their parents. My focus on this probation model is to place both child and parent in an institution were they would undergo a period of restoration of family values, rehabilitation, parenting courses, academia and counselling.
