In contrast to it, E-cigarettes heat up liquid to produce vapor which could be inhaled instead of smoke. This vapor contains nicotine, flavorings and other chemicals. The results demonstrated that Traditional cigarettes contained same level of nicotine as that of e-cigarettes. Legal Aspects of E-Cigs in India The E-cigarette market in India will grow at a CAGR of 63.38 percent over the period 2013-2018. In India, the use of electronic cigarettes is currently legal. India does not have laws that deal directly with the sale of e-cigarettes, which fall outside the purview of the Cigarettes & Other Tobacco Products Act (COTPA), 2003, which regulates the sale, ads and use of tobacco products. Under the Indian Health Law of 2006, tobacco smoking has been banned in public. Since e-cigarettes avoid the use of tobacco, they do not fall under this law. The Central government now plans to come out with a legislation prohibiting the sale of these electronic inhalers, which are freely sold online as well as in large cities. Going by the Global Adult Tobacco Survey, India has an estimated 27.49 crore tobacco users including 16.37 crore users of smokeless tobacco and 7 crore smokers. The remaining four crore use both traditional as well as e-cigarettes. Marketing of e-cigarettes in India India has a fledgling but growing market for e-cigarettes dominated by foreign brands Traditional cigarettes are banned from any kind of advertisements or marketing. There are strict norms and regulations surrounding cigarettes. However, it is not the case for e-cigarettes. The manufactures of e-cigarettes take advantage of the lack of any clear regulation regarding e-cigarettes. It has been advertised on TV in countries like USA. ‘Celebrities Vaping’ has been a major marketing puh for e-cigarettes in developed countries, However, In India, such trends have not emerged. The major marketing platforms adopted by the e-cigarette manufacturers are as follows: • Social Media • E mail marketing • Company websites The vapor devices, rarely seen in Indian stores, are widely promoted through social media, direct email marketing and even company websites. Last month, the diversified ITC Group launched its Eon brand of e-cigarettes to add its range of conventional tobacco products. E-cigarettes are commonly advertised on Twitter and the tweets often link to commercial websites promoting e-cigarette use. Challenges: No scientific and definitive information is available about possible benefits or harms of e-cigarettes. In June, a group of 122 experts from across the globe had written to WHO Director-General Margaret Chan saying that manufacturers of electronic nicotine delivery systems (ENDS) are misleading the public by projecting their products as an aid to quit smoking, for which there is no concrete evidence. The federal Food and Drug Administration in the United States in April of 2014 proposed certain basic rules regarding the regulations of this new product. FDA is yet to approve them as smoking cessation tools. ETHICAL VIEW The ubiquity of the digital cigarette is undeniable. They are present everywhere. It has raised quite a few doubts about the e-cigarettes. While the e-cigarette manufacturers may not have any laws governing them as of now, it does not free them of their ethical responsibilities. Even if the e-cigarette product is a legal one in certain jurisdictions, nonetheless is it a moral product? In the name of selling a harmless product, is the Marketing & Advertising of this Product also influencing minors, either directly or indirectly? Are they being targeted knowingly and even if it is not deliberate, does it end their moral responsibility here? Are e-cigarettes the new “evil weed” because they contain nicotine and thus may entice people, particularly young people, to smoke and perhaps get “hooked” on much stronger nicotine tobacco products? Or are e-cigarettes a good and beneficial product, due to their low nicotine content, because, like nicotine patches, they perhaps can function as a smoking reduction and maybe cessation device? Any advertising of nicotine cartridges in e-cigarettes must state truthfully, accurately, and fully just what they are supposed to contain.
And, of course, the advertising cannot be deceptive or misleading as to any health benefits to be derived from the product. However, most of the e-cigarette advertisements make tall claims about the e-cigarettes being safe and they are even offered as ‘smoking cessation alternatives’. This is done even when FDI is yet to allow them to do so.
In all, E-Cigarettes present an ethical dilemma to the society.
On the one hand, e-cigarettes hold the promise to save the lives of many smokers who switch to them; while on the other hand, they present mammoth risks to the society.
• E-Cigarettes may actually fail in getting people to quit smoking and it may even lead to dual usage of cigarettes along with e-cigarettes. It would mean doubled intake of nicotine and will cause more harm to smokers.
• It may lead to increased initiation of nicotine products among youth
• Former smokers may be tempted to switch back to nicotine in the form of e-cigarettes
• They may become a ‘gateway to smoking’. Teenagers may first start by trying e-cigarettes and then they may get addicted to nicotine and move to actual
cigarettes. • It might just act as a license for smokers to smoke at public places or in offices where traditional cigarettes are banned. SURVEY Results In the survey conducted by U.S. centers for disease control and prevention for why the people are using e-cigarettes or what are the reasons that they are trying e-cigarettes .The results were as follows • Almost 65% were of the view that they want to try something new that’s why they are using the e-cigarettes • About 55% started using e-cigarettes as they want to quit/reduce smoking and as e-cigarettes are positioned as product that can help people reduce smoking so they are using e-cigarettes • About 50% have cited that they are using e-cigarettes as they think that e-cigarettes are less harmful as compared to traditional cigarettes so that’s why they are using e-cigarettes. As e-cigarettes contains no tobacco as compared to traditional cigarettes so we can say that they are less harmful • About 45% were of the view that the major reason that they want to use e-cigarettes was because they don’t want to disturb others from there smoke. Non-smokers will benefit from not being around and exposed to conventional “second-hand smoke” of the users of conventional tobacco products rather, they will “merely” be exposed to some cloud-like mist. Furthermore, smoking in enclosed spaces has been deemed to be particularly socially unacceptable these days; but the use of the e-cigarette, which produces “merely” a vapor and not smoke, may make “smoking” socially acceptable in buildings, offices, movie theatres, restaurants, and other public places • About 20% were of the view that the major reason that they started e-cigarettes is because they can smoke in areas where smoking e-cigarettes is banned. Furthermore, smoking in enclosed spaces has been deemed to be particularly socially unacceptable these days; but the use of the e-cigarette, which produces “merely” a vapor and not smoke, may make “smoking” socially acceptable in buildings, offices, movie theatres, restaurants, and other public places. Some employers may allow employees to smoke e-cigarettes so long as other employees, customers, or clients to not object. Perhaps even productivity will increase with e-cigarettes if vaping is allowed in the office, since certain employees will not have to take time off for their usual and usually frequent cigarette breaks. • About 23 % were of the view that the major reason that they started using e-cigarettes is because they think that they taste good as compared to traditional cigarettes. Nicotine cartridges are also exempt from tobacco taxes, which make up a large part of the retail cost of a traditional cigarette, and thus the price of an e-cigarette is more competitive with traditional tobacco products. From my late teens, into my mid-twenties, I was a smoker. At first, it was just recreational; however that changed fairly quickly. I began buying them and smoking regularly throughout the day. It then progressed to smoking a pack per day until it was too late. I was officially addicted. I knew it was a terrible habit and I was shamed of it and would hide it from friends and family hoping they wouldn’t find out. Finally, after coughing hacking, and repeatedly getting sick several times a year, I came to the realization that I had to quit. However, it wasn’t as easy as I had anticipated.
