To start with, it is a crime for one to be found in possession of the drug. This is in regard to whether the individual is using or not using the drug. Possessing the drug is likely to suggest that the individual is either a user or a distributor of the drug. In regard to the United States controlled substance 21 U.S.C. § 841(c)), possession of the crystal meth drug is illegal in many states. In many states, an individual can be arrested for possession of the drug and not for the possession of the ingredients (Gottfredson 5). This is ironical as the ingredients are more important that the drug itself. The person having the meth itself should be arrested as he or she has the weapon which can lead to destruction as compared to the person who has the drug but does not know what it entails to make the drugs,. The laws should be more specific in fighting the use of this drug by talking and managing the circulation of the ingredients. Being a chemical drug, it is much easier for chemists to come up with the combination and purchase the ingredients (Gaines 113). Through the ingredients, a constant supply of the drug can be continued. It …show more content…
According to the federal law, any individual indulged in the sale of this drug is committing a crime. In California, an individual found selling the drug can be jailed up to three years in prison. Selling the drug is a felony crime that can have further serious consequences to the accused. Not only is this a felony crime but it can also carrier other consequences which can be increased to more than three years if the sale was made to a minor or if the defendant or the accused is a repeat offender. Some people are also involved in trafficking which has the same consequences as that of selling the drug. Due to the placed laws, the distributors have come up with more cunning ways to get to their clients. This is what has resulted to more cases of drug trafficking. Being charged with drug trafficking of meth, a defendant can face anti-drug charges placed by the federal government. Depending with the quantity and quality of meth involved in the case and the defendant prior criminal history, the set legal consequences can range from 40 years in prison to life imprisonment (Gaines 213). There has been some argument regarding the punishment of the people found selling the drug. Some of the argument is that the offender may not be aware of what they are selling. This is because the packaging of the drug cans sometime being changed and hence an innocent person may be caught unawareness selling the drug. Another thing
If you get caught with narcotics, your sentencing depends on the amount you are caught with, for example, crack cocaine is five years, for five grams. Powder cocaine is five years for five hundred grams, heroin is five years for one hundred grams, methamphetamine is five years for ten grams, PCP is five years for ten grams, this is not what high level drug traffickers are involved in. most drug cases involve low level offenders. It all depends on the amount you have on you, while you get caught with the controlled substance. There was a mandatory minimum sentences were criticized by the U.S. sentencing commission as early as 1991. In the report they found that all defense lawyers, and nearly half of the prosecutors, they all seemed to have a problem with mandatory minimum sentences. They would try there hardest to get away from the mandatory minimum
...tistical data put forth that the phenomenon of using and manufacturing methamphetamine is rising in our country. The state of Kentucky, particularly the rural areas, is being taken over by the use and manufacturing of meth. This phenomenon is largely costing the tax payers, as well as, putting our future generation in jeopardy. This author feels it is important for the Kentucky Legislative to look at the numbers, the cost and proper treatment in order to deal with this large problem correctly. Passing one law to decrease the manufacturing by less than ten percent isn’t enough.
Two effects of meth addiction are an increase in property crimes and an increase in the number of children entering foster career. Shockingly, half of the inmates in Portland jails were meth users, and meth addicts commit 80% of the property crimes in Oregon. These statistics show how meth can not only negatively affect an individual and a family, but a whole community. The correlation between property crimes and meth can be explained by the fact that meth is an ultra-stimulant. According to the video, one puff can an individual stay high for even a whole day. As a result, the person’s dependency leads them to do things or commit crimes they would not have done otherwise
among gangs, etc. The outcome of being addicted to crystal meth for to long will lead to death. This
Meth is not only highly addictive it is easily "cooked" in homes across the country. Unlike some drugs, which are derived from natural sources, meth includes an array of dangerous chemicals. These chemicals can include battery acid, rat poison and motor oil.
Drug abuse refers to the sale, possession, or the manufacture of an illicit drug. Bartol and Bartol classify dominant psychoactive drugs into four categories, namely: stimulants, hallucinogens, sedative-hypnotics and opiate narcotics (2011). A psychoactive drug is a chemical substance that influences an individual’s perception, decision-making, behavior, and mood (Bartol & Bartol, 2011). Methamphetamine, popularly known on the streets as meth, glass, crystal (pure form) or speed, is a drug that traces its origin from the West Coast in the 1970s and has swept across the United States. The relationship between drug and substance abuse and criminality is not a simple one.
Don't let incarceration or death affect the life of you, or someone that you love. Understanding the horrific effects of methamphetamine can make a difference in life or death. According to T. Lopez (2014), at age eighteen she lost her father due to the impact that methamphetamine had on his heart and kidneys. Nevertheless, a few years later she and her husband became a victim of the awful cycle of addiction. Unfortunately, due to their addiction they became involved in criminal activity and found their selves jailed leaving behind their five children. Methamphetamine is a potent stimulant that affects the central nervous system (CNS). It is commonly called speed, meth, chalk, ice, crystal, crank, and glass. Meth is a white, odorless, bitter-tasting crystal-like powder that easily dissolves in water or alcohol (Speed , 2011). It was created “from the drug amphetamine, and was originally used in nasal decongestants, bronchial inhalers, and the treatment of narcolepsy and obesity” (Treating Methamphetamine Addiction). Methamphetamine is considered to be “a Schedule II drug - a drug with little medical use and a high potential for abuse” (Treating Methamphetamine Addiction). Although it can be made in small secret laboratories with fairly inexpensive over-the-counter ingredients, “over 85% of methamphetamine is made in super labs in California and Mexico” (Meth Addiction Statistics, 2014). Methamphetamine abuse is a very serious addiction that affects a user’s mental and physical states while simultaneously destroying their lives; without managed treatment, misfortune is inevitable.
“Meth, not even once” is a popular phrase that is associated with this drug. This drug has many known horrible effects associated with it, plus many effects more I am sure are going to be discovered over time. I am intending to cover the history, effects, the different categories of meth abuse, and the withdrawal effects of Methamphetamine in this paper, and what to do if you suspect someone you know is using meth.
shouldn't be punished the same as a person who has way over the legal amount and had intent to sell. But now with the mandatory minimums it doesn’t matter and they are both treated the same.
