According to the video “The Criminal Justice System Myth v. Reality: Crime has been steadily increasing” during the late 1980's early 1990's the crime rates overall had gone up because of the increased number of juvenile crimes and homicide rates for youth. It’s these kinds of trends that caused population growth in prisons. Additionally juveniles being sent from juvenile courts to adult courts and changes in policies such as mandatory minimum laws that required time in prison for drugs and crimes related to homicide.
What is about to lead us into another boom in crime and thus population in prison is the economic downturn. Crime rate rises in areas of high joblessness and poverty. It’s fair to say those that will commit crimes will regardless
of outside factors, but those who would normally not commit crimes may feel their backs against a wall and "pushed" into crime to try and make ends meet. I think that in addition to all that’s being said there is a lot of kids who get so overwhelmed and the feelings of being alone are too much for them. That in addition to absentee parents (for various reasons) gives the kids the means and opportunity to seek out filler for that void. Not all choices have turned out for the worst but in poor areas a lot of these choices are personal crimes, the “wrong crowd” and gang affiliation. This and when these people have their own children you will get a lot of new children that follow in their parents footsteps or follow the example lead by their parents. This unfortunately creates a cycle especially when one parent is absent due to prison time and the other due to work to pay bills. Plus once you have a record it’s hard to go straight where there aren’t a lot of jobs to begin with and the ones that are available have the option to be picky and not want someone with a record.
Increased tensions during the 1960s in the context of the Civil Rights Movement started to cause an increase in crime, sparking a newfound belief in incarcerating the masses to prevent more crime from occurring. During the 1970s, the likelihood of being incarcerated increased for nearly every citizen, especially low-level offenders. If given this prompt at the beginning of this semester I would have answered with a resounding yes, the criminal justice system is racist. The classes I have previously taken at LSU forced me to view the criminal justice system as a failed institution and Eric Holder’s interview in VICE - Fixing The System solidified that ideology. Over the past several decades, the number of prison inmates has grown exponentially. In 1980, prison population had numbers around half a million inmates. A graph of statistics gathered from the U.S. Bureau of Justice shows that between 1980 and 2010, the prison population grew almost five times, topping out at nearly 2.5 million. According to an article in The New York Times, the average time spent in jail by prisoners released in 2009 increased by 36% compared to prisoners released in 1990. Many people, such as those at Human Rights Watch, believe that the increase of these numbers has been because of tough-on-crime laws, causing prisons to be filled with non-violent offenders. This rise in crime rates, prison population, and recidivism, has led politicians as well as ordinary citizens to call for prison reform.
The media plays a huge role in forming people's perceptions of crime. Without the media we would remain ignorant to occurrences outside our direct social groups. The media and especially news coverage therefore provides us with an important point of contact with the rest of society. In evaluating its effect on popular perceptions of crime it becomes important to consider where most of the information comes from and how representative it is on actual criminality. If it takes "facts" (the truth, the actual event, a real thing) or if it is heightened to a crime myth. With a myth being based upon "exaggeration" or heightening of "ordinary" events in life. Today, half of state prisoners are serving time for nonviolent crimes. Over half of federal prisoners are serving time for drug crimes. Mass incarceration seems to be extremely expensive and a waste of money. It is believed to be a massive failure. Increased punishments and jailing have been declining in effectiveness for more than thirty years. Violent crime rates fell by more than fifty percent between 1991 and 2013, while property crime declined by forty-six percent, according to FBI statistics. Yet between 1990 and 2009, the prison population in the U.S. more than doubled, jumping from 771,243 to over 1.6 million (Nadia Prupis, 2015). While jailing may have at first had a positive result on the crime rate, it has reached a point of being less and less worth all the effort. Income growth and an aging population each had a greater effect on the decline in national crime rates than jailing. According to the Bureau of Justice Statistics, in the year 1980 we had approximately 501,900 persons incarcerated across the United States. By the year 2000, that figure has jumped to over 2,014,000 prisoners. The current level of incarceration represents the continuation of a 25-year escalation of the nation's prison and jail population beginning in 1973. Currently the U.S. rate of 672 per 100,000 is second only to Russia, and represents a level of incarceration that is 6-10 times that of most industrialized nations. The rise in prison population in recent years is particularly remarkable given that crime rates have been falling nationally since 1992. With less crime, one might assume that fewer people would be sentenced to prison. This trend has been overridden by the increasing impact of lengthy mandatory sentencing policies.
Over the next 10 years the criminal Justice system could entirely change with the passing of a major law, epidemic, or failed service. Consequently, every since 9-11 our justice system has become much more open minded. Therefore, resulting in the strict enforcement of laws to protect its citizens. Nothing ever stays the same for too long. New developments related to science, technology, DNA analysis, and countless other tools and other factors are changing for the better in solving cases, prevention of crimes, and aiding in investigations. Where there is change there will be changes in the way we handle everyday processing. For example, booking a criminal, acquiring evidence, and interrogation. This also results in the field of criminal justice having no choice but to adapt to the slowly changing times or else be left behind.
My first exposure to the criminal justice system was while in high school when I was fortunate to be chosen for an internship with a District Judge John Vance in Dallas, Texas. Judge Vance made certain I had a rich and varied experience. He had me to sit in on several high profile cases in his court and to participate in preparing cases for trial with a prosecutor and defense attorney. In addition, he encouraged me to visit other courtrooms and courthouses to observe the proceedings. This along with him coordinating visits at local jails and law enforcement agencies gave me a broad and well-rounded perspective of the criminal justice system. The criminal justice system is composed of three parts – Police, Courts and Corrections – and all three work together to protect an individual’s rights and the rights of society to live without fear of being a victim of crime. According to merriam-webster.com, crime is defined as “an act that is forbidden or omission of a duty that is commanded by public law and that makes the offender liable to punishment by that law.” When all the three parts work together, it makes the criminal justice system function like a well tuned machine.
With the substantial increase in prison population and various changes that plague correctional institutions, government agencies are finding that what was once considered a difficult task to provide educational programs, inmate security and rehabilitation programs are now impossible to accomplish. From state to state, each correctional organization is coupled with financial problems that have depleted the resources to assist in providing the quality of care in which the judicial system demands from these state and federal prisons. Judges, victims, and prosecuting attorneys entrust that once an offender is turned over to the correctional system, that the offender will receive the punishment imposed by the court, be given services that aid in the rehabilitation of those offenders that one day will be released back into society, and to act as a deterrent to other criminals contemplating criminal acts that could result in their incarceration. Has our nation’s correctional system finally reached it’s critical collapse, and as a result placed American citizens in harm’s way to what could result in a plethora of early releases of inmates to reduce the large prison populations in which independent facilities are no longer able to manage? Could these problems ultimately result in a drastic increase in person and property crimes in which even our own law enforcement is ineffective in controlling these colossal increases in crime against society?
