In the First Amendment of the United States Constitution, it specifically states that the teachings of religion should not be allowed in public schools. Former president, George W. Bush stated "school officials should never favor one religion over another, or favor religion over no religion." Contrary to both Bush’s statement and the First Amendment, public schools are still are still teaching their students creationism and expelling evolution from their curriculum. Therefore, the state laws that make it illegal to teach evolution in schools in America go against the constitutional rights

In Charles Darwin’s life he had helped make a significant advancement in the way mankind viewed the world. With his observations, he played a part in shifting the model of evolution into his peers’ minds. Darwin’s theory on natural selection impacted the areas of science and religion because it questioned and challenged the Bible; and anything that challenged the Bible in Darwin’s era was sure to create contention with the church. Members of the Church took offense to Darwin’s Origins of Species because it unswervingly contradicted the teachings of the book of Genesis in the Bible. In Inherit The Wind, by Jerome Lawrence and Robert E. Lee, is about a big trial in a small town, and a controversial Creation versus Evolution debate. There are many characters with flamboyant and powerful personalities. Among them are: Matthew Harrison Brady, and Henry Drummond. Although all of these influential people are powerful, not all of them have the same amount of power, not only over other people, but over themselves as well.
In cases having to do with constitutionality, the issue of the separation of church and state arises with marked frequency. This battle, which has raged since the nation?s founding, touches the very heart of the United States public, and pits two of the country's most important influences of public opinion against one another. Although some material containing religious content has found its way into many of the nation's public schools, its inclusion stems from its contextual and historical importance, which is heavily supported by material evidence and documentation. It often results from a teacher?s own decision, rather than from a decision handed down from above by a higher power. The proposal of the Dover Area School District to include instruction of intelligent design in biology classes violates the United States Constitution by promoting an excessive religious presence in public schools.

The teacher John Scopes was only teaching evolution in a relation to science evolution. The 1920’s were a time of change. New ideas were becoming more readily experimented with and even accepted by large portions of the population. Some of these included jazz music and the fight against the alcoholic prohibition. The radical idea I will focus on in this paper, however, is Evolution. It is a theory that had been around for over half a century before the 20’s but had only more recently caught on in the US. It contradicted the Christian theory of Divine Creation as described in the Bible. This caused many religious fundamentalists to fight against it. They took their battle to the law books, and they were challenged by pro-evolution modernists in the Scopes "Monkey Trial" of 1925.
The Butler act affected American society by making many Americans question their fundamental mindset during the Scopes trial. Fundamentalism was a religious movement particular to Protestant (WASP) values, that became very popular in the United States in the early 20th century. Despite Fundamentalism being a religious movement, it advanced its way into schools in Tennessee; this helped form the Butler act. The Butler Act was put into motion in 1925, it was a law used to control and adjust science being taught in schools. In spite of the fact that the governor and the people of Tennessee trusted that the Butler act was ideal, especially to “protect the children” against science, they were encroaching upon the freedom of anyone who did not hold
In the United States, the average child goes through public funded schools that have a basic curriculum. According to the Texas Education Agency, some of the subjects include science, mathematics, social studies, English, and more. Nowhere in the subject is religion included. The basic curriculum is made in order to give students skills, knowledge, and to help develop the minds of the future. In science class, evolution is taught either briefly or detailed. It is taught because it is a popular theory that did not seem to choose a certain religion. So why believe that religion and science can be taught together? The evolution of Earth and the universe can be believed in any way an individual chooses.
Teaching of evolution has several issues. One of the main issue is that it is unfair to some students with a background of Christianity. Christians believe in Creationism, meaning God created the whole world or if not, most of the world. Darwin's theory of Evolution is complete contradictory of this. In the Bible, it is stated that God made humans in His image while Darwin's theory says that Humans evolved from monkeys. It is basically proving that God, does not exist, violating the first amendment, Freedom of Belief. The first amendment states "..respecting the establishment of religion..." When Christian students listen and are forced to learn the theory of Evolution, it is restricting them to worship without obstacles and is therefore, disrespecting the establishment of religion by defying the existence of God. Until the early 1960s, religion was accepted in most public school systems across our nation. One of the main purposes for school in early America was for religious purposes (Prothero). Benjamin Franklin stated, "It is religion and morality alone which can establish the principles upon which freedom can securely stand." Thomas Jefferson stated, "The question isn't what religion is true. The question is what religious traditions do we need to know something about in order to be an effective citizen." Something that can be beneficial to our nation should not be taken away. Even though religion offends some people, it should be allowed in public schools because of its influence on America and western civilizations, and its ability to help form closer relationships.

There is a major controversy brewing in the educational field today. Scientist, teachers, professors, and many others are debating where the world and its habitats originally came from. This is the debate of Intelligent Design (ID) and Evolution. The main debating question of many scholars being, "Is the universe self-contained or does it require something beyond itself to explain its existence and internal function?".
Scott points out that school districts have boards in place that have people who “...may or may not know much about the field of education” (Pg. 87-8). He goes on to say that these people, despite the state mandated curriculums that are supposed to be used to guide the districts, have the final say in what their educators can teach. There are parallels between the disorganization of our school system and the religious matters in that there are many sects of Christianity, from which most of the antievolution ideals stem. The Fundamentalist movement in the 20’s is one of the main culprits against evolution as it called for a strict interpretation of the Bible. This movement led to the push to eradicate the concept of evolution from the curriculum due to the fear that it will shake the faith of the youth. This push resulted in the Scopes trial which put the controversy in a new light. Despite the odds, Scopes won but even after that even less schools taught evolution. Much later on, schools began to teach concepts that were scientific alternatives to evolution as creationism was viewed as a religious view and was not allowed to be pushed
Creation Vs Evolution “The greatest mystery of existence is existence itself” (Chopra). Chopra, a world-renowned author, perceives the existence of life as a truly mystifying celebration. The pending question that many scientists, and even theists, attempt to answer is how life ultimately began. Currently, the mystery is left with two propositions, evolution and creation. While both approaches attempt to answer the origins of life, evolution and creation are two contrasting concepts.
There seems to be an equal argument between creationism and evolution, so why is only one taught in public schools? Creationism and evolution have equal evidence for and against them; exposing students to both sides can only do well by giving them new ways of thinking, and if both are just theories, why not teach both? Seeing and learning different opinions will help further the education of students in public schools, and it will only be used for their advantage. Each side deserves to be heard and taught in all public schools.
