Discuss the concept of “precedent” and its implications for court decisions affecting public schools as it relates to case law. The concept “precedent” is an important part of the principles of law established by courts. This concept stated that a case or issue decided by a court can help answer any other future legal questions. It has big implications for the law and surely in decisions affecting the education system. The doctrine that a lower court must follow a precedent is called stare decisis. According to La Morte (2012) “under the doctrine of stare decicis, for instance, a court may stand by precedent and thereby not disturb a settled point of law” (p. 9). This legal concept helps all people have the opportunity to be treated equally, but case law is not always well settle and courts can make different decisions in some cases arguing that, the current situation differs that given in the previous legal precedent or even when the established precedent no longer applies. …show more content…

In conclusion, the precedents can benefit students, teachers, and schools, but we must recognize that as many other court decision, this is not perfect and the precedent itself may have errors or the new legal case may not fit into the provisions of the preceding.
