How Did the Constitution Guard Against Tyranny? In May of 1787 in Philadelphia, we started a draft of our constitution. 57 white males had made their way to the constitutional convention to create our new constitution because the one prior wasn't working. In our old constitution, there was no central government, which led to various problems. The Constitution guards against tyranny by creating three branches, the legislative, executive, and judicial branches. This constitution also created a central government with court systems, a chief executive, etc. Without this new draft, there would be many complications, like, the national government could’ve had less power than the state government. Lastly, Article 3, talks about the Judicial branch, the judicial branch that interprets the laws and handles legal disputes in the court systems. These branches help prevent tyranny by making sure that one person or branch isn't able to have control over the entire government. Checks and balances are very important to help prevent tyranny, because they make sure that each branch does not get too much power. Without checks and balances, it would be very hard to know if a branch has more power than the others or not enough power. As showcased in Document C, checks and balances give each branch the right to check on the other branches, making sure that their power is equally divided. For example, the legislative branch makes all the laws, but they cannot also enforce them. To make it even, the executive branch can decide if they want those laws to be enforced by the judicial branch or if they want to veto the law. Thai helps avoid tyranny by making sure that each branch is unable to abuse power and make it so that each branch can limit the power of the other
