Nearly every aspect of law enforcement has a court decision that governs criteria. Most court rulings are the result of civil lawsuit towards a police officer and agency. However, currently, there is no law that mandates law enforcement driver training. When it comes to firearms, negligence by officers has resulted in a multitude of court rulings. Popow v. City of Margate, 1979, is a particularly interesting case that outlines failed firearms training by an agency. In this case, an officer chasing a suspect during a foot pursuit fired at the suspect, striking and killing an innocent bystander (Justia.com, 2017). The court ruled that the agency was “grossly negligent” of “failure to train” (Justia.com, 2017). As a result, nearly every agency requires annual firearms training and has written policy concerning the same. Officers must show proficiency in firearms use every year to maintain their certification. Many states even impose fines on officers for
In this day and age there are many variations of what constitutes a couple or family in comparison to many years ago. Long ago the idea of a ‘nuclear family’ was considered the norm; it consisted of the conventional husband, wife and children . But as our society progressed through the years this definition became less conventional and criticisms were made, this definition of ‘family’ did not account for gay unions, soul parents nor did it acknowledge the prevalence of extended family. The definition of family has changed over time, as have the socially defined roles of mothers and fathers. Within these varied family units, situations occur in which divorces and separations take place and a lot of the times these tricky situations may involve children, which can make an already tricky situation even more problematic. There are pieces of legislation which are in place which aim to protect the best interests of a child during the time their parents are going through divorce but sometimes these avenues can be more problematic and ultimately destroy unions whereas other avenues of dispute resolution such as mediation, albeit with its own criticisms, helps to keep relationships afoot in that it provides an opportunity for peaceful and mutual agreements to be made in a more laid back environment.

Structural Family Therapy offers a framework that provides order and meaning within the family connections (Nichols, 2013). Divorce in a family is considered a significant transition for all parties involved. When counseling a family going through divorce the structural family therapist’s job is to build an alliance with the family and obtain information about the structure. The structure of the family consists of the roles, interactions, organization, and hierarchy. Family therapy yields the belief that changing the organization of the family leads to change in the individual members. The structural family therapist often will try to become part of the family to gain a perspective of their issues as whole so not to place the focus on one individual. Joining is an empathetic approach in helping families explain and break down their individual stories without uncomfortable challenge or unnecessary confrontation (Nichols, 2013). It is important to note that family dysfunction that often leads to divorce is not attributed to one individual, but the entire family system. In structural family therapy, part of dealing with the issue of divorce in the family is to focus on the interactions between all the family members both positive and negative. Through these interactions the therapist can discover where the conflicts arise, which will in turn help the therapist understand how these negative interactions affect the family. Family therapy in these cases allows for repair of long-standing interactional patterns in which divorce is just one of a series of ongoing transactions that are disruptive to the child’s development (Kaplan, 1977, p.75). The structural family therapist often has the family play out these family interactions via enactments so that he can get a firsthand look at maladaptive patterns, roles, and
Firstly, as barristers are professionally bound to accept a brief, the cab rank rule promotes access to justice by ensuring legal representation is available to all, including the undesirable client or the unpopular cause. This ensures equality before the law and allows clients to be represented by a barrister of their choice. As the choice belongs to the client, not the lawyer, this improves the quality of legal representation available. It promotes the ideal of service for t...
Divorce is and has become a major issue in our society, the reason for that has been attributed to the drastic increase in divorce rates over the years. Divorce often disrupts the flow of the family structure, increases discord, and affects how family issues are handled. Families dealing with divorce are often times in a state of complete confusion and disorder, and filled with frustration, anger, and pain. Power struggles between spouses, which often times spread to the children if there any increase as the addiction worsens. There is a growing concernment among those in different fields like Social Work, Academia, and Mental Health in the United States, other countries, who have taken an interest in how divorce is readjusting

The concept of collaborative divorce is slowly making its way into American Court rooms. It provides an affordable alternative to litigation, and demands full cooperation of all parties. It reduces the risk of conflict, and in the event of disagreement there are trained professionals ready to intervene. A neutral law firm would function as the core for a movement for collaboration – a movemen...
Family Law (Law Express) 2th edition, by Jonathon Herring, published by Pearson Education Limited 2009
Marriage Counseling or “Couple Therapy” is a term that is used to describe a type of counseling a couple attends in order to help them overcome issues in their relationships to avoid separation or divorce. Today, people view divorce as something that occurs commonly between married couples who have difficulty maintaining a relationship with their spouse. For the past thirty years, the phrase: “fifty percent of marriages end in divorce”, seems to have been ingrained into people’s mentality because it has become extremely common to come across individuals who have either been through one or more divorces. Divorce or separation not only affects the couples, but also their children. Having a strong family plays a major part in the lives of children and is crucial for their mental well-being. A report done by a team of senior academics for DailyMail UK found that “the damage caused to a child by divorce continues to blight his or her life as far as old age” and that “parental separation in childhood was consistently associated with psychological distress in adulthood during people’s early thirties”. Not only does the report show that children are affected by the effects of divorced but, the report also suggests that as divorce and separation continues to grow more common in society, the effects it has on the mental health of children does not reduce.
