The use of the Children Act 2004 in day-to-day work with children and young people allows multi-disciplinary teams to shared information, which is used to safeguard and promote the welfare of children and young people known to one or more agencies. The interests of the child are paramount. In the setting, a specifically trained member of staff will be appointed to supervise safeguarding and child protection.
The grounds for making a supervision or care order can be found in in s.31 of The Children Act 1989. Before a supervision or care order can be made, there are four areas that must be established. The court must show that ‘the child concerned is suffering or likely to suffer, significant harm’. Under s.31(2)(b) it states that, ‘The harm, or likelihood of harm, is attributable to: (i) the care given to the child, or likely to be given to him if the order were not made, not being what it would be reasonable to expect a parent to give him; or (ii) the child’s being beyond parental control’. The last two criteria are that the making of the order would promote the welfare of the child, and it is better for the child than making no order at all. The meeting was to address CYS concerns regarding Jamiles leaving home without permission during the middle of February to see her mother. Donna wanted to verify the acquisition because she was unsure of what to believe from Lesley (Jamiles mother). The meeting was also to establish an appropriate after care-plan for Jamiles once MSTT close services. Jamiles did state she went to her mother's home at that time because she was feeling alone. My supervisor helped me along the process of ending my first case. Vickie Babcock and I had multiple supervisions, with her teaching me how to complete a risk assessment. The risk assessment tool is used most frequently in the agency. This risk assessment is used to determine if the child may be at risk of maltreatment in the future. If the caregiver’s attributes are more on the scale of moderate or high risk, then the agency determines the caregiver as unsafe.
