I interviewed my client Tammi Musumeci about a car accident she was involved in. Ms. Musumeci was driving in the rain and was hit by another car which in turn forced her car to veer off the road and crash into a wall. The driver who hit her was attempting to switch lanes without a signal and hit Ms. Musumeci from the back. After Ms. Musumeci was hit, the driver of the car who caused the accident drove off. The injuries she sustained from the incident included a concussion, torn rotator cuffs, and one broken rib. I definitely believe this is an actionable tort based on the negligent behavior of the driver who caused the accident. Due to the lack of turn signal use and failure to drive carefully during inclement weather, this seems like clear negligence. The driver also drove away after clearly causing an obvious and harmful accident. I was anticipating to be told a story and then from there have all the facts I needed. I had to ask for many details the client did not initially give such as whether or not the driver who caused the accident fled the scene or not and what the extent of her injuries were. I also realized how important it is to be aware of the emotional aspects of the interview. As I was asking about the injuries, I ended up saying something like “oh wow that’s good” due to how the extend of the injuries made the case more favorable to her. My comment at the time would have seemed very insensitive and inappropriate to an actual client, and might have even caused me to lose said client. What I found most interesting as the client being interviewed was how much detail about the incident I was able to remember.
