I interviewed my client Tammi Musumeci about a car accident she was involved in. Ms. Musumeci was driving in the rain and was hit by another car which in turn forced her car to veer off the road and crash into a wall. The driver who hit her was attempting to switch lanes without a signal and hit Ms. Musumeci from the back. After Ms. Musumeci was hit, the driver of the car who caused the accident drove off. The injuries she sustained from the incident included a concussion, torn rotator cuffs, and one broken rib. I definitely believe this is an actionable tort based on the negligent behavior of the driver who caused the accident. Due to the lack of turn signal use and failure to drive carefully during inclement weather, this seems like clear negligence. The driver also drove away after clearly causing an obvious and harmful accident. I was anticipating to be told a story and then from there have all the facts I needed. I had to ask for many details the client did not initially give such as whether or not the driver who caused the accident fled the scene or not and what the extent of her injuries were. I also realized how important it is to be aware of the emotional aspects of the interview. As I was asking about the injuries, I ended up saying something like “oh wow that’s good” due to how the extend of the injuries made the case more favorable to her. My comment at the time would have seemed very insensitive and inappropriate to an actual client, and might have even caused me to lose said client. What I found most interesting as the client being interviewed was how much detail about the incident I was able to remember. On the morning of the 17th of May 2005, Nola Walker was involved in a two vehicle motor accident. She had just dropped her son off at his new job, when she ignored a give way sign at an intersection. When the ambulance arrived the officers, Nucifora and Blake, recall Walker being “able to converse” and “orientated”. Blake conducted multiple assessments and did her vital signs twice. The theories in which I base my decision on are res ipsa loquitor and negligence per se. Res ipsa loquitor means that “it creates a presumption that the defendant was negligent because he or she was in exclusive control of the situation and that the plaintiff would not have suffered an Injury”. Negligence per se means “an act of the defendant that violates a statute regulation or ordinance can be used to establish a breach of the duty of due care” (Mayer et al,. 2014, p. 163). About 4 years ago Johnathan was in a tragic car accident due to drinking and driving. He fell asleep at the wheel and drove his car underneath a parked 18 wheeler on the side of the highway. Johnathan not only put himself in danger, but also a friend of his that was passed out in the backseat. This caused Johnathan to have to have massive facial reconstructive surgery. Johnathan’s friend suffered minor injuries since he was lying down.
At Ten P.m on September 23, 2006, my mother Kelli Elizabeth Dicks was hit by a car on Route 146 southbound trying to cross the high speed lane. She was being picked up by a friend. Instead of taking the exit and coming to the other side of the highway, her ride suggested she run across the street. I walked in my third and final mock session with a level of comfortability that I knew what I was dealing with and prepared for the client. Feed back form my classmate during my last case presentation was perfect a gave me an air of confidence for my last session. However, it was a grounding experience when the client brought up a current crisis she was dealing with at the moment. The client mentioned that she was was pregnant and was not able to make a decision of weather to keep the baby or have an abortion. The client came in with a very real level of anxiety that created a tension throughout the session that really tested my ability to stay present and support the client during this sensitive time.
Disappointment, disbelief and fear filled my mind as I lye on my side, sandwiched between the cold, soft dirt and the hot, slick metal of the car. The weight of the car pressed down on the lower half of my body with monster force. It did not hurt, my body was numb. All I could feel was the car hood's mass stamping my body father and farther into the ground. My lungs felt pinched shut and air would neither enter nor escape them. My mind was buzzing. What had just happened? In the distance, on that cursed road, I saw cars driving by completely unaware of what happened, how I felt. I tried to yell but my voice was unheard. All I could do was wait. Wait for someone to help me or wait to die.

While arriving on time, I was left outside in the cold for 10 minutes as a result of the night before. The incautious members of DSP had a party to commend their week of soberness. Last year I got involved in a massive car accident. It was the most terrified part of life. It was the moment. I will never forget in my whole life. Before, I never realized how people really feel when a car accident happens.But,after this car accident I know what really it felt like. It was the moment. My mind was totally feared of driving. Accidents is defined as an unplanned and undesired circumstances resulting in injuries, fatalities and loss or damage of property or assets(safety.ILO, 2011). Accidents are much deeper and beyond the older clichés, accounting to bad luck or fate, almighty’s work or simply being at wrong place at wrong time. But, in todays scientific world it is neither perceived as fate nor as deity’s work but a social problem resulting from a chain of undesired events. Preventing accidents is very arduous task without knowledge of accident phenomenon and the study in the field of accident phenomenon has been very diverse but a basic question has always been raised as why does accident occur? Can there be some common pattern to it? To unravel these mysteries and predict and prevent accidents several theories and model has been postulated in the past and recent times with each having some explanatory and predictive values.
Accidents happen all the time whether we know it or not. Some could possibly be avoided and others may not. I was a young girl, who didn’t truly grasp the concept of life and death. Every time I was upset about something, I would think about ending my own life. However, through one horrifying incident, that silly thought of mine completely vanished. Thanks to that specific mishap, the way I perceived life and death has in turn, changed entirely anew.
