With the Reconstruction policies, whites reestablished civil authority in the southern states (formally known as the Confederate states). The whites created a series of black codes. With these restrictive laws, they were made to restrict the freed black's work activity and use them for general labor since slavery was no longer prohibited. In this essay I will be writing about the effectiveness of the 13th, 14th and 15th amendments to the Constitution of the United States of America and considering whether they achieved the purpose of making life better for African Americans. I’m going to start this essay by talking about the Amendments and what they were designed to achieve.
Abraham Lincoln became the United States ' 16th President in 1861, delivering the Emancipation Proclamation that declared forever free those slaves within the Confederacy in 1863. If there is a part of the United States History that best characterizes it, is the interminable fight for the Civil Rights. This he stated most movingly in dedicating the military cemetery at Gettysburg: "that we here highly resolve that these dead shall not have died in vain--that this nation, under God, shall have a new birth of freedom--and that government of the people, by the people, for the people, shall not perish from the earth. On December 6, 1865, the thirteenth amendment to the United States constitution was ratified (Archives). This amendment effectively abolished slavery with the exception of a punishment for a crime (Archives). This was a great victory for blacks, who had been the preferred target for slaves. For many, however, the passage of the amendment failed to change the attitudes of white Americans. Blacks were clearly not welcome in many cities across the nation, with laws allowing blacks to work within a city’s limits, but requiring them to leave before sundown.
After the Civil War, in 1865, the southern plantation owners were left with minimal labor. They were bitter over the outcome of the war and wanted to keep African Americans under their control. Black Codes were unique to the southern states, and each state had their own variation of them. In general, the codes compelled the freedmen to work. Any unemployed black could be arrested and charged with vagrancy. The ones that did work had hours, duties, and types of jobs dictated to them. Codes were also developed to restrict blacks from becoming successful. They discouraged owning and selling property, and raising and selling their own crops. Blacks were often prohibited from entering town without written permission from a white employer. A black found after 10 p.m. without a note could be arrested. The 15th Amendment was written by George Washington Julian. This amendment was passed on February 26, 1869 and was ratified February 3, 1870. The 15th Amendment was very significant to many Americans of different races because it changed their lives forever by allowing them to vote. “The present difficulty, in bringing all parts of the United States to a happy unity and love of country grows out of the prejudice to color. The prejudice is a senseless one, but it exists,” said U.S. Grant, 1869.
During the time of reconstruction, the 13th amendment abolished slavery. As the Nation was attempting to pick up their broken pieces and mend the brokenness of the states, former slaves were getting the opportunity to start their new, free lives. This however, created tension between the Northerners and the Southerners once again. The Southerners hated the fact that their slaves were being freed and did not belong to them anymore. The plantations were suffering without the slaves laboring and the owners were running out of solutions. The “cruel and unusual” clause in the eighth amendment states that “cruel and unusual punishment” such as torture or lingering death can not be inflicted on anyone as a form of execution. It is however permissible under the 8th Amendment to execute a convict by means of hanging, shooting, electrocution, and lethal gas.
The extents of the Fourteenth Amendment to the Constitution has been long discussed since its adoption in mid-late 1800s. Deciding cases like Brown v. Board of Education and Roe v. Wade has been possible due to mentioned amendment. These past cases not only show the progression of American society, but also highlights the degree of versatility that is contained within the amendment. Amendment 13, passed January 31, 1865, ratified December 6 1865, brought freedom and citizenship to all slaves. Although the slaves were free, they weren’t equal to the whites, and didn’t have the rights that all of the other white American citizens did. Black Americans moved past slavery, but faced other challenges that held their population back. During the reconstruction era Black Americans faced difficulties socially, politically, and economically that White Americans didn’t.
In the latter half of the 18th century, freed slaves possessed the right to vote in all but three states. It was not until the 19th century that states began to pass laws to disenfranchise the black population. In 1850, only 6 out of the 31 states allowed blacks to vote. 1Following the civil war, three reconstruction amendments were passed. The first and second sought to end slavery and guarantee equal rights. The third, the 15th amendment, granted suffrage regardless of color, race, or previous position of servitude.2 The 15th Amendment monumentally changed the structure of American politics as it was no longer the privileged whites who could vote. For some it was as though hell had arrived on earth, but for others, it was freedom singing. However, the song was short lived. While many political cartoons from the period show the freedom that ex-slaves have for voting because of the 15th Amendment, they often neglect to include the fact that many African Americans were coerced into voting a certain way or simply had their rights stripped from them.
After the 13th amendment was passed, there was a severe shortage of workers on plantations and they needed help. The black codes were partially created because of economic worries of not having labor in the south. They helped reconstruction because it ensured that wealthy southern landowners would have a cheap and steady workforce they needed, because some of the codes forced African Americans to sign contracts that required them to work for meager wages. The government was also scared that the freed slaves would try to get revenge on their owners. The black codes helped regain control and inhibit the freedoms over the freed slaves, prevent black uprisings, ensure the continued and steady supply of cheap labor, and maintain segregation and white supremacy. Also, without the black codes, many amendments granting African Americans equal rights wouldn’t have been passed. Many white Southerners were not in favor of the 13th Amendment so many Southern states enforced Black Codes, which basically returned blacks to slavery without calling it slavery.
