Affirmative Action As long as humanity has been thriving on the earth, inequalities have separated men. From the "haves" and "have nots" of the hunter and gatherer societies, to the Caste System of India, to the American Democracy. Is this fundamental inequality natural, or is it a problem that man should set out to remedy? Would society actually be able to exist with no inequality? These are the types of questions that were taken into consideration when perhaps the most anti-democrat bill ever to be entertained by the American Congress cam up for debate; enter Affirmative Action. The roots for Affirmative Action stem all the way back into the era before the Civil War. With slavery an option as cheap labor, many people bought into the idea of it, both those in the North (mainly factories) and those in the South (mainly plantations). But there was one ripple in this ideal, those words in the Declaration of Independence "..That all men are created equal.." With these simple words, the changing of a nation was to follow. In 1857 a key event in the history of Affirmative Action took place, the Dred Scott decision. In this decision the Supreme Court ruled that slaves were "subordinate and inferior being," this is where the initial differences began. After this decision, Abraham Lincoln pushes for reconciliation with the Emancipation Proclamations, which on January 1, 1863, freed the slaves living in the South. After this monuments step, Congress pushed forward with the Thirteenth Amendment. Ratified on December 6, 1865, this permanently abolished slavery, but this did not end the dispute. Affirmative action started in the 1960’s as a way to end discrimination against African American and later all minorities - including women. By migrating people of all color into workplaces and colleges/universities seemed to be the suitable solution to diversify our nation. Although blacks had been freed for a 100 years, they continually struggled with segregation. The Civil Rights Act of 1964 banned the segregation of all sort in the United States, however that was not enough. Congress mandated the affirmative action program as a plan of desegregation. In 1961, President John F. Kennedy made reference to this plan, but it was not until September 1965 that it was enforced by President Lyndon Johnson. The program affected federal jobs, to include federal contracting company, and universities. In order to receive federal funding, each entity had to hire and enroll minorities. Affirmative action was a good jump start to get our nation to where it is today. However, affirmative action should not be continued because it is a form of discrimination, it is more harmful than helpful, and it supplements race or gender for one’s qualification.
Affirmative action was put into affect with the Civil Rights Act of 1964 (Eastland 22). The purposes of affirmative action are noble at best-in theory they would serve to end the discriminatory practices so rampant in the American society. The goals were to repair or negate the effects of past discrimination, move towards diversity in both the private and public sector, to encourage representation in the work force, and to increase the economic levels of both women and minorities (Doverspike 3).
Affirmative action was created to allow minorities to have more opportunities in the workforce and in education. It still remains to be a debate whether affirmative action should be a necessary route even though we have made progress towards greater equality. The argument over Affirmative action has been going on for some time with two opposing sides. There is one side who finds Affirmative action as an opportunity to the less fortunate; those who are against have the belief that it promotes less qualified individuals rather than a person own merit.
The roots of affirmative action may be traced back to the early 1960’s, during the Civil Rights Movement. It was in 1961 that President John F. Kennedy issued an Executive Order that first introduced affirmative action. This order included an establishment that government contractors “take affirmative action to ensure that applicants are employed, and employees are treated fairly during employment, without regard to their race, creed, color, or national origin.” (University of California Irvine) Over the years, there have been many adjustments to affirmative action, but they all reiterated the same general idea. The history of affirmative action has its roots in the Civil Rights Act of 1964, and stems from the United States Supreme case of Brown vs. Board of Education of Topeka Kansas. In 1969, the department of Labor exposed widespread racial discrimination of the Construction Department so President Nixon decided to incorporate a system of "goals and timetables" that provided guidelines for companies to follow and comply with affirmative action regulations. In order to discuss how affirmative action was put into legislation, we must review the history of black americans and slavery. America’s Declaration of Independence stated that “all men were created equal,” but under the Constitution blacks were not created equal because first of all, they were not American citizens; they were considered to be property. This is seen in the Dred Scott v. Sanford case (1857) when Dred Scott, a slave is taken by his master to settle into other free states and back into the state of Missouri (not a free state). When his master died, he claimed to be free because he had lived in states where slavery was illegal. This case went to the Supreme Court, where it was ruled that Scott could not sue because he was not a citizen (Berman 508).
Affirmative Action is a policy in the United States of America. It is in use to help minorities get equal treatment in admissions policies for big businesses and higher educational programs. In one way or another, this policy affects almost every person in America. It affects people directly, and most commonly, indirectly. When this policy affects people, it usually affects them in a negative way. When Affirmative Action first started, it was a descent policy, but with changes in society, it has become a policy that does more harm than good. Since this is what the policy currently does, Affirmative Action should be out of use for every application it has a function for. So, this policy should be out of every law book in America to eliminate the negative impact that it is causing. Affirmative Action is outdated because it is turning into a reverse discrimination policy.
Affirmative Action Affirmative action can be defined as action taken to compensate for past unfairness in the education of minorities. The current system of affirmative action allows universities to admit applicants from certain ethnic and minority groups with lower credentials. The main purpose of affirmative action is to produce a diverse campus population that is comparable to today's society. The use of race as a facto by which someone is admitted to college in the long run will compromise the quality of the university. Implicating affirmative action to solve the problem of diversity on today's campuses has lead to the creation of problems.

We hold these truths to be self-evident: that all men are created equal." - Dr. Martin Luther King Jr. (6). Dr. King stated this in his famous “I have a Dream" speech in Washington, D.C. in 1963. Is affirmative action still needed in America? Affirmative action is still needed because America does not have enough equality and diversity. Almost all of our American history dealt with inequality between the white men and the black men. As time went on, nothing has changed and is still seen in today’s society. There are two definitions of affirmative action: 1) race-neutral, gender-neutral assurance against actual discrimination and 2) racial-preferences and gender-preferences for the correct races and genders (3). Most Americans associate affirmative action with the second definition, causing much controversy. However, the true and intended meaning of affirmative action is the first one. Affirmative action is essential in America because Americans do not have sufficient diversity and equality in our society.
Affirmative Action has been an issue of contention since its inception during the Civil Rights struggles of mid 20th century America. Discrimination could no longer be tolerated and the Unites States government had an obligation to encourage equality at all levels of the social infrastructure. The main type of discrimination being addressed by Affirmative Action programs was racial discrimination. The Merriam Webster dictionary defines racism as: ‘a belief that race is the primary determinant of human traits and capacities and that racial differences produce an inherent superiority of a particular race.’ The Civil Rights Act of 1964, which prohibited discrimination of any kind, laid the foundation for the introduction of Affirmative Action programs. In 1965, Lyndon Johnson signed an executive order requiring government contractors to diversify its staff by hiring more members of the minorities. President Nixon implemented a system in which the government could monitor the progress being made by businesses in hiring minorities. Eventually, high level educational institutions would also see the need for Affirmative Action and the benefits of a diverse student body. Affirmative Action was designed to overcome the issue of discrimination in education and the workplace by giving less fortunate members of the minority an opportunity to level the playing field and achieve success similar to that of their counterparts in the majority. Affirmative Action programs, which encourage the inclusion of minorities in education and at all levels in the workplace, are vital in the effort to eradicate discrimination and provide equal opportunity.

Affirmative action was created to beas a temporary policy to aide African Americans and other minorities, such asincluding women, with opportunities equal to those received by the majority of whites males. Affirmative action policies (AAP) create diversity and provide special preferences to minorities. The courts created laws that were “race-conscious” to promote minority opportunities in education, employment, and government contracts. The Civil Rights Act of 1964 provided the framework for affirmative action policy (The Leadership Conference, 2014).
The issue of affirmative action has been a controversial one since its inception. The law was developed during the 1960’s as a result of the civil rights movement and the need to address injustices committed against minorities throughout the United States history. There were multiple attempts to correct the inequities between the majority and the various minorities including the 13, 14 and 15th Amendments. The Civil Rights Act of 1964 allowed for the creation of the Equal Employment Opportunity Commission (EEOC) to create rules to end discrimination. Affirmative action came into being with the executive order 11246 issued by President Johnson. The Civil Rights Act and President Johnson’s executive order have been updated throughout the years to address gender, disabilities, age and other characteristics that could be considered discriminatory.
According to the Encyclopædia Britannica, affirmative action is “an active effort to improve employment or educational opportunities for members of minority groups and women.” However, despite its well-intentioned policies, it has been the source of much controversy over the years. Barbara Scott and Mary Ann Schwartz mention that “proponents of affirmative action argue that given that racism and discrimination are systemic problems, their solutions require institutional remedies such as those offered by affirmative action legislation” (298). The need for affirmative action was a concept noticed in 1865 during the passages of the Civil War amendments. During those years our country was still practicing in slavery and wrongful treatment of the black race. While blacks were being forced to comply to the rules of slavery, many individuals were denied their rights to food, clothing, shelter, employment, education and many other wants and/or needs. Similar acts such as these over time lead the law of affirmative action. Over the years, affirmative action plans and policies continue to merge to further in the efforts of benefiting the equality among historically disadvantaged ethnic groups as well as women. From our past to our present many people who are equally qualified and in need of jobs, services, assistance and/or necessities are denied due to their gender, race, religion, and/or ethnicity. Acts of discrimination are not just associated with employment but extend to educational opportunities, housing needs, contracting for small and large business and other public services.
