Are gay marriages in Asia viewed with the same perspective as in the American context?
The history of gay marriage is short but not liked as much. From the history of gay marriages there are an estimated number of 250 million people who live in places which accept gay marriage; this is about 4% of world’s population. In the 2nd century in Rome, men of the same age were legally allowed to marry where they were considered to be pagans and the marriages were conducted by the Mother Goddess (Celeste 2010). On April 16, 106, the first Gay marriage was documented in which two men, Pedro and Vandilaz were married in a chapel witnessed by a priest. In the United States, majority of Christians are very active in opposing same sex marriages both vocally and politically. Why is it so? This is against the convectional purpose of marriage and also marriage is defined as union between two people of opposite sex, (Norton, 2004)
In Asia, gay marriage is in full support from all corners ranging from religious leaders, politicians, to gay rights activists. They argue that gays are families too and they require recognition and support. According to Jennifer Lin, an Asian marriage activist, there was an importance for the Asian people to increase visibility and also encourage gay marriages. There is a rise in the visibility of gay people in Asia which is seen as a form of social change and it is growing very fast as a result of high rate of development within Asia. The United States of America, as a whole, has pushed for rights and equality for any and all people. Gay rights and racial equality have received an ample amount of support as well as opposition. Even bringing up the other side’s argument may cause a debate in almost any environment. Today, Americans are easily offended by things that don’t agree with what they believe. America is full of passionate people who always have a cause to fight for or against. Gay marriage has been opposed countless times on local, state, and national levels. “Almost two- thirds of Republicans oppose the Supreme Court’s backing of gay marriage, according to Reuters/Ipsos Poll ” (Reuters). Even though another online survey stated that “more than half of Americans support it,” they still
President George Bush strongly opposed gay marriage along with most of America 's past and present legislators and politicians. For instance, Minnesota state senator Paul Koering openly came out the closet and admitted being gay when in the past he had voted against the attempted marriage amendments for gays to be legal to unify. Today, more than 35 states have legalized gay marriage. Homosexuals are adopting children because they cannot have one. They take children who were once starving and living in the streets, or abandoned, and take good care of them. I 'd rather see a child with a loving gay couple than to see it sleeping in the street with nowhere to go. Government officials in both state and national offices oppose these laws because if they allow same-sex marriage to occur, they will lose large amounts of votes and supporters will be appalled. The future looks grim for gay marriage with the conservative republicans holding office. Furthermore, legalizing same sex marriage can cause a chain reaction of hostility and violence. Many anti-gay organizations, some resembling the infamous Ku Klux Klan of the 1920’s, will form and be on the doorstep of same-sex couples. ... what can be considered one of the most forward thinking countries in the world. The longer we hold out on allowing homosexual couples to marry, the further we will fall behind in the world. We cannot continuously look down upon other countries degradation of particular minorities while we continue to do the same thing in our own country. Gay marriage it simply gives another minority the opportunity to express their love. Being married involves legal matters, and religion is simply something that we have added to it. The ideals of marriage have been ever-evolving and we as Americans, the pillar of modernization, the ever futuristic mainstay, should be open-minded enough to evolve even more to benefit the homosexual community. If not open-minded enough, look at the laws: America established itself upon the ideals of equality for all. We should follow our own rules.
The United States is a country built on a number of ideals and institutions. The moral structure of many Americans today was developed by our ancestors and the founders of this nation through the institutions that were a part of their lives. Family, religion, marriage, equality, and justice are just a few examples of the important components that provide a moral basis for our country. If any of these elements were to become too mutated, the effects on society could be devastating. Right now in the United States, one of these building blocks of society is being threatened by the possibility of a negative transformation. The building block of marriage as the sacred joining of one man and one woman is under attack and is at risk of being destroyed. People in favor of gay marriage want to change marriage to the joining of two people of either sex, which goes against what the purpose of marriage has been and why it is important to society and religion. People who are in opposition to same-sex marriage are eagerly expressing their opinions with religious and cultural reasons that show how this change could impact our society forever.
In Africa, same sex marriage is illegal, but is legal in parts of America and other countries. Lauren mentions how in some countries, people who are in a same-sex marriage are even punished and sent to death because of it. She also mentions how in parts of Asia, Europe, and Native America... Same sex marriages were seen as disgusting ceremonies to people against it. Christians believe that marriage is sacred and should be just between a man and a woman. For example, within the Bible it states that from the beginning of the creation, God made them male and female. For this cause a man shall leave his father and mother; and shall cleave to his wife.” (Mark 10:6-7). This shows how Christians believe that man and women should be the only people who are allowed to be married. According to the Bible, people who didn’t follow the word of God received his judgment. In the book of Genesis it states, “The Lord rained down sulphurous fire upon Sodom and Gomorrah. He overthrew those cities and the whole Plain, together with the inhabitants of the cities and the produce of the soil.” (Gen. 19:24-25) This would honestly explain why many Christians are against gay marriage. Religious societies have engraved it into the heads of Christians and other religious groups that if you don’t follow the will of God you will be punished and they see people who support gay marriage as sinners. Gay marriage is one of todays most talked about subjects in the news. But for many, including myself, do not see why this barbaric belief and view is still in existence in the twenty-first century. Anybody would think that a perfect law abiding, tax paying citizen of the United States, should have every equal opportunity as any other American. In our society today, homosexuals have been broadly acknowledged by the majority of the people. According to Jonas Bagas, the social attitudes and behavior of the Filipinos about homosexuals and same sex marriage are changing wherein the Social media has major access to a wider range of narratives and stories about LGBTs and made them part of our experiences, creating an environment that could help dismantle the oppressive stereotypes about homosexuality. It shows that the social media has changed the perception of the Filipinos on how to deal with issues that have been filtered and controlled in the past by traditional institutions, like the Church and the schools, thus it makes them more openness to engage in an issue that is considered as a taboo. In addition, various LGBT groups have been made that are actively promoting and advocating for homosexual rights and to maintain that society will not discriminate on the basis of sexual preference. In fact, this issue received a lot of protest and disapproval because it opposes the adapted meaning of marriage based on the Catholic teaching that states that marriage is a union between a man and a woman. Though there were already more than a dozen countries which have accepted legally formalizing marriage between same sex marriages like Argentina, Belgium, Brazil, Canada, France etc. But majority of countries still do not recognize this same sex marriage including the Philippines. However, Polls in different countries show that there is an increasing support for legally recognizing same-sex marriage.
In North America, LGBT rights are often discussed through institutions, social media, and organizations supporting such cases. However, one can notice that leaving this North American mindset results are dramatically different in attitudes towards LBGT issues. This literature review will be centering on LGBT rights in India, and will focus upon the Supreme Court decision that upheld Section 377 of the Indian Constitution and repealed the Delhi High Court’s ruling. This research paper will additionally investigate the exact timeline of each decision by highlighting the history of Section 377 of the Penal Code of India, the ruling of the Delhi High Court in 2009 and finally what the Supreme Court’s ruling was in December of 2013. Moreover, it will focus and discuss the discourse behind why the Supreme Court reinstated criminalizing gay sex in the country. Lastly, this research paper will offer a critical perspective by addressing a possible solution in order to gain awareness and take a stand against the Supreme Court for reinstating criminalization of gay sex in the country.
Legalizing gay marriage has caused many problems in the society today. The U.S. Constitution is making some people go against their religious beliefs because of this law. I personally do not think people should have to go against their religion to support something that God would not be pleased with. We have enough things going on in this horrible world and irrelevant things like this should not be added to society’s problems.
The relationship between law and society is a deeply discussed and closely examined subject. The law governs both modern and traditional societies. Oliver Wendell Holmes said that, “The law embodies the story of a nation’s development through many centuries”. The legal culture of each nation is distinct for this reason. The past of a nation plays a highly detrimental role in the legal structure of the society. Therefore, the law governing the English and that governing Indians will be miles apart for the simple reason that the issues that need to be addressed at that level are different and since the law governs the basic existence of the nation, it is essential that it is molded according to the citizens and the culture of the society.
