Executive Overview As an add-on component to its IT Operations-as-a-Service program for Whataburger Restaurants, Sigma offers the SmartHands Dispatch service for the onsite support at Whataburger stores. Dispatch services may be delivered by Sigma employees or an approved 3rd party managed by Sigma. The scheduling and deployment of a technician will occur after the Sigma ITOaaS Operations team has provided remote support and troubleshooting as part of the MANAGED Service Level support agreement. The following outlines the services and deliverables of the program on a per incident basis: • Identify the defective unit through triage by Sigma's service desk • Send a swap request to the Sigma warehouse • Dispatch the kit from the Sigma warehouse to the customer location where problem was reported o Replacement device will be configured with the appropriate settings of the failed unit (ex. IP Address, backup image) o Replacement kit will be shipped overnight and delivered by 10:30am CST the next day (dependent on customer's shipping services) • Replacement kits will be shipped same day as long as the swap request is sent to the Sigma/Pivot warehouse by 1:00pm EST • Swap requests received after 1:00pm EST may be processed the following business day • SmartHands technician will be dispatched to the store the following day (dependent on shipping service area and customer specified off-peak hours) o This will be provided as described in section 2 o Customer (ex. McDonalds are most heavily located in North America, East Asia and Europe due to the fact that these continents have better economies; therefore they can afford the popular food chain restaurant. On the other hand, Africa and Central Asia do not have nearly as many McDonalds because their economies are weaker than North America, East Asia and Europe. Russia, being the largest country in the world in terms of landmass, only has 94 McDonalds’ while Brazil, which is not nearly the size of Russia, has 584 McDonalds’.
In looking at the utilization of the three machines it became apparent that Machine #1 was a bottleneck as it operated at or close to 100% utilization (Exhibit 1) with a maximum capacity of 5 kits per day. Furthermore, in analyzing the data we noted that there was spare capacity on Machines 2 & 3 so we prioritized any work from Machine #1 as the two other machines were not the constraint initially. We concluded from this that we would initially purchase an additional Machine #1 while maintaining the same number of the other two machines. The Panera Bread Company began in 1981 as Au Bon Pain Co., Inc. Founded by Ron Shaich and Louis Kane, the company thrived along the east coast of the United States and internationally throughout the 1980’s and 1990’s and became the dominant operator within the bakery-café category. In the early 1990’s, Saint Louis Bread company, a chain of 20 bakery-cafes were acquired by the Au Bon Pain Co. Following this purchase, the company redesigned the newly acquired company and increased unit volumes by 75%. This new concept was named Panera Bread. Top management chose to sell their previous bakery-café known as Au Bon Pain Co. due to the financial and managerial needs of Panera. The case of Burger King Corporation v. Rudzewicz, 471 U.S. 462, 105 S. Ct. 2174, 85 L. Ed. 2d 528 (1985) addressed the issue of personal jurisdiction and whether or not it violates the Due Process Clause of the Fourteenth Amendment. The plaintiff, Burger King, is a Florida corporation whose principal offices are located in Miami. The defendant, John Rudzewicz, was a resident of Michigan and a principal of a Michigan franchise. Rudzewicz, as a franchisee owner, had been given a license to use Burger King’s name and logo (trademarks) to operate a Burger King in Michigan. The contract between the franchisor and franchisee stated that the franchisor relationship (contract) is under the control of Florida. Other provisions of the contract include required monthly payments of fees and royalties to Miami headquarters, and all major decisions and problems had to be communicated with headquarters. In addition, the franchisee had to conduct business at a leased restaurant facility for 20 years. However, the defendant failed to fulfill franchisee obligations by not keeping up with his monthly payments of fees and royalties that he owed to Burger King in Florida. As a result, Burger King sued for a diversity suit against Rudzewicz in an effort to get back the money that they were owed. Burger King claimed a breach of contract, specifically the “Franchise Agreement”, between Burger King (the franchisor) and Rudzewicz (the franchisee). The case eventually made it all the way to the United States Supreme Court (Case Briefs).

Burger king has been in existence for 60 years and is growing rapidly in many other countries. Burger King delivers quality, great tasting food which satisfies ones need or wants and captures the value of customers even before the first purchase is made. Burger King has products very unique from other competitors such as KFC and McDonalds. The difference is that Burger King does not limit their customers in terms of what they eat. For example, when I spoke to a customer also big fan of Burger King, he mentioned that the sauces are left public for the customer to decide on which sauce to have rather than giving the customer one kind of sauce such as McDonalds and KFC. The cold beverage is also self-help service in which customers can help themselves to a bottomless drink. This way the customer feels free to choose what satisfies the need or want.
