Walt Disney Studios is suing Professor Faden for infringing its copyright by using Disney clips in “A Fair(y) Use Tale.” Professor Faden claims he did not infringe Walt Disney Studios copyright. He took bits and pieces of Disney movies and made a video of all the clips that he used for fair use. Faden was using pieces of Walt Disney Studios movies for educational purposes, and never broke the copyright laws, therefore, it was noninfringing. The definition of fair use is a legal doctrine that portions of copyrighted materials may be used without permission of the copyright owner provided the use is fair and reasonable, does not substantially impair the value of the materials, and does not curtail the profits reasonably expected by the owner. The factors of fair use are purpose and character of the use, nature of the copyrighted work, amount and sustainability of the portion used in relation to the copyrighted work as a whole, the effect of the use upon the potential market for the copyrighted work. The first one is purpose and character of the use. He took clips of Disney movies and made a video on fair use. The second one is nature of the copyrighted work. It was to inform the viewers of copyright and fair use. The third one is the amount of sustainability of the portion used in relation of the copyrighted work as a whole. He used many different Disney movies to make a video. He didn’t make a video based on one Disney movie. The last one is the effect of the use upon the potential market for the copyrighted work. Faden didn’t make the video to make profit off of it, it was made to inform viewers about fair use and copyright. Faden took in mind all of these factors, and made sure he wouldn’t break copyright laws. What he didn’t do is take all the movies he used from Disney and made no changes to it, and claimed it was his. That would not be considered fair
They hired three different lawyers to handle their case, (which if you ask me, that's a clear sign that they know we have the upper hand in this case) two of them were clearly there for research purposes only, the other's name was Mister Smith, he stood up to give his opening statement. “While it is true that the video was made for educational purposes, to edit or show even small portions of films requires a public performance license, the only way to obtain this license is to have direct permission from the copyright owner. The only way this could be fair use is if he showed it to a small group of people such as a classroom and never put it online, this of course did not happen. Walt Disney Films are known to be as an incredible and outstanding fantasy stories producer. It created more than a hundred of films. Majority of what has been produced rely on fictional stories. The films that were released used animation to capture children’s interest and musically performed as well. Walt Disney produced fantasy stories like The Little Mermaid 1989; Sleeping Beauty 1959; Beauty and the Beast 1991; Cinderella 1950 and more. The tales most often than not were always about the life of a princess in search of her prince charming.

I selected this company due to the fact I am a fan of their products and services. Disney produced some of my favorite films like Aladdin, Hook and The Lion King. After I visited their website, I discovered that Disney owns multiple media outlets, in such areas as film, Internet, music, broadcasting, publishing and recreation. According to Disney’s “The mission of The Walt Disney Company is to be the one of the world’s leading producers and providers of entertainment and information. In fact, my daughter became engaged at the end of Main Street, in a fairy-tale moment in front of the enchanted Cinderella’s Castle, in the Magic Kingdom theme park for her birthday over the holidays. Just about everyone has some knowledge of Walt Disney’s incredible endeavors. However, how many people can say that they have knowledge of the man Disney was before creating Mickey Mouse and what follows?
Copyright infringement is a major issue with media ethics. Many people confuse copyright infringement with trademark infringement (Miller, 2012). However, copyright infringement is when someone unlawfully uses a particular work that is protected by copyright law. These works can include: movies, pictures, songs, albums, artwork, pieces of literature, and newspapers. There is no reason for any of the previous to be copyright infringed, because there are ways to correctly cite all of them as sources, without illegally copyright infringing them. Most people simply do not use their resources to help them with their citing.
