Virtual Child Pornography Should be Legal
This nation has several issues over which most people's minds freeze up, with the disastrous drug war probably leading the list. I don't share a feeling of squeamishness and horror when it comes to drugs: What I don't want, I don't take, it's that simple. And I don't spend time fretting that my neighbors might be toking, or snorting, in the privacy of their homes.
Child pornography is something else; it pushes all kinds of emotional hot-buttons in me. Certainly I would agree with the majority that anyone who exploits children in a sexual manner is committing a serious offense, deserving of harsh punishment.
And anyone who get his kicks looking at images of children in sexual situations, well, that's also pretty horrifying to my sensibilities. I am very glad that my own lust meter pegs when I look at fully grown women, not at some other subset of the population.
Nevertheless, I feel moved to speak against the wave of hysteria that is exemplified by U.S. Rep. Henry Brown's call for a Constitutional amendment to ban virtual child pornography.
(Virtual child pornography is images that appear to be of children having sex, but which are in fact made-up, simulated by the miracles of modern computer graphics).
Some who oppose such an amendment do so on the basis that the Constitution is not meant to cover specific legislative issues. That is true, but it misses the larger point, which comes down to basic rights, even for people we think have horrifying tastes.
To put it bluntly, children (and adults too, of course) have the right not to be sexually exploited, BUT, adults have the right to possess any material which does not directly exploit children. Yes, including virtual pornography.
I think a strong case could be made that it should not be illegal for someone to possess images of ACTUAL child pornography: The crime has been committed by the person exploiting the children, not the person viewing the picture. Nevertheless, in this column I'm taking the less assertive position that only pretend pictures of children don't warrant legal sanction.
Think about this: Take a napkin. Draw a big guy with an erect c***. Draw a much smaller figure giving him a b*** j**. You have just committed a felony. Take that napkin and stuff it in someone else's pocket.

Such was the case of Ohio high school student, Jesse Logan, who sent nude photos to her boyfriend who then sent them to other students who harassed her until she committed suicide.2 Currently, there are laws in place against minors sexting and sexting to minors and they fall under the child pornography category. While the laws are intended to protect minors from sexual predators, what most minors do not understand is that they are subject to them as well. This means that, if fifteen-year-old Timmy decides to sext his fifteen-year-old girlfriend, Sarah, a naked picture of himself, both Timmy and Sarah could be tried in court on charges of disseminating child pornography and possessing child pornography. These serious charges can result in having to register as a sex offender for several years, although the message may have been sent and received consensually by both parties. This was the case for an 18-year-old Iowa boy who sent a nude picture of himself to a fourteen-year-old girl after she asked him repeatedly to do so.

Both the criminal justice system and treating mentally ill individuals can be traced back to the beginning of human existence. Over the ages both systems have evolved and expanded with the changes within society. In some ways the criminal justice system has become more tolerant of those with mental illness, while in other aspect the criminal justice system has become less tolerant of those with mental disorders. Now more than ever the criminal justice system interacts with mentally ill individuals.
This world has become immersed in online media from socializing on networking sites to seeking information on search engines. People of all ages have become reliant on online media, but the most engaged users are the younger, more easily impacted generations. Although there are many positive uses for online media, there are many negative uses as well. Unfortunately, it is all too easy for these negative effects to impede upon the perceptions of adolescents. Some countries have been trying to reduce this effect by expelling the inappropriate content of online media ("Influence on Children Media...”). However, in the United States, children are thrown in the waves, expected to stay afloat in this massive sea, but many are being dragged under the surface by the nefarious temptations media creates. Content that is not appropriate for the young, growing minds of children are easily accessible; a myriad of devices may be used to access this material, all at the click of a button. Without adult content filters on online media, adolescents of various ages are exposed to dangerous conceptions. A world of pornography, violence, and public humiliation lay in the user’s fingertips.
In recent years, pornography has established itself as perhaps the most controversial topic arising out of the use of the Internet. The easy availability of this type of sexually explicit material has caused a panic among government officials, family groups, religious groups and law enforcement bodies and this panic has been perpetuated in the media.
To some, pornography is nothing more than a few pictures of scantily clad Women in seductive poses. But pornography has become much more than just Photographs of nude women. Computer technology is providing child molesters and child pornographers with powerful new tools for victimizing children. But there seems to be little doubt that films do have some effect on society and that all of us live with such effects.
