Act- Utilitarianism is the rightness of actions depends entirely on how they impact welfare or happiness, by attempting to maximize each. Utilitarianism sees no action is bad in itself because morality is decided by consequences of actions. The ‘good’ of saving the innocent people must be weighed up against the ‘bad’ (torturing the suspect) in order to make a decision on the correct course of action. Bentham calls this method of moral evaluation the ‘principal of utility. Whereas for deontologists, they believe our moral obligations do not entirely depend on the consequences of our actions. First, the ticking-bomb scenarios are cases in which torturing the terrorist will save many innocent lives at the cost of non-lethal suffering to one individual. Torturing the terrorist would thus produce the most happiness/well-being. This approach has great strengths but also creates complex questions: is torture still the lesser evil if it only saves one person? Is it morally right to torture a person’s children to extract a confession? Is it morally right to torture ninety-nine people in an attempt to save one-hundred others? In theory this type of thinking can justify extreme inhumanity as long as it is calculated as the lesser evil. Secondly, one ought to do what produces the most happiness/well-being. Despite the wider case against torture, a person confronted with the immediate choices in the ‘ticking bomb’ case is unlikely to take these issues into account; ‘interrogators will still use coercion because in some cases they will deem it worth the consequence. Few people would be unable to see a moral basis for torture if it was carried out in a reasonably clear ‘ticking bomb’ case and if the intention of the torturer was to ‘do the right thing.’ The difficulties of the immediate choice between carrying out torture and allowing deaths make it difficult to morally condemn the unfortunate person charged with deciding. Alan Dershowitz challenges the legitimization of non-lethal torture in his essay, “Should the Ticking Bomb Terrorist be tortured?” He claims that torture should indeed be legitimized for specific scenarios that require such action. The ticking bomb terrorist gives the example of a terrorist withholding time-sensitive information that could result in the death of innocent citizens, if not shared. Not only does Dershowitz challenge the idea of torture, but he also gives a probable solution that favors the legitimization the torture. He mentions three values that would have to be complied with by all three branches of government if it were to be legitimated, which Dershowitz does endorse. Torture, as defined by the Oxford dictionary is the action of forcing a person to expose something through pain and suffering (“Definition of Torture in English”, 1). It has been a very effective means of extracting information. The practice of torture was originally used on slaves to increase productivity. It later proved to be an efficient approach to force individuals to disclose information. Many civilizations have used this practice throughout history, each with their own unique way. The Greeks used a technique known as the brazen bull. This approach consisted of a victim to be placed in an iron bull and steamed alive (Blinderman, 1). A very gruesome and agonizing approach but widely accepted at the time because it delivered results. Torture, though a controversial topic today, should be acceptable, because firstly, it can lead to the gathering crucial intelligence, secondly, it is a quick approach to gain said information, and finally, it is can be sanctioned in an ethical aspect.

Hedonism focuses on pleasure or happiness as being the only good (“Internet Encyclopedia of Philosophy”). Pleasure and happiness are considered goods themselves since compared to friends or families that can produce such valuables as pleasure and happiness (“Internet Encyclopedia of Philosophy”). At first glance, Utilitarian moral theories may seem to support the idea of torturing this innocent man. If we look at this situation we see that there is a dilemma of hurting one man, or having to bear the death of many. We may say that since the basis of Utilitarianism is to do what is best for the greater good, then there is no question that we would torture this one man so that we may save thousands. Take a step back and look at this situation from another angle. What truly is the greater good here? Let us focus on the idea that “if punishing John will do no good, then John should go free” (Pojman, 2002, p.109). What is the chance that a captured soldier is going to give away the secret location of the bomb? It is highly likely he has been trained not to speak under any circumstances. If he does not speak then you have just diminished utility for every single person involved.

Deontological moral theory is a Non-Consequentialist moral theory. While consequentialists believe the ends always justify the means, deontologists assert that the rightness of an action is not simply dependent on maximizing the good, if that action goes against what is considered moral. It is the inherent nature of the act alone that determines its ethical standing. For example, imagine a situation where there are four critical condition patients in a hospital who each need a different organ in order to survive. Then, a healthy man comes to the doctor’s office for a routine check-up. According to consequentialism, not deontology, the doctor should and must sacrifice that one man in order to save for others. Thus, maximizing the good. However, deontological thought contests this way of thinking by contending that it is immoral to kill the innocent despite the fact one would be maximizing the good. Deontologists create concrete distinctions between what is moral right and wrong and use their morals as a guide when making choices. Deontologists generate restrictions against maximizing the good when it interferes with moral standards. Also, since deontologists place a high value on the individual, in some instances it is permissible not to maximize the good when it is detrimental to yourself. For example, one does not need to impoverish oneself to the point of worthlessness simply to satisfy one’s moral obligations. Deontology can be looked at as a generally flexible moral theory that allows for self-interpretation but like all others theories studied thus far, there are arguments one can make against its reasoning.
Here Bentham is saying that the principle is the only valid of deciding and justifying our actions, that the principle should be applied regardless of any others, as it is the only true and reliable way of defining whether an action is right or wrong. An advantage of utilitarianism is that it can be applied to any situation. Unlike many moral approaches you are not restricted by rules such as ‘it is always wrong to lie,’ or ‘killing is never right.’ This allows the philosopher to consider any dilemma or problem in it’s own specific context. For example applying Kantian ethics, abortion or euthanasia would have to be defined as wrong, however a utilitarian has the scope to make there own decision considering a range of factors and situations.
As we analyze this scenario through the eyes of Kantian Deontology, it is imperative that we recognize that, for our purposes, the lives of the civilians in question are irrelevant. This is because, as stated earlier, the consequences of one’s actions are meaningless; it is only the intent and will that truly matter in deciding an actions morality. We are only concerned with discerning the moral nature of torture itself. By removing the possibility of a terrible outcome, Kant leads us to a clear verdict on torture. In response to the first question that Kantian’s must ask themselves, it appears that torture fails. Torture is certainly not a maxim that many would want to will into the natural law. The second formulation of the categorical imperative, the basis of the second question that Kantian’s need to consider, is where torturing for information is declared absolutely impermissible. By torturing someone for information, specifically the location of several bombs, we are disregarding their rational autonomy by using them merely as a means only (Reitan). Act utilitarians like Bentham believe that an action is right or wrong depending on what good will the society results from it. Even if the action individually is not necessarily morally right as long as the ending result is beneficial for the society, that action is then considered right.
