The new Constitution of the United States, ratified in 1789 by James Madison, created an entirely new system within America, which had never been attempted before. The first consideration to make is the new institutions created by the Constitution. Before its adoption, America was operating under the Articles of Confederation This document offered us a set of universal values out of which laws and codes have emerged and have been carried out . As such, it symbolizes the essence of constitutionality—that government must be restrained by the rule of law. The year of 1776 was a time of revolution, independence, and patriotism. American colonists had severed their umbilical cord to the Mother Country and declared themselves “Free and Independent States”.1 The chains of monarchy had been thrown off and a new government was formed. Shying away from a totalitarian government, the Second Continental Congress drafted a document called the Articles of Confederation which established a loose union of the states. It was an attempt at self-government that ended in failure. The Articles of Confederation had many defects which included a weak central government that lacked the power to tax, regulate trade, required equal representation and a unanimous vote to amend the Articles, and had only a legislative branch. As a result the United States lacked respect from foreign countries. These flaws were so severe that a new government had to be drafted and as a result the Constitution was born. This document remedied the weak points of the federal government and created one that was strong and fair, yet still governed by the people.
In today 's government political parties are a large part of government operations and how decisions are made in the government. In Madison 's The Federalist, No.10 Madison talked about how factions can control and cause harm to the government. A solution to this control was the use of a republic in order to limit the power of factions and keep them from having complete control. In our government however, factions have become a major part of the government system with political parties having complete control over the different branches of government. The use of this two political party system creates many problems within our government as the two parties fight for control over legislature and control over the government. Despite using a republic system as Madison mentions in his paper, factions continue to control and affect our government today. Madison 's views on government branches also affects our government today. Our government being in branches does help our government from being affected by corruption by each branch being independent from each other. These independent branches help prevent corruption by each branch having independent leadership and control and not being affected by the views of each other. They insisted that in order achieve a greater amount of freedom, a national government was needed to avoid the civil unrest during the system under the Articles of Confederation. Claiming that the new national government would be a “perfect balance between liberty and power,” it would avoid the disruption that liberty [civil unrest] and power [king’s abuse of power in England] caused. The “lackluster leadership” of the critics of the new constitution claimed that a large land area such as America could not work for such a diverse nation.
The Constitution is important because it was expressly designed to limit powers into three co-ordinate branches, the legislative, executive, and judiciary branch; none of which was to have supremacy over the others. This separation of powers with the checks and balances which each branch was given over the others was designed to prevent any branch, from infringing individual liberties safeguarded by the Constitution. I think the U.S. Constitution was a way for the U.S. to establish government which was a negotiation between the two former governments, a monarchy and total state power. I think by creating the checks and balances, people’s rights would be safer and they would feel more secure not having one branch of government with absolute power. What I found most interesting about the Constitution was how complex and detailed the framers made it, to effectively explain and limit the individual branches of power in government. In the words of Thomas Paine, "a government without a constitution is power without right". Meaning that for power to be granted, it is necessary to establish a constitution.
Before the adoption of the United States Constitution, the U.S. was governed by the Articles of Confederation. These articles stated that almost every function of the government was chartered by the legislature known as Congress. There was no distinction between legislative or executive powers. This was a major shortcoming in how the United States was governed as many leaders became dissatisfied with how the government was structured by the Articles of Confederation. They felt that the government was too weak to effectively deal with the upcoming challenges. In 1787, an agreement was made by delegates at the Constitutional Convention that a national judiciary needed to be established. This agreement became known as The Constitution of the United States, which explicitly granted certain powers to each of the three branches of the federal government, while reserving other powers exclusively to the states or to the people as individuals. After the American Revolution, each of the original 13 colonies operated under its own rules of government. Most states were against any form of centralized rule from the government. They feared that what happened in England would happen again. They decided to write the Articles of Confederation, which was ratified in 1781. It was not effective and it led to many problems. The United States constitution is said to be unique compared to any other forms of law. There are four ideal concepts that set the constitution apart from any other law. The four ideal concepts is representative-democracy, federalism, separation of powers, and interpretation (Marks; 9/8/16). All of these concepts were different from the other world governments at the time in 1787. Most likely taking influence from Jean-Jacques Rousseau and John Locke, the U.S. constitution tries to establish trust between the people and the government. It sets up limitations, functions, hierarchies, and constant debate. The constitution serves as a benchmark and a reference point to see what the government can and cannot do.
American politics is often defined by a continuing power conflict between the executive and the legislative branches of the government. This struggle for political power between the two stronger branches of the three is inherent in the Constitution, itself. The concepts of separation of powers and checks and balances ensure that the branches of government will remain in conflict and provide a balance that keeps the entire government under control. As it was first established, the executive branch was much smaller and weaker than as we know it today. Consequently, the legislative branch was unquestionably dominant. Over the course of history, the executive branch grew in both size and power to the point where it occasionally overtook the legislative and today rivals the legislative in a much closer political battle. Today both branches have major factors that contribute to their power, but on the whole the legislative remains the lastingly dominant branch.
The United States government braces its power among three powerful branches, legislative, executive and judicial.
