A well founded government is one which has the consent of the people it governs. This system is used to protect its people and provide them with the necessities to prosper. But, many individuals have believed that majority of the time government should not interfere in economic and political affairs. This type of government is known as an active government which can be referred to as a “large government.” Transcendentalist Henry David Thoreau, Civil Rights activist Dr. Martin Luther King Jr., and political anarchist Emma Goldman argue the right to break unjust laws that the government up holds for the public. Although some are more radical than others, each thinker asses their idea in a different way. Thoreau and King both believe that the best way to rid an unjust law is by performing acts of civil disobedience. Goldman on the other hand, believes in complete obliteration of the government thus becoming a state of anarchism. All three thinkers have made it clear in their arguments that it is justified to break an unjust law.
In his essay “On the Duty of Civil Disobedience,” Henry David Thoreau starts off by saying, “Government is best which governs least” (Thoreau 98). Thoreau clearly states that he is not an anarchist and does not believe that government should be abolished. Rather, he believes that we are entitled to a better government that is based upon morality and justice. Thoreau explores the idea of civil disobedience and challenges the role of government by describing his own incarceration for refusing to pay taxes during the Mexican-American War to expand slavery. So many individuals have disobeyed unjust laws because they have felt it is their moral integrity to do so. In Sophocles tragic play Antigone, the main protagonist buries her brother Polyneices' body, by disobeying Creon's deceleration of letting his corpse rot and be eaten by vultures. Knowing the consequences, Antigone still accepted her faith. Individuals disobey laws on the grounds that a higher moral law may be at risk.

In 1848, David Thoreau addressed and lectured civil disobedience to the Concord Lyceum in response to his jail time related to his protest of slavery and the Mexican War. In his lecture, Thoreau expresses in the beginning “That government is best which governs least,” which sets the topic for the rest of the lecture, and is arguably the overall theme of his speech. He chastises American institutions and policies, attempting to expand his views to others. Thoreau wrote "Civil Disobedience" in 1849 after spending a night in the Walden town jail for refusing to pay a poll tax that supported the Mexican War. He recommended passive resistance as a form of tension that could lead to reform of unjust laws practiced by the government. He voiced civil disobedience as "An expression of the individual's liberty to create change" (Thoreau 530). Thoreau felt that the government had established order that resisted reform and change. "Action from principle, the perception and the performance of right, changes things and relations; it is essentially revolutionary" (Thoreau 531).
Obedience to civil law is necessary to uphold order and peace. In the play, Antigone, by Jean Anouilh, Creon, the king of Thebes, states that anarchy is the greatest of evils and that good lives are made through discipline and lawfulness (Anouilh 42-47). Creon’s judgment and emphatic support of civil law makes him an inadequate leader because his actions in various situations lead to the untruthful messages to his people and the loss of his family members.
Civil disobedience is the purposeful violation of a law to show that it is unconstitutional or morally defective. In the plays, Antigone and Trifles, the female main characters commit an act of civil disobedience. The plays are respectively written by Sophocles and Susan Glaspell. Antigone, the main character of Antigone, protects her dead brother's honor as she disobeys the laws of King Creon. Mrs. Hale, the main character of Trifles prevents a neighbor from being charged with homicide as she breaks the law in front of two lawmen-The Sheriff and the County Attorney. Both characters' crimes are similar; however, their differences lie in how they handle their violations. Antigone boldly and proudly breaks the law, does not care if she is caught, and loudly admits to the crime in front of her fellow Theban citizens. On the other hand, Mrs. Hale performs her crime artfully and quietly, does not want to be caught, and has no intentions of exposing her crime. Both characters accomplish their tasks, but Mrs. Hale's actions are carried out more effectively. She saves her neighbor and herself from imprisonment.
In his famous essay, “Letter from Birmingham Jail,’’ Martin Luther King, Jr. cites conscience as a guide to obeying just laws and defying unjust laws. In the same way, Henry David Thoreau wrote in his famous essay, “Civil Disobedience,” that people should do what their conscience tells them and not obey unjust laws. The positions of the two writers are very close; they use a common theme of conscience, and they use a similar rhetorical appeal of ethos.
In Sophocles’ Antigone, the most prominent theme is the concept of divine law versus human law. Henry David Thoreau was a mid-nineteenth century transcendentalist philosopher and writer. Thoreau is best remembered for his book “Walden”, detailing his simple life living by Walden Pond. His other most well-known work is “Civil Disobedience”, a philosophical, political piece concerning his views on 19th century America. A fervent pacifist, humanitarian and abolitionist, Thoreau stopped paying his poll taxes (a tax levied on all adults in a community) as a form of protest towards the government for the Mexican American War and slavery. After being imprisoned in July 1846 for not paying his taxes, Thoreau wrote Civil Disobedience in response. According to the American heritage dictionary “Civil Disobedience” is refusal to obey civil laws in an effort to induce change in governmental policy or legislation, characterized by the use of passive resistance or other nonviolent means. In “Civil Disobedience” Thoreau stated “That government is best which governs least, and I would like to see it acted up more rapidly and systematically” (pg227). Thoreau did not believe that the government should have the final say on everything. The citizens of this country should have rights in the decision making process and the opportunity to think for themselves also. Thoreau says that government does not, in fact, achieve that with which we credit it: it does not keep the country free, settle the West, or educate. Rather, these achievements come from the character of the American people, and they would have been even more successful in these endeavors had government been even less involved.

The government today holds power over the people in the United States. Even though the United States is a democratic government there is still corruption within it. Such as there being corrupt police officers who may lie to save himself knowing that he was wrong. Enabling the persecution of another person who is innocent. Also the rich in this government still hold the most power in this country. A rich person may buy their way out of jail, while a non rich person is not able to. I believe civil disobedience is a great way to combat the government because it prevents bloodshed and allows a message to get across if down with enough people to gain attention.

During Thoreau’s life, there were two major issues being debated in the United States: slavery and the Mexican-American War. Both issues greatly influenced his essay, as he actually practiced civil disobedience in his own life by refusing to pay taxes in protest of the Mexican War. He states that the government should be based on conscience and that citizens should refuse to follow the law and have the duty not to participate and stay as a member of an unjust institution like the government. I argue that the notion of individualism and skepticism toward government is essential to the basis of many important reform movements in the modern society.

His main point is that any man, who treats himself as a conscience man, should differentiate laws in order to determine which law is right or wrong, and consequently no to obey that unjust law.
