Since 1973, when Roe vs. Wade has been established, there have been many heated debates among pro-life and pro-choice groups. With abortion being an option for women, it is important to know whether a fetus can feel pain during an abortion procedure. Various people have considered abortion to be unlawful unless it saved the life of the mother (McBride). The court decided based on the history of abortion laws and considered three reasons for banning abortion. One was “A Victorian social concern to discourage illicit sexual conduct.” This was rejected because of modern gender roles. Secondly, “protect the health of women” was to provide a safe medical environment for the mother and was also rejected because medical technology was advancing. Thirdly, “protecting the prenatal life” was argued by the court since they considered the fetus not yet a “person.” “America’s criminal and civil laws only sometimes regard fetuses as persons deserving protecting” (McBride). So, from 1973 to 2013 there have been an estimated 56.6 million abortions that have been performed among pregnant women. That’s approximately 1.4 million abortions performed annually. The topic of abortion has also made the nation politically divided, as a result of many see abortion as killing a child, while the other side of the debate, many see it as it is the woman’s right to choose if she’s ready for a child or not. I personally feel that no matter what gestational age the fetus and or child may be, anesthesia should be given to relieve the pain, if any, to the fetus. Although abortion has been the center of frequent arguments, the question remains if the child endures the pain during the abortion procedure. The Roe v. Wade case originated in the state of Texas in 1970 at the suggestion of Sarah Weddington an Austin attorney. Norma McCorvey otherwise known as "Jane Roe" was an unmarried pregnant woman seeking to overturn the anti-abortion law in the state of Texas. The lawsuit claimed that the statue was unconstitutionally vague and abridged privacy rights of pregnant women guaranteed by the first, fourth, fifth, ninth, and fourteenth amendments to the constitution. But, there are many differences between an actual person and a fetus. First of all, a fetus is completely dependent on the mother. Fetus’s need their mothers in order to be fed correctly, to live in a stable environment, and to grow and expand among many other things. Because the fetus cannot survive on its own, then it does not qualify as a human being. In addition, a fetus that is still inside the womb is only a potential person. The fetus resides inside of the mother, and thus is part of the mother herself until it is born. Another difference between a fetus and a person is that a person can feel pain. Anti abortionist commonly argue that abortion is wrong because it would cause pain to the fetus. But, according to Mark Rosen, an obstetrical anesthesiologist at the University of California at San Francisco, “the wiring at the point where you feel pain, such as the skin, doesn’t reach the emotional part where you feel pain, in the brain.” Furthermore, the thalamus does not form until week 28 of the pregnancy. So, no information, including pain, can reach the cortex in the brain for processing. These facts prove that a fetus would not be affected by the mother’s choice of having an abortion, thus proving Marquis and all other anti-abortionists wrong.

The United States government has a difficult time with coming to an agreement on whether to ban abortions, or keep them. Although the United States is about freedom and the people, the government should be more concerned about the health of its nation. According to the Stedman’s Medical Dictionary, an abortion is “Expulsion from the uterus of an embryo or fetus before viability (20 weeks’ gestation [18 weeks after fertilization] or fetal weight less than 500 g)” (Williams and Wilkins). An abortion can be performed in many different ways, depending on the time in which the abortion is taken place and the size of the fetus. There are three main categories in which an abortion can be performed. The most common form of an abortion is those that invade the uterus and kills the child by instruments which enter the uterus through the cervix. An abortion that happens toward the fifth month of being pregnant, is to kill the preborn child by administering drugs; the mother will then be put into induce labor where she will deliver the dead baby. Then the last three months of pregnancy, doctors will invade the uterus by abdominal surgery; during this time the umbilical cord is cut, thus cutting off the baby’s oxygen supply in which it causes suffocation. Through all of these abortions, the mother of the child is impacted in some way or another. With every abortion the mother undergoes, the more negative affect it has on her fertility, and her reproductive system.

Sometimes, the fetus is born alive, but it is left in a corner to die. Although the abortion process provides pregnant women with an alternative option, after twenty weeks, due to the emotional and sensory growth of the fetus, it would be cruel and unethical to have an abortion.

“The first essential requirement for nociception is the presence of sensory receptors, which first develop in the perioral area at approximately 7 weeks gestation and are diffusely located throughout the body by 14 weeks” (Meyers 241). Nociceptors are sensory receptors in the body that respond to stimuli that is in the form of pain. This means that an unborn child is in fact capable of comprehending and feeling pain. On January 22, 1973, the U.S. Supreme Court, in two separate decisions, Roe v. Wade and Doe v. Bolton, declared that Congress and the states had to adopt a policy on abortion. Since then, abortion has been one of the most controversial issues in our country today. Every time the subject of abortion is raised, the same question always comes up: should people have the right to terminate an unborn child? The answer is no. No person should have the right to terminate an unborn child which has not yet had the chance to live, no matter what the reason is. Abortion is the termination of an alive, unborn child, which can experience pain through the process of an abortion. These facts only help to prove that a fetus is an actual person, who deserves the chance to be born. Contrary to belief, a fetus can actually feel pain. The observation of abortions on ultrasound have been very disturbing. So disturbing, that many abortion doctors who have seen the procedure, refuse to participate in abortions again (Meyer 62-64). An article entitled ıFetal positions: Making Abortion rareġ reports that, ıBernard Nathanson, a former director of the National Abortion Rights Action League, who performed thousands of abortions, repudiated the practice in the early 1980's after observing the apparent agony of a fetus subjected to a suction-tip abortionġ (Meyer 62-64). Modern neurology supports the claim that the fetus can experience pain, not just reflex. Reflexive reactions stimulate only the spinal column, but the more complex reactions that stimulate pain occur in the tiny portion of the brain called the thalamus.
