Justice. It is something that everyone wants, something that we strive for, even something that sparks. However, when we think of lawyers, we think of superheroes with an expensive education, walking into the courtroom and serving up justice. What no one thinks of is the person that helped the lawyer get there, the paralegal that prepares the necessary documents, the paralegal that makes sure his or her attorney is at the right place at the right time. A paralegal is crucial and in some cases vital to our justice system yet they are so often over looked.
To understand what a paralegal does we must first understand what the job of a lawyer entails. Black’s Law Dictionary defines a lawyer as “a person learned in the law; as an attorney, counsel or solicitor; a person who is practicing law.” Attorneys generally have around seven years of a college education under their belt, they have the authority to argue their clients case before a judge and jury. Just because a person has a law degree does not necessarily mean that they are skilled lawyers. One could have the best education money can buy but still be a lousy attorney. Practice and careful preparation is needed before one goes to court, but there is still one thing that is invaluable to an attorney.
Experience. All of the classes in the world could not prepare one for the nerve that it takes to stand before a judge and jury with your client beside you trusting you to put up a fight. The job of a criminal lawyer is quite difficult. Whether on the defense or the prosecution, you must work diligently and swiftly in order to persuade the jury. Some lawyers play dirty and try to get their client off of the hook even though they are guilty without a doubt. Even though the evidence is all there, the prosecution sometimes just can’t get the one last piece of the puzzle to make the case stick and lock the criminal up. People are represented in court by two kinds of lawyers, court-appointed lawyers and public defenders, which mean "hired lawyers" (Green, 2001). People that have higher income can hire their own lawyers. The lower and middle-income people are mainly the ones who rely on court appointed lawyers. These people don't have the money to hire a lawyer. Court appointed lawyers are not working in your best interest for many reasons.

Attorneys ensure that society has a place to seek and obtain justice, giving confidence that restitution and retribution can occur within the law. Attorneys have a difficult job. They must know the laws like they know the back of their hands. Attorneys attend school just as long or even longer than most doctors. They have the difficult job of defending their clients or prosecuting the bad guys.

Before starting the paralegal program, I did not have a clear understanding of what a paralegal actually does. I always been interested in being a paralegal, but never clearly understood the full responsibilities. After being in this program, I have some understanding to the many responsibilities than I initially knew. The primary function of a paralegal is to assist attorneys in preparing for hearing, trials, meetings, and real estate closings. In addition, paralegals can also do other office tasks, such as office management as trainer of new hired paralegal, book keeping, and free lancing.
For the first mock trial held in class, the case of the stolen lunch, I did not have a large role. I chose to be a part of the jury, which I feel gave me an immense feeling of responsibility and really allowed me to deeply analyze the case as it was being presented. Within this case, Mary Ovechkin, the plaintiff, had claimed that her lunch had been stolen and ate by the defendant, Sammy Crosby. My first expectation of this case, before it had actually started, was that the defense and prosecution would each have time to present their cases. I expected both sides to question those who were involved, such as the witnesses, defendant, and plaintiff. Then I expected to have to come up with my own verdict to share with the rest of the jury based on the evidence presented. Based on my role, I expected to learn how the jury reaches their decisions.
The United States Constitution gives us the right of due process under the Fifth Amendment. The right to an attorney is something that should never be taken away. So how do attorneys help their clients? What standards are set to protect them? There are strict guidelines that attorneys must follow to avoid legal misconduct. These standards are stated by the American Bar Association in the ABA Model Rules of Professional Conduct. It is very important that attorneys decide carefully before taking on a case for many reasons. They must remember that they have to carefully consider the needs and problems of their clients and uphold their ethical responsibilities to their profession and the criminal justice system. It is when a lawyer does not balance the needs of the client with the ethical aspects of his or her profession that misconduct can occur.
