According to the Penal Code Section 459: “Every person who enters any house, room, apartment, tenement, shop, warehouse, store, mill, barn, stable, outhouse or other building, tent, vessel, etc., with intent to commit grand or petit larceny or any felony is guilty of burglary.” This is the section code for California that explains what burglary means. The FBI defines the term burglary as an “unlawful entry into a structure to commit a felony or theft, by forcible entry, unlawful entry where no force is used, or attempted forcible entry”(Larkin 2009). If a person would like to see more information about burglaries they can check in the California penal code sections 458-464 which go in depth about burglary. There are different degrees of burglary for example burglary in the first degree may be imprisonment in the state prison for two to six years, and burglary in the second degree may be imprisonment in the county jail nothing beyond one year.
There are different types of places that get burglarized but typically, the most common types of burglaries occur in homes. Investigating a home burglary goes much deeper than we realize, it may seem like something small and not a big deal but really it is a big deal. Normally, burglars don’t do it just once, they do it multiple times and to different people. First of all, it depends on the type of burglary there are various types. When an officer first responds to a home burglary he or she first inspects the scene, the perpetrator may still be inside the home. Officers take cautious steps by checking every room in the building and ensuring that the home is safe for people to be inside. They are lucky if the perpetrator is still there because then he or she would be caught on scene and that w...

...efore committing the crime. Lastly, the targeted typically operate with a group of criminals and they target the wealthy homes. These types of burglars are the most skilled and are only interested in the most expensive products. These are the different types of burglars and each of them is there to commit a crime, some are better than others though.
Burglaries happen a lot in homes and happen very often, mostly when it is warmer outside because people are on vacation and away from their homes for long periods of time. Homeowners are recommended to get security systems installed on their properties to help prevent bad things to happen while they are away. Police officers are doing what they can to help prevent burglaries and all sorts of crimes in our communities. Even though burglar’s strike many times they eventually do get caught and pay the price with jail time.
This paper will provide an explanation into how differential association theory explains burglary. Burglary, according to the Federal Bureau of Investigations (F.B.I), considers a property crime a Type 1 Index Crime because of its potentially violent nature. The F.B.I. breaks burglary down into three sub classifications. This paper discusses the elements of the crime of burglary and what constitutes a structure or dwelling. It will discuss a brief history of the deviance, trends and rates, and how it correlates to the specific theory that this paper will also discuss.
Since burglary is their primary form of income, they would need to know the ends and outs of presuming their targets and be dedicated to getting the job done. Also, this individual must be able to accept all circumstances that come with the territory, such as being apprehended. A burglar can be compared to several professions; however, the initial thought that comes to mind is an attorney. Attorneys are known foremost as swindlers that maneuver their way through the judicial system to success. Just as a burglar a lawyer investigate the circumstances and come to a conclusion on how to win a case. Weather the client is innocent or guilty; they do what’s necessary to retrieve a
Even though there have been many ex-cons that have left the prison system many times when they are released they are merely better-educated and skilled criminals, it does not matter how much money you have, your race, color, background, religion, sex everyone is affected because we are all a part of this problem. If you vote, if you pay taxes, if you are afraid to walk alone at night, you are already involved. More than half of all US prisoners that are serving time for non-violent offenses, and most nonviolent offenders do in fact learn a lesson while in prison: how to be violent.
With the evolution of our economy and technology we have experienced a new wave of crime and it’s not by the low level street criminals you would expect, but high end, tie wearing business men and women. Merriam-Webster defines crime as “an act or the commission of an act that is forbidden or the omission of a duty that is commanded by a public law and that makes the offender liable to punishment by that law” (Merriam-Webster). There are many types of crime but the two this paper will focus on are white collar crime and its comparison to street crime. You won’t find an official definition of street crime, but it’s normally thought of as theft, robbery, car theft, arson, drug dealing, and vandalism. The phrase “white-collar crime” was first
There are numerous theories as to why a crime is committed. Rational choice theory, which is a subset of classical theory, says that before people commit a crime they think about what they are going to do. They weigh the pros and cons before committing the criminal act. The rational choice theory is well suited for the causation of burglary. The support for this theory is that burglars do not commit crime for the fun of it or just because they want to. It is usually because they need money to keep their heads above water. In their situation, they do not see any other way than to steal to make a living. The opposition for rational choice theory is that criminals do not think before they act as they may be incapable of thinking rationally in the first place.
One of the world’s most horrible crimes is homicide. Homicide is taking the life of another human being by another human being. Homicide is classified in 3 ways justifiable, excusable, and criminal. Another crime I want to discuss is burglary. Burglary is also called breaking and entering into someone’s home or business by gaining entry with the intentions of committing an offense. Burglary is also a felony one must use force to gain entry in order for it to be considered a burglary. Investigations must be ethical. An investigator must be professional and compliant when investigating these crimes.
President Barack Obama, the United States of America’s 44th president is on his second term of presidency and has addressed more social and financial issues during his tenure than crime control policies. President Obama came into office in 2009 and continues to serve as President of the United States. As one evaluates the policies that are in place during his administration a conclusion can be made that his primary focus has been that of health care, civil rights, and foreign policy amongst other agendas that don’t necessarily address his crime policy. President Obama has not proposed any majorly significant crime policies or drastic changes in the crime policies that were in place prior to his appointment (Marion & Oliver, 2012).
I don’t know what people thought of when they saw JH’s family before their involvement with the criminal justice (CJ) system. However, I am sure they did not suspect the horrors that went on behind closed doors. JH, now about fifteen years old, was being sexually abused by his older brother and father. They both even recorded the acts. Eventually law enforcement got involved, police arrested the father and brother, the DA pressed charges, lawyers got involved, the courts sentenced them, they were incarcerated, at some point they’ll most likely have a parole hearing, and eventually might be released from prison. That is what most people think of when they think of criminal justice. Criminal justice is often erroneously limited to a crime, the
Criminology is the study of crime and criminals. In criminology, crime data is gathered in many different ways. All of these ways are part of the National Incident-Based Reporting system, which is a program that collects data on each respond crime incident (CITATION). There are Primary Sources of collecting crime data, and Secondary Sources of collecting crime data. Under the Primary Sources of collecting crime data are the National Crime Victimization Survey, Self Report Surveys, and the Uniform Crime Reports. These reporting surveys and official records gather information for Criminologists about all types of crimes. Some examples of these are homicide, rape, aggravated assault, robbery, arson, burglary, and larceny. Criminologists use these also to measure the nature and extent of the crime, along with behavior and personalities of the offenders. Secondary Sources of collecting crime data are Experimental Research, Observational and Interview Research, Data Mining, Crime Mapping, Meta-Analysis and Systematic Review, and Cohort Research. These gathering techniques gather informatio...
This essay will talk about what Situational Crime Prevention( SCP) is, it will also discuss the theoretical assumptions that underpin this approach, for example, the nature of the offender as well as examining how the SCP strategy has been used to deal with crime as well as the general pros and cons of such an approach.
Now you are going to take a look at the preventive behaviours of victimized and not victimized groups. It is obvious that in many cases the lack of protective measurements contributed somewhat to victimization. If you make a comparison between the two groups, you can see that at the time of the crime burglary victims had fewer household security measurements than not victimized. (Weinstein, 1989) As you can see there is no guarantee when or who is going to be victimized. Many will think that burglary victims’ experience does not deserve to be examined, but they are wrong. The main reason is that households are something sacred, where a family stores its memories, documents and everything else that no one different from family member deserves to see. This mean that these victims do not deserve invaded homes.
Once the officers arrive on scene and talk to the homeowner or business owners they must now for their and the citizens safety get the scene secured in a timely manner. Generally, it is not necessary to go to far lengths to secure a burglary scene because most times the burglar is already gone away from the scene of the crime but they still need to secure the scene just to be safe. They first need to ask the victim to avoid touching anything inside of their home or business, and try to keep them in an undisturbed portion of the scene such as the garage or in the kitchen where its likely the offender did not go through. Traffic through the building should be minimized. This is very important so that when the crime scene team arrives on scene they are able to dust for prints and look for clues that will help them head in the right direction to catch the assailant. In some cases the victims may have already been through their
Property Crime can be defined as the unauthorized taking or damaging of an individual’s personal belongings. This is not limited to robbery of any kind, fraud, or even arson, but all of these crimes have several coinciding traits that group them under this term. While property crimes are meant to take something that is not ours and use it for our own advantage, violent crimes are used to harm or even kill another rather than using for ones self. This includes hate crimes, murder, rape, and abuse. Hate Crimes are unique because they usually target someone who’s different than the race or sex of that individual committing the offense whereas murder and assault are not always gender or race defined. Therefore, property and violent crimes are influenced by social inequalities that are caused by gender, race, income and age; thus why the legal definition of crime cannot cover all possible scenarios without taking each individual case and studying social behaviors in these of why or what was the cause of the crime committed.
...ney.” According to a study done by Schwartz and Pitts at Ohio University,” 70% of homicides happened between 6 p.m. and 6 a.m. A majority of those homicides were done in low income areas. In the same study the average victim profile in household burglary is less than 19 years old, an annual income of less than $15,000, and renters living in a multifamily unit.
A home burglary investigation, the objectives of this type of investigation, and how the objectives will relate to a successful completion. The first objective of a home burglary investigation is crime detection. Typically a home burglary is reported by the homeowner, once they have returned from being away. It could be found by the detection of property loss, or a forced entry point. A report by neighbors who keep an eye on their neighborhood and observe the burglary in progress is another example of crime detection. Naturally, a better outcome would be to have someone, a witness who sees the suspect enter the residence, report it. This will take us to the second objective much more quickly. A burglary in progress is dispatched immediately with a minimum of two officers, while a burglary report is dispatched within thirty minutes with a one officer response (Columbus Police 2007). The police will be dispatched to a burglary in progress quicker and with a larger response.
