Criminal Justice Final Paper The criminal justice system is composed of many intricate parts that are all necessary for the system to work properly. Every division of the system accounts for its own specific tasks and does their best to protect the law of the land. The major components are the police, the courts and the corrections. Each of these groups bring their own set of specialized skills to reach further towards the goal of a peaceful society. The police are responsible for making arrest, writting citations, patrolling the streets, etc. The police are responsible both for bringing in individuals after criminal activity and also trying to prevent crime from hapenning. They are the vigilant eye that protects the general public from crime. Patrol is one of the major components of the policing job. An example would be a prison inmate being starved for behavioral issues. Although punishment is necessary, making an inmate go without basic human needs is considered to be unconstitutional. Every individual who is arrested is guranteed the right to a speedy trial by jury. It is at this time that it is considered whether or not the accused is guilty or not. Without the attempt to prove their innocence there would be many people who are imprisoned falsely and not given the chance to prove they are not guilty. Due process is the gurantee that individuals will be treated fairly and within the realms of constitutional justice when they are going through the criminal justice process. Until proven guilty an individual in many cases has the right to come and go as they would before until they are proven innocent or guilty. One of the benefits of due process is demonstrated in the Belshaw case. The inquisitorial system of justice is based on crime control; the Swiss police had a hard time in Canada with Mr. Belshaw, because of his right to due process, under Canadian law. Both systems of justice share common beliefs, for example, they both look for proof beyond a reasonable doubt. In Canada we fight about facts and laws, where-as the inquisitorial system searches for the facts. The adversarial system has a separation of powers with the police, crown, defense, and the judge. It is quite different for the inquisitorial system of justice, the police do the arrest, then they present the facts to crown, which then decide if they have a case and turn over the evidence to the judge. The only problem is that the judge decides what will lead them to the truth. How any evidence was collected is irrelevant. In due process if the police obtain evidence and violate the law or a persons charter of rights and freedoms the judge will exclude the evidence from the hearing, even if it would help or prove that the person is guilty. These two systems of justice are generated in democratic traditions.

Being a citizen of the United States comes with advantages that no other country can match. We are granted rights and privileges just for being born within our borders. Others can also gain these rights by adopting our way of life and swearing to uphold its values. Being a citizen or not, we are expected to obey laws that the U.S. Government has put in place to maintain order and balance. When we don’t obey these laws the government has the right to punish us. Luckily for us, our Bill of Rights has even granted us rights until proven guilty. It gives us rights to a fair and speedy trial as well as the right to representation during trial. So many rights and procedures have come about since the birth of our nation. We are constantly making new rules to help uphold the old rules and deciding if the old rules still apply. One practice that has been used during trial has no mention in the Bill of Rights, but has been held as constitutional is plea-bargaining.
Today our world is filled with crime. The people committing these crimes must have a consequence for their illegal actions. The system in place to keeping everything fair and safe is called the criminal justice system. This was put in place to ensure there is fairness and justice served to people who break the laws set up by the government.
If someone is a suspect to a crime, they are innocent until proven guilty. This is the American way! Freedom and equality is what we stand for. By stating the Miranda rights this provides equality for everyone. These rights make sure you have a fair, unbiased trial. Once again innocent until proven guilty, would you treat an innocent person on the street unfairly. Why would you treat someone suspected of a crime any differently? Just because they are suspected doesn’t mean that they committed the crime.

It is the right for arresting officers to read the accuser his or her rights because if the courts weren't fair was the purpose of having one. The Miranda Rights does serve a purpose and that's to inform the defendants of his rights before self incrimination therefore; it is up to the defendant to waive their rights. I agree with the courts if the defendant makes a statement before the officer has a chance to read him or her rights that the statement should be used in the court of law. The alternative for an unfair trial could separate Americans for years. We can have two different classes fighting one class to be equal and this could create great ciaos that can destroy our country for years.

The Classical School of criminology is a theory about evolving from a capital punishment type of view to more humane ways of punishing people. Positivist criminology is maintaining the control of human behavior and criminal behavior. They did this through three different categories of Biological studies, which are five methodologies of crime that were mainly focused on biological theories, Psychological theories, which contains four separate theories, and the Sociological theories, which also includes four different methods of explaining why crime exists. The last theory is about Critical criminology. Their goal was to transform society in a way that would liberate and empower subordinate groups of individuals.

In Intro to Criminal Justice class, I had the opportunity to learn about the Criminal Justice System more thoroughly. I learned that there are three components that make up the Criminal Justice System such as the courts, law enforcement, and corrections. Each component has its own role in making sure the the Criminal Justice System is functioning properly. If one of these components are not efficient the Criminal Justice system will not be as strong as it could be.
