Shahriyar Mammadli 21402720 ENG 101-97 Nilüfer Yeşil Essay, first draft -.-.- Are there any legitimate reasons which justify the limitations of freedom of speech? Freedom of speech is the concept that people can spread their ideas, thoughts or interpret others' opinions freely without humiliating their religions, reputations. People have right to receive or impart information without any interference by governments and other people. Furthermore, freedom of speech is the most precious human right that belongs to everyone so that each of us has a right to freely express ourselves either orally or through writing and also through art as well as internet. However, “when it stands on opposition to other individuals’ interests or public interests , such as privacy ,reputation or national security , restrictions and limitations of freedom of speech should be taken into account”(Sun 153). Despite the common idea, there should be some restrictions on freedom of speech in order to eradicate hate speech, protecting national security and protecting minors. Eradicating hate speech is the grave reason for limitation of freedom of speech because of precluding prejudgement and grudge among different religions and nations. Clear and Danger was evaluated in the First Amendment and guarantees the right of Freedom of Speech. I have two scenarios regarding clear and danger, the first scenario is Debs v United States. In this case Debs v United States, Debs felt that socialism is the answer; however, Deb’s was prosecuted for the remarks that he made. In addition, the speech that Deb gave wasn’t as harsh as made by others, for example, George McGovern made a remark about the Viet Nam War during his 1972 presidential bid which was very harsh. This process was done by using its weak form of the clear-and-present-danger test and Deb’s ended up being sentenced to a ten year sentence. In this case Deb’s couldn’t speak everything on his mind that he wanted which was a violation
This source supplies my paper with more evidence of how freedom of speech is in a dangerous place. American has always stood by freedom of speech, and to see how social media platforms try to manipulate and take off as the choose to increase slight bias is unpleasant. The article establishes a worry to the fellow readers that hold freedom of speech so high and that it is at risk. The article manages to explain why freedom of speech is in danger, and why there should be no limits to free speech.
Freedom of speech has been a controversial issue throughout the world. Our ability to say whatever we want is very important to us as individuals and communities. Although freedom of speech and expression may sometimes be offensive to other people, it is still everyone’s right to express his/her opinion under the American constitution which states that “congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or the press”. Although this amendment gave people the right express thier opinions, it still rests in one’s own hands as how far they will go to exercise that right of freedom of speech.
1. The measure of a great society is the ability of its citizens to tolerate the viewpoints of those with whom they disagree. As Voltaire once said, “I may disagree with what you have to say, but I will defend to the death your right to say it” (Columbia). This right to express one's opinion can be characterized as “freedom of speech.” The concept of “freedom of speech” is a Constitutional right in the United States, guaranteed under the First Amendment to the Constitution:
Imagine a time when one could be fined, imprisoned and even killed for simply speaking one’s mind. Speech is the basic vehicle for communication of beliefs, thoughts and ideas. Without the right to speak one’s mind freely one would be forced to agree with everything society stated. With freedom of speech one’s own ideas can be expressed freely and the follower’s belief will be stronger. The words sound so simple, but without them the world would be a very different place.
The Amendment I of the Bill of Rights is often called “the freedom of speech.” It provides a multitude of freedoms: of religion, of speech, of the press, to peacefully assemble, to petition the government. Religious freedom is vitally important to this day because it eliminates the problem of religious conflicts. Historically, many people died for their beliefs because their government only allowed and permitted one religion. T...
Freedom of speech is the right of civilians to openly express their opinions without constant interference by the government. For the last few years, the limitations and regulations on freedom of speech have constantly increased. This right is limited by use of expression to provoke violence or illegal activities, libel and slander, obscene material, and proper setting. These limitations may appear to be justified, however who decides what is obscene and inappropriate or when it is the wrong time or place? To have so many limits and regulations on freedom of speech is somewhat unnecessary. It is understood that some things are not meant to be said in public due to terrorist attacks and other violent acts against our government, but everything should not be seen as a threat. Some people prefer to express themselves angrily or profanely, and as long as it causes no har...
In the United States, free speech is protected by the First Amendment in which it states, “Congress shall make no laws respecting an establishment of religion … or abridging the freedom of speech.” Now, nearly 250 years into the future, the exact thing that the Founding Fathers were afraid of is starting to happen. Today, our freedom of speech is being threatened through different forces, such as the tyranny of the majority, the protection of the minority, and the stability of the society. Now, colleges and universities in the United States today are also trying to institute a code upon its students that would bar them from exercising their right to speak freely in the name of protecting minorities from getting bullied. This brings us into
The fundamental purpose of the first amendment was to guarantee the maintenance of an effective system of free speech and expression. This calls for an examination of the various elements which are necessary to support such a system in a modem democratic society. Some of these elements found early articulation in the classic theory of free expression, as it developed over the course of centuries; others are the outgrowth of contemporary conditions. More specifically, it is necessary to analyze what it is that the first amendment attempts to maintain: the function of freedom of expression in a democratic society; what the practical difficulties are in maintaining such a system: the dynamic forces at work in any governmental attempt to restrict or regulate expression; and the role of law and legal institutions in developing and supporting freedom of expression. These three elements are the basic components of any comprehensive theory of the first amendment viewed as a guarantee of a system of free expression.
The First Amendment is known as the most protected civil liberty that protects our right to freedom of speech. There has been much controversy regarding hate speech and laws that prohibit it. These problems have risen from generation to generation and have been protested whether freedom of speech is guaranteed. According to our text book, By the People, hate speech is defined as “hostile statements based on someone’s personal characteristics, such as race, ethnicity, religion, or sexual orientation.” Hate speech is a topic of issue for many people and their right’s, so the question is often proposed whether hate speech should be banned by government.
Hate speech is often misunderstood because it can be classified as either careless or intentionally hurtful. Many people interpret careless statements as acts of aggression, but with good reason. It would be false to say that the freedom of speech has never been manipulated to inflict damage upon others. Questions have been risen of what hate speech is and if it should be allowed to be viewed by public access. Alan M. Dershowitz delivers an enumerative definition of the term by asserting all speech that criticizes another’s race, religion, gender, ethnicity, appearance, class, physical or mental capabilities, or sexual preference. However simply defining hate speech by listing out its various forms only amplifies its definition, but it fails to clarify. Vicki Chiang manages to provide a more analytical understanding of the term by listing the various forms of the act and addressing the effects upon all involved. Dershowitz’s list of hurtful instances of hate speech conveys a definition of the term as a whole, but does not cover all forms hate speech. Hate speech is any action that conveys a critical perception of an opinion which criticizes a group in a harmful manner. By addressing all forms of hate speech and considering all involved it can be concluded that though such media is often viewed as offensive, it should not be censored by a legislative body that advocates freedom of speech. In a library, one should be allowed access to the records of the past in order to prepare for the future, despite the severity of the content.
Censorship is the control of communication between people. This includes restrictions on what can be seen and heard. Mostly, censorship is practiced by Governments. But religious and political leaders and special interest groups also try to control the flow of information. Censorship violates individual rights, hides useful information, and limits freedom of speech.
Freedom of speech has many positive things, one of which is the help it gives on decision-making. Thanks to freedom of speech it is possible to express personal ideas without fear or restraints; therefore, all the perspectives and options will be on the table, giving people more opportunities to choose from. Nevertheless, everything in life has a limit, and the limit of freedom of speech depends directly on the consideration of the rights of others. People is free of believing what they want, thinking what they want, and even saying what they want, everything as long as they do not intrude or violate anyone else's rights. Under certain circumstances freedom of speech should be limited, and this is more than just a political action, this acts represent the urge for tolerance and the need for respect.
In the past decade, there has been a huge conflict with regard to free speech. There are those who believe that there should not be straining on free speech, while others think there should be limits to how far one can go. However, everyone needs experience in dealing with controversial ideologies as it has them learn and reflect on their own views. If everything controversial were to be censored, the world would be composed of grown up children. Although speech can be taken to a radical extent, no limitations should be placed on freedom of speech because it will only damage the people of society from becoming critical thinkers.
First of all, what does Freedom of Speech mean to people? According to some, it is the
