Unless you are enrolled in the military, you may not have realized that once you join the armed forces, you have given up some of your rights. Striking is a technique that is used by unsatisfied employee who fell like they deserve better for themselves and their employers refuse to listen to what they have to say. In America and some other countries, striking is recognized as a universal right for all citizens. But the only thing is that one of those revoked rights of the armed forces is having the right to protest. As going on strike is a fundamental right, everyone no matter in what occupation should have that right. (Bell and Mark 24) If employees feel that they are being mistreated or have to work in unbearable conditions and have been reporting it to employers, once nothing is being done they should have that right to go on strike. No contract should have the right to deny a persons’ right once it is documented as a fundamental right. In the case of the military, Military personnel should not have to abide to an unfair assessment and just go along with it. Military personnel also has the right to stand their ground. (Protesting 1) If the government fails to acknowledge the pleas of the military, a strike should be a necessity as military personnel have an essential role in government functions. Once a country realizes they become more vulnerable to becoming a target from an enemy country because their military is occupied by striking against its government, they may want to consider the requests of an unsatisfied military. Also, striking is usually the final resort of fighting when the government or employers will not listen. Striking helps well in safeguarding a worker’s interest. If the military feels that they are being mistreated or that they are unsatisfied and have been complaining to the government and as a result not getting any adjustments, they should have the right to go on strike to be heard vehemently. Politicians at the same time should not have control of the liberties of the military or anyone. (Essential 2) Being able to working is profoundly a right and not a privilege. As working being a right, this means that the right to strike should exist. This also means as a right, the employee should have the right to adjust his or her right in the way that suits them best. Because this contract signifies that this person can lose their position for going on strike that can result to a breakage in numbers. The more military personnel eradicated from their job, the smaller the military and the bigger foreign threats become. Not everyone agreed and supported the cause of the strike. There were workers that did not want to get involved, and there were people bullying the strikers for striking and trying all kind of methods to get the strikers to give up the strike. There were threats, and things said and done as part of the struggle to gain forces on both sides. The use of violent type tactics were being used on a regular basis and people were getting hurt.
Labor’s rights, this issue have been bothering many worker since the 19th century and can still be a problem today. As John L. Lewis has said in his speech “I repeat that labor seeks peace and guarantees its own loyalty, but the voice of labor, insistent upon its rights, should not be annoying to the ears of justice or offensive to the conscience of the American people” (John L. Lewis), which under his words meant that labor is something that can be done right and peacefully but it needs rules and benefits that come with those rules which labor asks for and when labor asks for those rules and benefits it shouldn’t be taken like some annoying kid’s demands but more as something that needs to be done and done with a right mind set. Labor today consists of a man or woman going to work, working their hours, and finally getting paid for those hours at the end of the week, at least a minimum of $7.50 an hour (United States Department of Labor), but before it wasn’t like that before many workers would get paid very poorly even thought they would work for a lot of hours and they wouldn’t get benefits from their work or safety when working such as in the mines like the mine workers, but one man stood up for them and his name was John L. This strike involved the workers of General Motors and they were unhappy with how much they were getting payed in relation to how much profit General Motors was bringing in. They also were concerned with the notion of being fired with no warning and no help after they were layoff with no unemployment insurance. The workers that were still at the plants had no control over about of hours to be worked, or when the lines would speed up. With the workers at high tension they formed the Sit down strike (The 1937 Flint Sit- down Strike). The strike need to be this was for a few reasons, one, all the workers would not leave the building because if they held a normal strike then they would just all be fired and replaced with other people. Another reason was because although there was an early union that started in 1935, the United Automotive Workers (UAW), they are still a new union that did not have respect with he companies to negotiate with them. (Piven & Cloward, 18) Workers protest by striking against their employer, it is easier for employees to protest because they are all located and working together under one roof and are fighting for one thing, and that one thing is related to the workplace. While it is easier for employees to protest, it is not that easy for lower class employees to protest because they have little ability to protect themselves against their institutional managers. When the lower class workers have an informal organizational protest the government is eventually stepping in to disarm the protestors and make efforts to conciliate, “…mobs of unemployed were granted relief in the 1930s…” (Piven & Cloward, 29) The protests cause disruption and sometimes that disruption can make a change but when people are protesting blindly they are more prone to social injustice then making a change.
This type of strike would be similar to something unions would embrace today. Things changes when it seemed the Carnegie Steel was going to try and bring in replacement workers for those on strike. The company was within limits of the law if they brought non-union members in to work. The first official battle occurred on July 6 because it was discovered that 300 Pinkerton detectives were coming ashore from up the river to the Carnegie Mills. The union workers were then going to seize the mills and keep out all people working for Carnegie. They were going to take control of the facility in order to try and persuade management to agree to their terms. The union members were aware of replacements coming in and planned to stop them at all costs. At this point gunfire began from parties on either side; both the strikers and the detectives. It was never clearly recorded who took the first shot, but more union members were in trouble than anyone else. About 11 men died, two from the Pinkertons and 9 from the union. An incredibly large number of men on both sides were also injured from the battle. In the days following the battle, it was discussed between the AA and the company to end the rioting that had begun yet there were no signs of the strike stopping. " While 8 hour day strike movement was generally peaceful, there was some acts of violence that set the labor movement back. The McCormick Harvester Company in Chicago learned ahead of time of a planned strike and so locked out all its employees who held union cards. Because of this fights broke out and police opened fire on the union members killing four of them. A public rally to protest these killings at Haymarket Square drew a large crowd. When a bomb went off, killing seven police officers and wounding fifty more, the police began to fire into the crowd and several more people were killed and about two-hundred wounded.
Factories were known for their ill treatment of their employees, long hours and dirty and unsafe conditions. In 1866, unions started to form to improve working conditions for the workers. A fundamental problem faced by democratic societies is as long as people live their lives individually and go their separate ways and be selfish individuals, they are unlikely to meet collectively to resolve issues. There needs to be meaningful unity among people to alleviate this problem to get people obliged to one another, so there is a willingness to sacrifice for shared goals. Bonding of its citizens creates a democracy. Unions seemed to offer the middle class a chance to become a crucial part of fostering institutions of constitutional democracy. The unions have went through several transitions, but have always worked for the working force. I will discuss the history of the various unions, their wins and losses, and the struggle of the employee to achieve democracy in the workplace.
Teachers’ strikes seem to occur whenever satisfactions are not met in the contract. Whether it happened in recent times or many years ago, salary improvement has always been the number one issue. The American Federation of Teachers (AFT) and the National Education Association (NEA) think that teacher’s salaries are lower than other workers in other private companies, the service, or some of the organizations. Government reduced the budget of the education through cutting down the salaries and dismissing a number of employees.
Labor unions were established as a way for workers’ needs and grievances to be heard by management. According to Fossum (2012), “forming a union creates a collective voice to influence change at work” (p. 7). The collective voice of workers in a union holds much more power than any single employee’s voice. It can loudly draw attention to mistreatment or abuse of workers. The organized collective voice of workers demands to be treated in a fair way by its management in terms of wages, hours, benefits, and working conditions.
They are appropriate in many situations to ensure the demands of the employees are properly addressed and potentially adhered to. Management and unions seek to avoid a strike. With an honest assessment of the internal resources and external forces that affect union strategy, the union should be able to identify concrete accomplishments that are within reach and those matters that would be nice but are probably unachievable (Missouri, 2015). An example is the NFL referees union that organized a strike in 2012. The strike materialized for two primary reasons. First, the referees were seeking benefits that they put at $16.5 million over the five years of a new contract (Mills, 2012). It is difficult to see how anyone could deny that all workers should have the rights to strike. This is because striking gives workers freedom of speech. This is justifiable, because Britain is a democratic nation.
A collective bargaining agreement collectively sets the terms on which an employer offers individual work contracts to each of its employees in the bargaining unit. A bargaining agreement, also herein referred to as a labour agreement, is a legally enforceable written commitment, which states the rights and duties of all parties involved. The labour agreement should be made in good faith and is intended to be observed and not violated. The National Labour Relations Act obligates employers and unions to bargain in good faith concerning terms and conditions of employment, including hours and wages. Like any normal contract, competent parties must enter into a labour agreement. However, a labour agreement is unique from other legal contracts in that there is no consideration involved and nothing tangible is exchanged. Many, but not all, unions require formal ratification of a new labour contract by a majority membership acceptance, which is determined through vote by the members. Until majority approval of those voting in a ratification election is received, the proposed labour contract is not final. While each labour agreement is unique to the needs of an organization and its employees, most agreements include five issues: (1) Management Rights, (2) Union Security, (3) Wages and Benefits, (4) Individual Security (Seniority) Rights, and (5) Dispute Resolution. Management Rights “Management” is the process of working with people and resources to accomplish organizational goals by making the best possible use of money, time, materials and people. The management process, when properly executed, involves a wide variety of activities including planning, organizing, directing and controlling. It is management’s role to perform all of these functions in order to maximize results.
