Juvenile delinquency is a main concern in our criminal justice system today. There are so many kids in our society today that don’t know what it is like to be successful for various of different reasons. Many of these kids are being brought through the system at very young ages. They don’t know what it’s like to finish high school because some of them end up dropping out because they struggle so much. They have no idea what college education is like, which leads them down a path to crime. Many people see these kids as lowlife teenagers who cannot be saved. Their only option is it be put to a juvenile detention facility and be locked up until they are 18. The lack of awareness of disability and the lack of action across the system that addresses disability and impairments of at risk children make difficult situations more complicated. These individuals who need special education need to be taught differently than kids who do not have disabilities. In the past there’ve been many different treatment program that have been tried for juvenile offenders. If you take Special education programs that are being used in schools and create a treatment program based on that, you can have a successful program for these teenagers. A life changing day in March when Sherry West goes out for a walk with her baby without knowing that it was the last time she will ever see her son again. Sherry crossed a deadly path when she encountered Elkins and his accomplice. Elkins pulled out a gun and demanded her purse. Then Sherry refused by saying she didn't have any money and tried to protect her child. Then Elkins threatened her and the baby and counted down from five when he shot Sherry's leg and the baby. He shot right between the baby's eyes. In court, the grieving mother expressed her feelings by stating, "The love of my life was taken away, far away. All I can do is cry and wonder when I'm going to die." She also read a heart breaking statement on the witness stand by explaining how she will never hear his first word or see him walk. Elkins a seventeen year old boy showed no emotion and stood silent when he was sentenced to spend the rest of his life in prison. The punishment that the juvenile received was necessary due to the actions he committed. A punishment should imply for any juvenile who commits a serious crime.
There are numerous critics of the juvenile justice system, and while most of their denunciations remain the same as those of the justice system at large, an ample portion of their criticisms revolve around the claim that incarcerating young people not only doesn’t work in deterring or rehabilitating them, but makes them worse and leads to adult misconduct. A report noted that youth sent to juvenile prison were 37 times more likely to be arrested as adults (Szalavitz, 2009). Another major problem some cite with the juvenile justice system is that most delinquent offends have some form of mental illness, and that while studies have shown that mental health treatment would be a better alternative, they are simply ignored or incarcerated (Ramirez, 2008), completely contradictory to the core values of the juvenile justice system which stresses rehabilitation and restitution above all else.
The dilemma of juvenile incarceration is a problem that thankfully has been declining, but still continues to be an ethical issue. The de-incarceration trend has coincided with a decrease in crime. In the Juvenile Justice system many ways have been explored and researched to determine the best means to prevent delinquency and help children who are juvenile delinquents. Programs have been developed starting in the early years as attempts to solve the juvenile delinquency problems. Houses of refuge were established as places of confinement for juvenile offenders. Later an alternative to houses of refuge, the cottage system, was created. The cottage system provided homes where children were sent to live with families who clothed, fed, provided them with supervision and had them work to teach discipline and responsibility. Later, special a Juvenile Court system was established around the country. Programs such as Upward Bound, Technical Schools (Automotive mechanic) counseling sessions, after school programs and government agencies were developed to find answers to and stop juvenile delinquency. After many years of seeking solutions; nothing is working as it should.
Juvenile delinquency is the participation of illegal behavior by minors. Usually crimes committed by a child under the age of 18. The young people who usually live in difficult circumstances are the ones who are at risk of becoming “delinquents.” Juvenile delinquency is becoming more complicated and universal. In most states juvenile delinquency are criminal acts committed by minors’ ages 10 to 18 years old, the crimes are categorized as status offenders or delinquent offenders. Offenses committed by status offenders can only be committed because the offender is a minor, such as running away from home, truancy and underage drinking. (Mooney, pg 115) then there are delinquent offenders whose offenses would be a crime if they were committed by an adult. Depending on the nature of the crime, minors are tried in a juvenile justice system or can be transferred to the adult justice system. According to the Campaign for Youth Justice, it is estimated 1.7 million youths are in the juvenile justice system with 100,000 cases being heard in juvenile court annually. Juvenile delinquency is committing criminal acts or offenses by a young person, generally involving people under the age of eighteen. That is what this research proposal is about. For my research proposal my research question is what can cause or deter juvenile delinquency in first time offenders? I feel that this is an important question to be asking, because in our society there is too much juvenile delinquency and if we can use this research to figure out what can cause and deter this phenomenon then we could sincerely help a lot of adolescents.
