The Federal Bureaucracy is comprised of nearly every department, committee, and agency that makes up the Federal Government. The function of the bureaucracy is to implement laws and policies, define the rules and regulations of how a law works, and institute examinations, permits and licenses. Congress makes the laws and policies in a broad manner and the bureaucrats flesh out the details and minutia of the intent of that law’s maker. The bureaucrats of the specific department etc. may be appointed officials, civil service employees or other federal employees. According to www.wiki.answers.com, the bureaucracy is part of the executive branch and has powers derived from that. It has no single power, per se, however, since it has various departments, each department has its own mission with various powers allocated to each by policy, convention or law designated and defined by the department function. The overall indication of power is by its duties and responsibilities to develop the laws and institute the requirement of licenses, permits, fees and exams. These “powers” are controlled by Congress and in a small part by the President. The President’s control is with the ability to remove any appointed officials to the bureaucracy. The Federal Register is a daily newspaper which contains Federal Agency Regulations, Proposed Rules and Public Notices, Executive Orders, Proclamations and various Presidential Documents. Its purpose is to inform the American people of their rights and obligations and provide access to Federal benefits and funding. That is a lot of new information to be published daily. This amount of information in this newspaper is overwhelming and much is undecipherable, even for lawyers; which makes it less user-friendly for most citizens. This is the format that the bureaucracy uses to communicate new license and permit requirements, and new regulations. John Stossel suggested that the bureaucracy has to add to this daily otherwise they are not considered as being productive. The Federal Register acts as the platform for introducing new rules and regulations that affect the average U.S. Citizen and it allows citizens to ask questions and comment on these new items. The drawback is the voluminous information to filter through to determine if the items affect the citizen or of interest to him. It appears that the newspaper is used so the Federal Government can declare it is providing the citizens with information of new regulations etc., and allowing the people the opportunity to ask questions and comment before it is finalized; it seems to be an
According to Cornelius Kerwin, "Rulemaking is the single most important function performed by agencies of government Rulemaking refines, and in some instances defines, the mission of every government agency. In so doing it provides direction and content from budgeting, program implementation, procurement, personnel management, dispute resolution, and other important government activities" (Preface XI). This is the foundation for the book, Rulemaking. The whole text primarily revolves around this statement. Throughout the book Kerwin's central theme is that rulemaking is the single most important function that any government agency has within its possession. Much like other admin law books he discusses how those agencies with their rulemaking powers interpret legislation and proceed forward with making policy.
Often, when the discussion of American bureaucracy is broached in conversation, those holding these conversations often think of the many men and women who operate behind the scenes within the government. This same cross section of Americans is looked upon as the real power within the federal government and unlike the other branches of government, has little to no oversight. Lastly, interest groups effect legislature by providing them with voter support, and interest groups effect bureaucracy by lobbying for them and providing them with jobs. In the example of racial profiling of the woman of Jewish and Arab descent, members from interest groups such as, The Economist, questioned both legislature and bureaucracy for the racial profiling against this innocent woman. They questioned members of the bureaucracy, for the flight attendants who started the initial suspicion and the federal agents who jerked her off of her flight and through her in a cell were both part of the bureaucracy. The Economist questioned the legislature for funding such abuse.

Federalism is the powers a country has, divided between the state and federal government. Federalism was not included in the articles of confederation which left the states with all of the power. Federalism was chosen in the United States because the U.S. wanted there to be more control in the National Government. The U.S State government wanted to keep some of the power, so federalism was a good system of government to choose because they got to split the powers between them. Federalism has many benefits in California. Federalism helps California by giving the state power. Each state is going to have a different diversity in which each state can govern. If California wanted to, they could establish a policy of their own. They could see how well the policy went, according to other states that have established them.
Most legislation originates from governmental departments and agencies. In committees, a majority vote decides and often, compromise must be reached in order for a bill or law to survive committee action. This frequently requires that a delegate alter his position in order to achieve a compromise. This compromise may or may not reflect the wishes of the people he/she represents. During this semester in Federal Government, I 've learned more in this class alone than many other years I 've been here. Mrs. Rishi has been a marvolous instructor and I couldn 't ask for more, her teaching style is what exactly fits my person to learn better. Countless key terms and basic knowledge of the American history and development have been jammed into my brain, that way those tests come as essay as they go. 2. Federal Regulation – the expansion of the federal government into almost all aspects of people’s lives
Whereas the six functions of government, as articulated in the Preamble remain the same, the functions have extended to govern issues not a factor during the 18th century. However, the primary function of the government to maintain order has remained unchanged. Demonstrated through various avenues, these functions are open to interpretation. Throughout time, the government continuously adapted itself to provide various services and regulations to the public that it views as beneficial for the public good. Such services have grown to include food standards, consumer protection, health, and education among others. Examples of governmental function expansion since ratification of the constitution can be seen in the Department of Agriculture, the Department of Energy, FEMA, and much more. Through FEMA, the federal government provides disaster relief funding to help communities struck by floods and tornadoes and other natural disasters. When the constitution of the United States was formed, the framers specifically designed the American Government structure to have checks and balances and democracy. To avoid autocracy the President was give power to preside over the executive branch of the government and as commander –in –chief, in which a clause was put into place to give the president the power to appeal any sudden attacks against America, without waiting for a vote from congress. While the president presides over the executive branch there has been ongoing debate over the role of the president in regards to foreign policy. Should foreign policy issues be an executive function by the president or should congress play a much greater role? With the sluggishness of our democracy, foreign policy issues most times need quicker response compared to how domestic policy is decided in the United States. Many believe to maintain openness and democracy both the president and congress need to agree on how the United States handles issue abroad. Although the president has been given much power, his or her power and decisions are sometimes limited based on decisions by congress and challenged and shaped by various bureaucracies throughout the government system. I shall discuss the Presidents role and the role of governmental bureaucracies (Department of Defense, Department of State and the National Security Council) that work together and sometimes not together to shape and implement American foreign Policy.

The current state of federalism in the United States is of one of peril, plagued with recent Supreme Court rulings, current debates over the devolution of Federal powers, and variance in State governing. The United States has always been troubled with the role of the Federal government V. State government on numerous issues. Since around the time of the Great Depression, the federal government was charged with the taking care of the American public in many social and economic matters. Congress was then granted by the Supreme Court almost complete power in passing any sort by legislation by relating it somehow to the Commerce Clause. The Commerce Clause found in Section 8, Article I, United States Constitution, states that Congress may regulate any and all commerce between foreign nations and the states. Congress simply related almost all legislature in some way to intrastate commerce, therefore making the passing of their legislation constitutional. This system was greatly used by Congress for almost sixty years, when, in the late nineteen-eighties and early nineteen-nineties many individuals and special interests groups challenged the constitutionally of these laws passed by Congress using the Commerce Clause. In several cases, such as United States v. Lopez, Congress was dealt a powerful blow and the states seemed to gain an upper hand. In a 5-4 decision, the Court ruled that Congress had exceeded its authority under the Commerce Clause by enacting the Gun-Free School Zones Act of 1990. This, along with many other laws repealed by the Supreme Court, weakened Federal control and gave power back to the states, a grievous mistake in my opinion. This increased the strains on the role of federalism in the United States and once again brought up the question, who has the power to govern what? In addition to this, federalism has taken a frightful turn with the current debates of devolution, or returning power to the states. Many current Congressmen and citizens alike believe that states should have a greater level of sovereignty and that federal power should be weakened so as to strengthen state governments. In contrast, many others believe that the Federal government should be allowed more power. This and other conflicting ideas have lead to a constant strain on the abilities of the government to best carry out its duties.
