As stated by the founding fathers of America “All men are created equal.” Black, white, brown, short, tall, smart, and dumb, all are created equally. Therefore every person deserves fair judgement. Unfortunately, it is a profound fact that not everyone is born normal and capable of task typical for a common person, who is free from disability. In my opinion, the quote “All men are created equal” serves to promote a friendly environment that helps encourage equality among people and aids to recognize the similarities rather than the differences that separates men. Even so, with this hope, the disabled community still struggles for equality. According to Legal Rights by the National Association of the Deaf (NAD), “Almost 10 percent of all American have some kind of hearing loss. These ten percent suffer from unfair treatment from professional, social and government service providers, including court and police” (NAD 1). Obviously, because deaf and hard of hearing have limited hearing, their communication and social skills are below the expectation of a common hearing person. Thus, most of these people are ignored, neglected, and discriminated against. However, as a citizen protected by the American with Disabilities Act (ADA), deaf and hard of hearing individuals deserve equal rights and must be accommodated for as a disabled person. If everyone is entitled to all the rights and freedom that is set forth in the Declaration, disabled people should not be robbed of their rights. However, they are still devalued from conducting common tasks which puts them at the bottom of the priority list as an employee and even so as a friend. Apparently, Amy Rowley a deaf student who was adept at lip reading and received help from her hearing aid was performing above average from her class without special help. However, the court ruled “she was entitled to be able to understand everything said in the classroom, a goal that could be achieved only through sign language”(Greenhouse 2). Even though Amy Rowley in the top half of her class the court recognized that she is still being denied of her rights. Therefore, the court ruled in her favor to accommodate her for education. With the accommodation she will be given an opportunity to achieve her full potential.
The Disability Discrimination Act of 1995 set out to end the discrimination people with disabilities encounter. The Act gave disabled people the right to employment, access to goods, facilities, and services and the right to buy and rent land and property. These rights came into force in December 1996, making treating a disabled person less favorably than an able-bodied person unlawful. Further rights came into force in October 1999, including the idea that service providers should consider making reasonable adjustments to the way they deliver their services so that people with a disability can use them. Just like members of other minorities, such as Hispanics and African-Americans, Deaf people experience some of the same oppression and hardships. Although the attempts to "fix" members of and obliterate the DEAF-WORLD are not as highly publicized as problems with other minorities, they still exist. Throughout time, hearing people have been trying to destroy the DEAF-WORLD with the eugenics movement, the mainstreaming of Deaf children into public hearing schools, and cochlear implants.
The movement continues to make great strides towards the empowerment and self determination ("Disability rights movement," 2005, p. 3). On the other hand, it has not completely broken down barriers that continue to create the dynamics of oppression among such individuals. For instance, WIOA can be harmful to individuals with disabilities because there are still societal prejudices and biases associated with the stereotypical portrayal of people with disabilities and WIOA has played a role in it. For example, WIOA networks with employers to hire individual’s with disabilities and place them in conventional settings, where they work with others who have disabilities, for example, Walgreen’s and in fact, these participating organizations have also increased their pay. In my opinion, individual’s with disabilities should be able to work with individuals who are not disabled, as well. Furthermore, pay for those individuals who are still considered to be in “sheltered” work programs have not received an increase in pay. Additionally, according to my studies, in 2012, less than 30 percent of Florida’s civilians with disabilities between age 18-64 living in the community were employed. There is a greater priority focused on young people who are disabled. The Americans with Disabilities Act (ADA) is one of the most significant laws in American History. Before the ADA was passed, employers were able to deny employment to a disabled worker, simply because he or she was disabled. With no other reason other than the person's physical disability, they were turned away or released from a job. The ADA gives civil rights protections to individuals with disabilities similar to those provided to individuals on the basis of race, color, sex, national origin, age, and religion. The act guarantees equal opportunity for individuals with disabilities in public accommodations, employment, transportation, State and local government services, and telecommunications. The ADA not only opened the door for millions of Americans to get back into the workplace, it paved the road for new facilities in the workplace, new training programs, and created jobs designed for a disabled society (Frierson, 1990). The deaf community does not see their hearing impairment as a disability but as a culture which includes a history of discrimination, racial prejudice, and segregation. According to an online transcript,“Through Deaf Eyes” (Weta and Florentine films/Hott productions Inc., 2007) there are thirty-five million Americans that are hard of hearing. Out of the thirty-five million an estimated 300,000 people are completely deaf. There are ninety percent of deaf people who have hearing parents (Halpern, C., 1996). Also, most deaf parents have hearing children. With this being the exemplification, deaf people communicate on a more intimate and significant level with hearing people all their lives. “Deaf people can be found in every ethnic group, every region, and every economic class” (Weta and Florentine films/Hott productions Inc., 2007). The deaf culture and hard of hearing have plenty of arguments and divisions with living in a hearing world without sound however, that absence will be a starting point of an identity within their culture as well as the hearing culture (Weta and Florentine films/Hott productions Inc., 2007).
Hearing people can have a place in the Deaf community. Each minority group tends to welcome genuine allies and the Deaf community is no exception. But it is important for people who hear to remember our role as allies. We join the community to show our support, not to lead. We can help educate other hearing people, but we are not missionaries to bring Deaf people into the mainstream. Deaf people are the appropriate leaders of their own civil rights movement and teachers of their children. Our role is not to give Deaf people a voice; it is to make sure that the voice already present is heard. And we can do that. We can teach other hearing people to listen.
Provided with the viewpoints on both the medical model and social model of disability, it is clear that these two concepts differ in terms of the definition of disability as well as the attitude of society towards people with disabilities. It is evident that people with disabilities veer towards the social model rather than the medical model. It is essential to acknowledge that Deafness is categorised as a medical disability within the individual as well as a societal disability, as society is not equipped enough to deal with the communication barriers that stem from hearing impairments.
While these three authors have different reasons to write their essays, be it media unfairness, ignorance, or ethical disputes, they all share a basic principle: The disabled are not viewed by the public as “normal people,” and they are unfairly cast away from the public eye. The disabled have the same capacity to love, desire and hurt as any other human being, and deserve all of the rights and privileges that we can offer them. They should be able to enter the same buildings, have representation in the media, and certainly be allowed the right to live.
Since the enactment of Public Law 94-142 (The Education for All Handicapped Children Act) in 1975, approximately one-half of all hearing impaired students in the United States have had the opportunity to be mainstreamed into regular education classrooms.
