Teacher tenure is a commonly argued topic among all secondary schools across the United States. It is thought of as a program that protects teachers’ intellectual freedom or human rights, so that he or she will not be fired after a certain amount of years in a particular school system, without a just case involved. It is a common concern in today’s time because some teachers abuse the loopholes that tenure has to offer and it is seen as a barrier to the well being of the students and society as a whole. This issue is simple to resolve, as the time period of tenure should be longer. Teacher tenure should be under constant revisions and a solution should be proposed in order to solve the problems tenure creates such as, creating complacency among teachers, making it difficult to remove unsatisfactory teachers from the work force, and requiring schools to make long-term spending commitments due to the majority of those who abuse the union laws of tenure in secondary school systems.
Teacher tenure creates complacency among teachers who do not fear losing their jobs. Once a teacher becomes certified after a certain amount of years in a school system, he or she becomes satisfied with the way they teach and act towards their students. Nixon, Packard, and Douvanis stated that some teachers have more of the ability to help care for and see students’ succeed than others might, “as some do not have any incentives to perform better than others” (Philips 2). This point also relates to the fact that “when teachers become tenured most try to only get by with the bare minimum of teaching and do not prepare in depth lessons because they believe tenure gives them a heightened sense of job security” (Philips). In conclusion, studies show that tenure creates complacency among teachers because they become satisfied with the way he or she teaches, makes it difficult to remove unsatisfactory teachers from the work force due to the majority of those who do not fear losing their jobs, and requires schools to make long-term spending commitments because it requires a lot of time and effort to rid of a teacher in a school system. These laws have been implemented throughout the United States for many of centuries; now it is time to do something about them and make a change to better our school systems being affected by these tenure regulations. This proposal of adjusting the probationary period will allow a new path for tenure in the years coming, in order to help students succeed and have enjoyable schooling without the burden of having poor, undesirable teachers.
He also argues that without tenure it would to be easier to fire the 10 percent of teachers that are poor performers. I personally agree with Matthew Miller’s proposal.
It was protect them from losing their jobs, which at first is grand for the low paid teachers, but instead of doing good it causes education become impossible to teach. According to New York Times, a well known newspaper, states that “Firing a bad teacher could take anywhere from two to almost 10 years and cost $50,000 to $450,000 or more” (New York Times). This tener law, makes it a time consuming and money spending process that the schools are not worth taking. In the movie, “Waiting For Superman” , by Davis Guggenheim- a well known director who made many other successful non-fiction films-The film claims “That if only the bottom 1/5 of bad teachers in the US were fired and replaced by only average teachers, our national test scores would reach those of Finland, more than a dozen places higher on international exam scores” (Guggenheim). So we just edited the tenure law then we can rid of the ineffective teachers and replace them, so that the students will receive the tutelage need. In recent news on tenure-article by New York Times- a Los Angeles County Judge Rolf M. Treu began to fix tenure law stating, “the practices are unconstitutional, for teachers can receive lifetime tenor. The process of getting rid of teachers is long process and money spending. The first article that I chose to work with is “The Rubber Room” by Steven Brill. This article is published by The New Yorker on August 31, 2009. Brill is an American Lawyer and a journalist-entrepreneur. “The Rubber Room” is about how it is wasting the city’s money as teachers are placed in this room where all they do is just sit around and play games. They are placed in these as they are waiting for their case to be heard by an arbitrator which could take up to many years. While they are sitting in these rooms, these teachers are still getting paid which is a waste of the city’s tax money. Brill also talks about tenure and how once teachers have tenure they seem to slack off at their job because they know that they have job security as mentioned in the article “she was given tenure after her third year of teaching, and then, like ninety-nine per cent of all teachers before 2002, she received a satisfactory rating each year.” (Brill 2)
Tenure is a type of job security that professors earn once they reach an exact level of expertise. Once a college professor has earned tenure, they need to be able to follow the teaching contract as long as they abide by the rules set forth in their contracts. It's believed that students are able to gain help from the expertise and skill of an untenured teacher. A number of the protections are extended to an irremovable teacher so that they can't be discriminated against their personal views, temperament conflicts, or any space that's not instructional. The statutes for academic tenure in higher education and dismissal vary from state to state, however altogether all are smart in standing and should be offered employment. This therefore will make sure professors won’t be fired for unnecessary issues. Tenure won't shield professors, but will help with those whom are ineffective or incapable.
From the reading “Ethical and Legal Issues in U.S. Education”, there were three points that that surprised me. One point was that it is so surprising to me that there are so many steps that a teacher, on tenure, must go through before they get fired. It makes it so difficult to be fired and such a long process that they will never be fired unless they commit a major crime and I believe that this should change. As a teacher, we need to be at the top of our game at all times, and teachers with tenure seem like they do not always have to in order to keep their job. One of their strongest points just might be when they mentioned how tenure should be replaced with multiyear contracts. “Professors who possess it have no reason to improve their teaching, take on introductory courses, or, in fact, accept any tasks, not to their liking.” (Hacker and Dreifus 181). Tenure is a policy that has been designed to protect teachers from false accusations and various injustices that may take place throughout ones career. For example, one of the rights afforded a tenured teacher is they cannot be discriminated against based on their personal views or belief systems outside of the educational arena. Also, they cannot be terminated without full due process. Tenure will not, however, protect educators who are incapable, ineffective, or are in violation of school board rules (Essex, 2012).

The nine members on the Supreme Court have the power to serve for life, also called Life Tenure. People have been saying that Justices should not be able to serve for life and retire when they want. Justices are serving well into their old age and they should be able to spend time with their family instead of working all the time on cases. Many people question the wisdom of judges in their 70s through 80s. Many elders have difficulties with health problems.
As you can see the school board handles many issues from budgets, to tenure, to performance scores, to conferences. Although this paper did not cover everything in the meeting, it summarized what took place, and what affects it would have on teachers. The decisions made no matter how big or small can influence how and what task a teacher performs. Several studies have shown that schools employing certain practices are linked to higher academic achievement. This paper will demonstrate that teacher competency and the school’s ability to provide an emotionally supportive environment are school characteristics associated with higher student academic success.
