Should NYS repeal the SAFE Act?
The Most opposed piece of legislation in state history.
If you own a firearm in New York State you know about the secure ammunition and firearms enforcement act or SAFE act for short. What you may not know about it though is much more important. What most people don’t realize is that this law is under more opposition than any other law in the state’s history “As of 3/11/2013, we've had 127,715 people sign the petition!” (New York senator Kathleen Marchione). There are many explanations why. What I am here to ask is should assault be legal and unrestricted in the state of New York, and is it legal to restrict them the way that the legislators of the state have?
Problems with legislation.
The SAFE act has considerable problems with the legislation, for instance it is already in the process of amendment because of the way the law was written. According to the New York State Sheriff’s association (NYSSA) this law could potentially make law enforcement officials be committing crimes just by carrying their standard issue sidearm under the new definition of an “assault weapon”.
The amount of ammunition that is allowed by law to be loaded into a firearm criminalize many popular handguns, even those used by the military like the Beretta m9 9mm, which is the standard issue side arm of the United States military that has an ammo capacity of a whopping 15 bullets. 16 bullets if one is locked in the chamber. According to this new law only seven are allowed to be loaded at any given time except when in a competition on a range.

Sandy Hook is an elementary school in Connecticut that was invaded by a shooter, Adam Lanza. Twenty-eight people were shot and killed, twenty of them being children between the ages of five and ten. Before Lanza arrived, he shot and killed his mother who was a teacher at this school. The article was published the day of the shooting to the Washington Post. The article was written announce what had actually happened during this tragic event. The article was directed towards parents with kids and adults to inform everyone on the catastrophe and to hopefully make schools as safe as they could possibly be. Additionally the author also states that this is not the right time to try and discuss the gun control laws.
On the morning of October 3, four people were shot within a span of approximately 2 hours in Aspen Hill, and other nearby areas in Montgomery County. Another was killed that evening in the District of Columbia, just over the border of Silver Spring. In each shooting, the victims were killed by a single bullet fired from some distance. The pattern was not detected until after the shootings occurred on October 3. Fear quickly spread throughout the community as news of the shootings circulated. Forcing someone to take medication or be hospitalized against their will seems contrary to an individual’s right to refuse medical treatment, however, the issue becomes complicated when it involves individuals suffering from a mental illness. What should be done when a person has lost their grasp on reality, or if they are at a risk of harming themselves or others? Would that justify denying individuals the right to refuse treatment and issuing involuntary treatment? Numerous books and articles have been written which debates this issue and presents the recommendations of assorted experts.

Assault weapon control is becoming an unavoidable topic in the United States. According to the Federal Bureau of Investigation more than nine hundred people have died from mass shootings in the past seven years and an assault rifle was used in twelve of the forty-three mass shootings in the past four years. The U.S. Department of Defense has long defined assault rifles as fully automatic rifles used for military purposes. The National Firearm Act of 1934 prohibited fully automatic weapons in the United States. The 1994 Assault Weapon Ban prohibited semi and fully automatic weapons and any weapon with military style characteristics. California Senator, Dianne Feinstein, is leading the charge in the American government to pass a bill that will limit the capacity of ammunition in a magazine and ban assault weapons that are too dangerous for public use. It is time for the American government to act swiftly and acknowledge the dangers assault rifles pose.
As time goes on, the law has put more emphasis on facility just like Bridgewater State Hospital in which many of the actions of the facility workers can face legal consequences such as facing prison time, fines, lawsuits, and etc. Society has a better understanding of why certain people act the way that they do and being more knowledgeable about psychology and mental diseases allows us to have a different approach when dealing with these topics or these individuals. In today’s era, there are many normal individuals who are willing to stand up for those who do not have a voice of their own. The writers of the law lacked understanding of the actual weapon terminology, causing this ban to be too broad and confusing. In the year 2012, Senator Feinstein drafted a new ban for guns. She came up with a new definition of the term “assault weapon” thereby expanding the word beyond what the scope should be. This will ban the use of many more guns. Although my voting patterns have become somewhat more conservative in recent years, I remain in my heart of hearts a 1960s Humphrey Democrat concerned with the plight of those most vulnerable in American society-minorities, the poor, the elderly, and single women-groups whose day-to-day realities are often overlooked in our public policy debates, people whose lives too often go unnoticed by our intellectually timid chattering classes.
