There is a serious issue that has recently been given national media attention. The serious topic sexual harassment and sexual assault was initially given media attention after the #MeToo movement begun within the Hollywood industry. Although the subject of sexual harassment and sexual assault was given attention, there is information dealing with this subject that is not discusses. Information of what exactly is sexual harassment and sexual assault consists of, how it can be dealt with and what consent is.

and bribery, or also known as quid pro quo, which can be better understood as something gained from something given (Kelly 2014, 403). An example in the work place is a supervisor promising a subordinate a raise if the subordinate has sexual relationship with the supervisor. There is also the establishment of a hostile environment which is conformed of uninvited advances, suggestive messages and unwanted sexual attention (Kelly 014, 403). This can be described as a worker making innuendoes in front of a coworker that is uncomfortable. Hostile environments can also consist of aggressive or outrageous acts; these acts are depicted as unwanted embraces, kisses, and fondling (Kelly 2014, 403). A description of this would be a student repeatedly asking out another classmate who has made it clear they are disinterested. The final way an individual can be affected by sexual harassment known as the third party effect. The third party effect is when a third person is affected by sexual relationship between other (Kelly 2014, 403). A way to look at this situation is when professor has a relationship with a student that allows student to have an academic advantage or special consideration. In addition to sexual harassment, there is the issue of sexual assault which included engaging in sexual acts without the other individual’s consent or against that individual’s will, or rape (Kelly 2014, 410).
It is important to understand that there are different types of rape that include different nonconsensual sexual acts. Any penile, finger or object penetration done orally, anally or through vagina that was not consensual is rape (Kelly 2014, 410). There are also different factors such as age that play a part in what is legally considered rape. Statutory rape is term used by the legal system to illustrate the circumstances in which an adult or teenager engages in sexual intercourse with an underage individual (Kelly 2014, 411). Although in the scenario where a person can obtain consent of the other individual it is not rape; if the person the other person is a minor they cannot legally give consent. There is also acquaintance rape, more commonly referred to as date rape, which consist of rape committed by a boyfriend or someone who knows the victim (Kelly 2014, 413). It is a common misconception that rapist is unknown strangers but that is not the actuality. The statistics show that at least 28% of rapes are done by friends, neighbors and coworkers (Kelly 2014, 413). This is a startling statistic in addition to that there is also rape between spouses. These are alarming rates of sexual assault and there need to be certain steps to be taken in order to prevent sexual violence. To first establish preventive measures against sexual assault and sexual harassment is to certain myth that should be addressed.
It is important to recognize the fact that women are not only ones affected by sexual violence and that men are also victims of raped and harassment, too. Secondly, is inform as many individuals of what sexual harassment is that way they can be aware of what is happening when face to face with sexual harassment. If the individual is facing sexual harassment there is five steps that can be taken in order to deal with sexual harassment. Step one is to seek support that way there is someone to lean on (Kelly 2014, 406). Step two know who to report such incident to. Step three be clear about your needs if you feel uncomfortable say so. Step four write a letter to the perpetrator stating the behavior that was unwelcomed, the feelings that were generated and concise message that the behavior needs to stop (Kelly 2014, 406). In addition to learning about sexual harassment and how to deal with it when it occurs, there needs to be a discussion about consent. Consent is the freely given verbal, or nonverbal, communication expressing willingness to engage in sexual activities (Kelly 2014, 408). There is a Ted Talk that aims to spread awareness about locker room talk and consent. consent should be accessible so that people understand (2017). When giving and receiving consent the message should be clear that way there is no misunderstanding later on. In order to reduce sexual harassment and sexual assault there needs to be awareness. It may be a taboo subject or too boring to go over in a meeting but it is necessary so that victims can speak voice their concern. Individuals need to know what sexual harassment, sexual assault and consent are. That way they know what to do when it happens around them or to them.

Sexual harassment is an important issue in every business; if left unattended it could cost companies millions in damages. In 1980 the Supreme Court ruled that sexual harassment was a violation of the Civil Rights Act of 1964. From 1978 to 1980, sexual harassment cases brought against companies cost them $189 million. This number rose to $267 million from 1985-1987. Damages are just measured only by numbers. Sexual harassment can cause harm to a company's image, reputation, customers, as well as their revenue.
The two types of sexual harassment recognized today are known as "quid pro quo" and "hostile environment". According to the EEOC guidelines, quid pro quo exists when "submission to or rejection of (unwelcome sexual) conduct by an individual is used as the basis for employment decisions affecting such individual". Hostile environment exists when unwelcome sexual conduct greatly disturbs an individual and interferes with the individual's job performance. The US Military has been one of the most powerful and respected fighting forces in the world; it is also a hotbed for sexual assault. Each year, thousands of men and women take an oath to serve and protect their country and each thousands of military service members are sexually assaulted. “Earlier this week, Pentagon officials released a new report which estimated more than 70 sexual assaults occur in the military each day.”(Shane III) Fear of retaliation, both personal and professional, and humiliation stop many service members from reporting their sexual assaults. Those few that make the bold choice to report incidents of sexual assault often finds themselves disappointed by the outcome; assaults that do get reported have an incredibly low rate of conviction of the offender. The US Military has proven over time that they are incapable of effectively dealing with the sexual assault problem that it faces.

According to Webster’s online dictionary, it is believed that the phrase “sexual harassment” was coined at Cornell University in 1974 ("Sexual harassment," 2011). The phrase wasn’t, however, really used in common language until the testimony of Anita Hill against Clarence Thomas in 1991. Sexual harassment can take many different shapes and forms. According to a Fox News article, the sexual harassment claims made by men have increased twofold in the last twenty years ("Sexual harassment claims," 2010). Because sexual harassment is illegal both on a federal and state level in many states, there are steps that an individual and employer should take to prevent sexual harassment.
Sexual assault is a problem that affects many students in colleges. Sexual assault is defined as “any unwanted contact” (6) performed on “an unwilling victim, without consent” (2). This means anything from touching to completed rape. Without consent means that “vigorous efforts were made to avoid sexual contact” (2). Physical symptoms of sexual assault can tamper with the victim’s quality of life. It can be pelvic pain, migraines, and even disability that can prevent a victim from working. There are over 32,000 pregnancies a year that are a result of completed rape, but problems with pregnancy can also be a result of sexual assault. In addition to these effects, women who experience this assault are more likely to contract sexually transmitted diseases (2).

When people think about rape, they usually think of a stranger with a knife hiding in the bushes. He waits for a woman to walk by and then attacks. But that is not the only kind of rape. The majority of victims are raped by individuals they know or acquaintances. This rape is known as “acquaintance rape” or “date rape.” Eighty percent of all rapes are, in fact, acquaintance rapes. This kind of rape happens when a man and a woman go out on a date together. The man forces the woman to have sex with him when she does not want to. Also called simple rape, which differs from real rape, because real rape involves weapons, violence and attackers. This kind of rape is recognized as rape in courtrooms, where simple rape is dismissed as not real rape and it is more common that the offender will be found not guilty.
Sexual assault is a term that is used interchangeably with the word rape. The decision on whether or not to use the term rape or sexual assault is made by a state’s jurisdiction. Sexual assault is more readily used in an attempt to be more gender neutral (National Victim Center). Sexual assault can be most easily described as forced or unconsentual sexual intercourse. The individual that is performing these acts on the victim may either be a stranger or an acquaintance. Society’s view of rape is that it only occurs at night to women in dark alleys by men they have never seen or met before. In reality there are two types of rape in which the victim knows the attacker. One of these is known as Acquaintance rape and the other being marital rape. All forms of rape have long term impacts on the victims, for a victim of acquaintance rape they can feel especially shameful if the attacker was a relative or superior at school or work. For victims of marital rape the assaults can be violent including verbal and physical abuse. In marital rape do to the fact the victim is married to their attacker it can lead to displacement, divorce, and codependency.

Workers’ and employers’ organizations are producing model policies and collective agreement clauses, issuing guidance on complying with laws, conducting research and providing training. At the workplace, growing numbers of employers are introducing sexual harassment policies and complaints procedures. Moreover, there appears to be an emerging consensus around what workplace policies should contain and the steps to be taken to implement them, which can be used by those employers who have yet to take action.
