Most Americans are aware of the effects of the Civil War, particularly on the abolition of slavery. But there is a great deal of ignorance on how the War and aftermath of enacting black civil rights shaped our modern government. In his article “To Begin the Nation Anew: Congress, Citizenship, and Civil Rights after the Civil War”, Robert J. Kaczorowski outlines the power struggle that occurred between local and federal government when it came to granting citizen’s rights. Though the battle wasn’t bloody, the war of government had nearly as profound effects as a physical war.
The thirteenth and fourteenth amendments, both which deal with civil rights, and the Civil Rights Act, which was made in 1866, have sparked considerable debate since their founding. As Kaczorowski states in his article, the federal government gained a considerable edge over local and state governments with its ability to legislate human rights. By adhering to their state law, or creating a state law opposing the national law, they are committing a crime. Regardless, state law was usurped by Federal law and Kaczorowski states that the framers of the civil policies had intentions to punish judges and officials through the same manner as civilians. Like the last paragraph discusses, if The United States guaranteed Civil Rights, instead of handing the rights to the states to pass down, the central government was responsible for the adherence in punishing any dissenters of the law. In the book, Apostles of Disunion, author Charles B. Dew opens the first chapter with a question the Immigration and Naturalization service has on an exam they administer to prospective new American citizens: “The Civil War was fought over what important issue”(4). Dew respond by noting that “according to the INS, you are correct if you offer either of the following answers: ‘slavery or states’ rights’” (4). Although this book provides more evidence and documentation that slavery was the cause of the Civil War, there are a few places where states’ rights are specifically noted. In presenting the findings of his extensive research, Dew provides compelling documentation that would allow the reader to conclude that slavery was indeed the cause for both secession and the Civil War.
In Joel L. Swerdlow’s 2001 essay, “Changing America,” he writes about the current cultural differences among kids in high school. He goes on to talk about how you can gather a large variety of kids, coming from all over the world, yet they still somehow manage to develop the same “American Teenager” attitude toward life. The essay talks about how people used to view America as a “melting pot” of nations, and how over time that view is starting to change.
In “The Closing of the American Book,” published in the New York Times Magazine, Andrew Solomon argues about how the decline of literary reading is a crisis in national health, politics, and education. Solomon relates the decline of reading with the rise of electronic media. He believes that watching television and sitting in front of a computer or a video screen instead of reading can cause the human brain to turn off, and lead to loneliness and depression. He also argues that with the decrease of reading rates, there will no longer be weapons against “absolutism” and “terrorism,” leading to the United States political failure in these battles. The last point Solomon makes is that there is no purpose behind America being one of the most literate societies in history if people eradicate this literacy, and so he encourages everyone to help the society by increasing reading rates and making it a “mainstay of community.” Solomon tries to show the importance of reading in brain development and he encourages people to read more by emphasizing the crisis and dangers behind the declination of reading.
Schenek v. United States was a trial in 1919 that reaffirmed the conviction of a man for circulating antidraft leaflets among members of the armed forces. This trial upheld the Espionage and Sedition Acts, which by many deemed unconstitutional. The Espionage Act of 1917 was a United States federal law, which made it a crime for a person to convey information with intent to interfere with the operation or success of the armed forces of the United States or to promote the success of its enemies. The Sedition Act forbade Americans to use "disloyal, profane, scurrilous, or abusive language" about the United States government, flag, or armed forces during war. The act also allowed the Postmaster General to deny mail delivery to dissenters of government policy during wartime. These two laws denied the freedom of speech that our sacred Bill of Rights was supposed to uphold. The antidraft flyers that Schenek passed out claimed to be freedom of speech so the government could not stop the circulation of Schenek’s pamphlets. However, by passing out antidraft laws, Schenek had “the intent to interfere with the operation of success of the armed forces of the United States.” By doing this, he broke the law. He was sentenced to six months in prison for breaking an unconstitutional law. The government was trying to reduce the freedom of speech during a time of war so that the nation would be united as one. The opposition of some feared Woodrow Wilson and his cabinet so they took action by reducing some freedoms and imprisoning many people unconstitutionally.
David W. Blight's book Beyond the Battlefield: Race, Memory and the American Civil War, is an intriguing look back into the Civil War era which is very heavily studied but misunderstood according to Blight. Blight focuses on how memory shapes history Blight feels, while the Civil War accomplished it goal of abolishing slavery, it fell short of its ultimate potential to pave the way for equality. Blight attempts to prove that the Civil War does little to bring equality to blacks. This book is a composite of twelve essays which are spilt into three parts. The Preludes describe blacks during the era before the Civil War and their struggle to over come slavery and describes the causes, course and consequences of the war. Problems in Civil War memory describes black history and deals with how during and after the war Americans seemed to forget the true meaning of the war which was race. And the postludes describes some for the leaders of black society and how they are attempting to keep the memory and the real meaning of the Civil War alive and explains the purpose of studying historical memory.
The tone of the short story “America and I” changed dramatically over the course of the narrative. The author, Anzia Yezierska, started the story with a hopeful and anxious tone. She was so enthusiastic about arriving in America and finding her dream. Yezierska felt her “heart and soul pregnant with the unlived lives of generations clamouring for expression.” Her dream was to be free from the monotonous work for living that she experienced back in her homeland. In 1866, the Civil Rights Bill was proposed in Congress. At the time, it was referred to as, “one of the most important bills ever presented to the House for its action.” (Foner 603). The Civil Rights Bill stated that each person born in the USA would be a citizen. It also proposed equality in the eyes of the law and would prohibit individual states from formulating legislature similar to the Black Codes. The ratification of the Civil Rights Bill would make it virtually illegal to discriminate against any person based on their race. In essence, the bill would enhance upon the Thirteenth Amendment that only abolished slavery; it did not make the African Americans equal to whites in the eyes of the law. In response to the bill, Johnson vetoed the Civil Rights Bill. He claimed that blacks should not be citizens and that Congress was trying to infringe on the States’ rights with the bill. Johnson strongly opposed large aspects of the Reconstruction due to his stubbornness and bigoted tendencies. America has gone through many hardships and struggles since coming together as a nation involving war and changes in the political system. Many highly regarded leaders in America have come bestowing their own ideas and foundation to provide a better life for “Americans”, but no other war or political change is more infamous than the civil war and reconstruction. Reconstruction started in 1865 and ended in 1877 and still to date one of the most debated issues in American history on whether reconstruction was a failure or success as well as a contest over the memory, meaning, and ending of the war. According to, “Major Problems in American History” David W. Blight of Yale University and Steven Hahn of the University of Pennsylvania take different stances on the meaning of reconstruction, and what caused its demise. David W. Blight argues that reconstruction was a conflict between two solely significant, but incompatible objectives that “vied” for attention both reconciliation and emancipation. On the other hand Steven Hahn argues that former slaves and confederates were willing and prepared to fight for what they believed in “reflecting a long tradition of southern violence that had previously undergirded slavery” Hahn also believes that reconstruction ended when the North grew tired of the 16 year freedom conflict. Although many people are unsure, Hahn’s arguments presents a more favorable appeal from support from his argument oppose to Blight. The inevitable end of reconstruction was the North pulling federal troops from the south allowing white rule to reign again and proving time travel exist as freed Africans in the south again had their civil, political, and economical position oppressed.
Bruce Catton made the statement that when the two sides of the nation went to war they destroyed one America, inventing another, which is still forming in the present. The war changed the political aspect of the country expanding the federal government. While local state governments still exist in the present, its power had, is much more restricted than what it was in the pre-war years. The Civil War in America is known to this day for being the pivotal turning point for slavery. But all the events in American politics that took place in the years prior to the war are just as crucial. Slavery was the solid foundation to America’s Political history because tremendous impact that the compromise of 1850, abolitionist/proslavery incidents, and the election of 1860 had. It is interesting to think about how different America would’ve been were it not for these exciting times in history. How much longer would America have been divided over the battle involving slavery? The American Civil War was the bloodiest military conflict in American history leaving over 500 thousand dead and over 300 thousand wounded (Roark 543-543). One might ask, what caused such internal tension within the most powerful nation in the world? During the nineteenth century, America was an infant nation, but toppling the entire world with its social, political, and economic innovations. In addition, immigrants were migrating from their native land to live the American dream (Roark 405-407). Meanwhile, hundreds of thousand African slaves were being traded in the domestic slave trade throughout the American south. Separated from their family, living in inhumane conditions, and working countless hours for days straight, the issue of slavery was the core of the Civil War (Roark 493-494). The North’s growing dissent for slavery and the South’s dependence on slavery is the reason why the Civil War was an inevitable conflict. The Civil Rights Act of 1964 forbid businesses connected with interstate commerce to discriminate when choosing its employees. If these businesses did not conform to the act, they would lose funds that were granted to them from the government.
