Retributive justice is a type of justice, which believes a punishment should be both rightful and proportionate to the immoral act. This type of retribution is similar to that of the concept “what goes around, comes around” and is prominent is various unethical acts such as an individual committing the act murder and then going to prison. Khaled Hosseini’s The Kite Runner and William Shakespeare’s King Lear are perfect examples of literature that integrate retributive justice into the plot. Both literary works have characters that make similar decisions and therefore go through similar experiences: they make poor decisions, ignore their conscience, and seek personal justice.
The role of retributive justice is evident within both The Kite Runner and King Lear and becomes clear through the outcomes of Baba and Lear’s poor decision-making. At the beginning of the novel, Amir characterizes his father as an honest, wealthy man with strong moral values; in fact, Baba spends a lot of time trying to impose his goodness onto Amir. An important turning point of the story for Amir is when Rahim Khan shares a horrifying truth; Baba is a sinner and goes against his beliefs by lying about Hassan’s birth. At first, the reader assumes that Baba keeps Hassan’s birth a secret so he is not frowned upon for having an affair with Ali’s wife. Although Baba tries to make up for his poor decision, he still experiences retributive justice by losing Hassan and Ali: “Then I saw Baba do something I had never seen him do before: He cried… I’ll never forget the way Baba said that, the pain in his plea, the fear.” (Hosseini 107). As the play progresses, Edmund eventually desires kingship and is willing to do anything to gain power, which includes using both sisters: “To both these sisters have I sworn my love;/ each as jealous of the other, as the stung/ Are of the adder. Which of them shall I take? / Both? One? Or neither? / Neither can be enjoyed/ If both remain alive.” (V. i. 56-59) Immediately the audience can sense that Edmund is slowly being consumed by his ambition and the chain of events that he causes through the play is to blame for his eventual death. Once again, it is unusual for death to be a form of retributive justice; however, Edmund brings death upon himself. His traitorous acts towards several of the characters- specifically Edgar- backfires, and for that he dies.
Redemption is gaining honor and self-forgiveness through a selfless act that reflects off of one’s regretful actions of their past. In the novel, The Kite Runner, Amir is the main character who goes through many life struggles and mistakes, then finds himself on a road to redemption. Amir and Hassan were best friends throughout their childhood and Hassan was the honorable, trusting best friend, the one to always take a stand for what he believed was right. Amir’s lack of courage caused him to stay silent in the worst of times, letting Hassan get tortured for the things he did not deserve. The themes of sacrifice, honor and redemption are carried out in many ways throughout this novel being shown through the actions of Hassan, Baba, and Amir.
To atone for his past sins, he embarks on a journey back to Afghanistan to redeem himself to Hassan for not treating him the way he was treated. He redeems himself by saving Sohrab and giving him a safer and enjoyable life in the Untied States. Amir tyres to attain redemption to baba for being the cause of his mother’s death as he believes. Gaining his fathers love and care will make him feel redeemed from all of the resentment and lack of care that his father shows to him. He must prove to Baba that he is worthy of spending time with everyday because he feels the hatred that his father shows to him. One way how he gets redemption from his father is by winning the kite running tournament to prove to him that he is worthy of being his son. Amir’s path of redemption is not only directed to other people but personal redemption for himself. He attempts to redeem himself by building an orphanage with his wife Soraya and giving Sohrab the childhood that is safer and more suitable for a young boy to grow up in. Amir has to realize that the past doesn’t define who someone is although you can’t forget the past, the actions that they decide to do to redeem themselves from the past mistakes defines who someone is. Over the course of the novel, Baba implies that he is not proud of Amir and the only reason he knows Amir is his son, is because he witnessed Amir 's birth. He states to Rahim Khan that he thinks Amir needs to stand up for himself more often. Countless times during the novel, Amir feels like he has to fight for his affection, that he has to earn Baba’s love. In order to prove himself worthy of affection and to redeem himself for not being a son Baba could be proud of, Amir yearns to win the kite runner competition. He reminisces on a memory, when all “I saw was the blue kite. All I smelled was victory. Salvation. Redemption” (65). In the aftermath of Hassan’s rape, Amir got rid of Hassan so he would not have to face the cause of his guilt on a daily basis. Amir buries the secret of the rape deep within him, where he hopes that it will not come back to haunt him, which is not the case. “We had both sinned and betrayed. But Baba had found a way to create good out of his remorse. What had I done, other than take my guilt out on the very same people I had betrayed, and then try to forget it all? To begin, the first instance of redemption is found and portrayed through irony. As Amir's mother died giving birth to him, he has always felt guilty. Leading up to the annual kite-fighting tournament, Amir feels as if winning will redeem her death, and solidify his relationship with Baba. When he comes upon Hassan who is cornered by Assef, Amir feels as if his rape might be justified: “Maybe Hassan was the price I had to pay, the lamb I had to slay to win Baba. “It's wrong what they say about the past, I've learned, about how you can bury it. Because the past claws its way out” (Hosseini). In The Kite Runner, Hosseini shares Amir’s journey to atonement. As Amir states, he was unable to bury his past, similar to his father, Baba, who spent the majority of his life haunted by his sins. While both father and son are consumed by guilt, the way in which they atone for their iniquities is dissimilar. While Baba attempts to live his life according to the Afghan saying, “ Life goes on, unmindful of beginning, end...crisis or catharsis, moving forward like a slow, dusty caravan of kochis [nomads]” (Hosseini 356), Amir strays from this traditional perspective. Baba chose to continue his life unmindful of his past, while Amir, eventually decides to confront his. Although both Baba and Amir have acted immorally, the choices they make find redemption affect the success of their individual attempts. In the novel, Amir’s quest for atonement is more effective than Baba’s because he acts virtuously, while his father, acts selfishly. Ultimately, Amir is the more successful of the two because, in opposition to Baba, he seeks holistic atonement and is willing to make sacrifices to achieve redemption.
Guilt is a strong emotion that affects many people around the world. It can either lead people into a deep and dark abyss that can slowly deteriorate people or it can inspire them to achieve redemption. Guilt and redemption are two interrelated subjects that can show the development of the character throughout a novel. The Scarlet Letter, by Nathaniel Hawthorne, and The Kite Runner, by Khaled Hosseini, are two literary works that convey the connections between guilt and redemption and show the development of the character by using theme and symbolism that are present in the novels.
Utilitarianism was long thought to violate the Principle of Retributive Justice, the concept of being punished for crimes committed. Under closer examination, it is revealed that Utilitarianism and Retributive Justice do not clash. According to Mill, the concept of justice is actually derived from utility. When an individual's moral rights are violated, it is a natural tendency to want to retaliate against the violator. The retaliation ensures that such an act would not happen again. By protecting individuals from the violation of rights, punishment contributes to an overall increase of utility in society. In Utilitarianism, Mill writes that "a person may possibly not need the benefits of others, but he always needs that they should not do him hurt" (Mill 89). This protection allows individuals to follow their own pursuits more effectively, without fear, and ultimately with more utility. At the same time, Mill also argues that certain cases exist where an individual has a moral duty to do an action that would be considered unjust under normal circumstances; however, due to the action drastically increasing utility, the action is allowed to be done and does not violate the Principle of Retributive Justice. An act that would be considered "wrong" in a normal situation can be "right" in other situations. One such example is the case of Robin Hood. Robin Hood is a fictional character who steals material goods and money from very rich individuals and redistributes those items to the very poor. He is not punished for his crimes, and is hailed as a hero for his deeds. Edmund’s discontent with the notion of bastardy is brought up furthermore in his soliloquy at the beginning of scene two: “Thou, nature, art my goddess. To thy law/ My services are bound. Wherefore should I/ Stand in the plague of custom…” (II.1-3). The notion of bastardy in Lear pushes Edmund to place his faith in his born traits as opposed to the system that has labeled him an outsider his whole life. He believes he is equal to his brother in every way—his mind and shape as true—and the only reason he is not aloud to prosper is because of a preconceived idea of the ideal child. Inevitably, Edmund wants to rebel against the system that has stifled him for so long. Gloucester is primarily responsible for Edmund’s actions because he in no way raised him equal to Edgar. Edmund’s goal to usurp his brother and earn the power he believes he deserves is due to the notion of bastardy in the play; Edmund questions “why brand they us with ‘base, base bastardy’” in his first soliloquy (II.10) . After all, even Kent attested to his fine demeanour. This paper considers the desert arguments raised to support retributivism, or retribution. Retributivism is "the application of the Principle of Desert to the special case of criminal punishment." Russ Shafer-Landau and James Rachels offer very different perspectives on moral desert which ground their differing views on the appropriate response to wrongdoing. In "The Failure of Retributivism," Shafer-Landau contends that retributivism fails to function as a comprehensive theoretical foundation for the legal use of punishment. In contrast, in his article "Punishment and Desert," Rachels uses the four principles of guilt, equal treatment, proportionality and excuses to illustrate the superiority of retribution as the basis for the justice system over two alternatives: deterrence and rehabilitation. Their philosophical treatment of the term leads to divergence on the justification of legal punishment. Ultimately, Rachels offers a more compelling view of desert than Shafer-Landau and, subsequently, better justifies his endorsement of a retributive justice system.
Another way that some argue against pure restitution is to say that is does not have an acceptable implication that punishment does have. Pure restitution lacks implications that are backed with punishment. Additionally, it is argued that pure restitution has an unacceptable implication that punishment also shares. Some say that pure restitution is too individualistic. It is also argued that some harm is beyond repair, and restitution will not solve or make these issues better, and the theory of pure restitution allows us to do nothing at all to the offender. As bastard son of Gloucester, Edmund wanted to receive all of the power destined for his brother, Edgar, who was Gloucester’s legitimate son.
