Becoming a well established officer is a job, and at times a difficult one. Law enforcement officers do not take their jobs lightly when it comes down to risking their life. Police officers are not super humans, they often endure extreme stress and harm when doing their job. It is not only their duty to protect the citizens of this state, but to also display appropriate action at all time. When analyzing the video called, “Cop Punches First Against Man Resisting Arrest,” it is evident that the suspect had a clear advantage on the officer in regards to his weight and height. Under these specific circumstances, I do believe that this force option was objectively reasonable. The following reasons are why I believe that the officer’s actions were reasonable. 1) The officer first used verbal commands, as stated by the news anchor, and when matters escalated the officer assessed the situation and changed his use of force to a more aggressive form. 2) The suspect was throwing punches back at the officer resulting in a public altercation that was categorized as violent. The officer had to keep the suspect focused, otherwise the man could have fled the scene. 3) The suspect had originally been stopped because he was carrying a deadly weapon. Therefore, the officer was not required to take this matter lightly due to the fact that the suspect was armed and dangerous. A crucial duty of being an officer is being able to assess each situation as it comes and reasonably transition degrees of force when necessary. Given the fact that no police department policy can realistically predict every situation an officer will encounter, the officer must use an objectively reasonable force that he believes suits the circumstance. Happening in today’s society, there have been countless number of citizens being killed by law enforcement. Some situations may not cause for force and others may. This case can be a reference in regards to making sure that the force you use is appropriate for the situation. As for the justice system, it is all about being fair and listening to both sides and issuing out the right punishment if there is any. However, if the officer is in immediate threat, he has the right to use deadly force to protect themselves from being the victim. “The Court held that the use of deadly force is subject to the Fourth Amendment's reasonableness requirement, and that the Tennessee statute was unconstitutional in so far as it authorized the use of deadly force to prevent the escape of all felony suspects, whatever the circumstances” (Gross,2016). Nonetheless, it also depends on the seriousness of the crime as to how excessive the force may be to control the civilian actively resisting apprehension. Police brutality is becoming more and more apparent in the news today because it seems to be occurring more than before. In 2012, the NYPD killed 21 people that year which was an increase by 7 from the previous year (W.A.T.E.R, 1). The numbers are rising in the big cities where more crimes are likely to happen. Toronto isn’t as big as New York City, but it comes to show that police officers are killing more individuals each year. In 2009, in the little city of Cabbagetown near Toronto, two Toronto officers severely beat a man who was allegedly drunk in public. The two police officers were later found guilty of assault causing bodily harm, which shocked much of the public because rarely do police officers get charged after incidents like this. This case ended up bringing up the ethical issue of whether police officers use excessive force on people because they are law enforcements. Police officers seem to usually get away with the actions they do, which sometimes result in death, because they are law enforcements and they’re just looking out for their own safety and of others. I believe that police officers do sometimes use excessive force on people and that they get away with the consequences because they have a free pass because of their job title. To defend this judgment, the arguments that I will use are the statements of both police officers, the test results that proved that the police officers attacked a man who didn’t deserve it, and the decision of the SIU.
Law enforcement officers are in constant dangerous situations while out doing their responsibilities. When in these threatening situations, police officers typically have little to no time to determine the right precaution. These precautions may lead to the death of a suspect or even the officer themselves. The media has recently shed light on police brutality with use of force. Use of force could be defined as the amount of effort an officer must use in order to make an unwilling subject compel. Police officers are usually trained to enable the proper responsible to a dangerous situation they may be put in. In this paper I will go through the guidelines that a police officer must obey when considering a certain degree of use of force. Within each guideline there will be the pro and cons with that situation and also a recent case that happened. This paper will also talk about how this topic can be addressed more properly. These guidelines that officer are taught during their training are called Use of Force Continuum.
One exception to the warrant requirement of the Fourth Amendment is a search incident to a lawful arrest. A search incident to lawful arrest requires a valid arrest as a foundation for conducting a search following an arrest (Ingram, 2009). In this particular type of arrest, a police officer will first begin the process by obtaining full control over an individual. Once the officer obtains full control over the individual he or she will then determine where, when, and how the person will either move from or stay in a particular area (Ingram, 2009). The next move is for the officer, after detaining the individual in question, is to then search the individual to find incriminating evidence. It is important to note that this type of search is actually permitted under the law.

Citizen’s opinion of law enforcement has often been linked to the media’s tactics of displaying officers using what appears to be excessive force during an arrest. This typically leads to citizens becoming outraged and creates an issue for the force. The question then arises as to what exactly is excessive force? While many citizens may characterize force as excessive, the law reflects the realities that officer’s face in making decisions to use force (Petrowski, 2005). The police forces in every community are deemed law enforcement officers and have to take necessary precautions in executing their job. Individuals that police officers encounter may at any time threaten the security of the officer or others. Police officers have to follow procedures that are necessary to maintain control of situations that can cause harm to others or property. The three topics that will be discussed in police use of force are; the explanation and background of use of force, limitations of use of force, and disputed court cases dealing with police use of force.
Was the intrusion based on a lawful objective, such as a valid arrest, detention, search, frisk, community warden guardian of mentally ill, defense of an officer or a citizen, or to prevent escape? If these answer yes then an officer may have legal ability to use the levels of force listed below to apprehend the suspect. Another list of things to consider when determining if it was a lawful use of force is; was the use of force relative to the person’s confrontation? Was there a crucial need to terminate the condition? Even though there is no duty to retreat, could the officer have used lesser force and still safely accomplish the lawful objective? These are the questions that the jury need to answer to determine if they should side with or against the officer in any court case brought to them that deals with such a controversial topic as this.
As a result, “Nearly all agree that when an officer is facing a deadly threat, the proper response is to use deadly force”(Lind). Yes there are many people out there that can be a deadly threat to police officers because the way they are acting but, there are many innocent people that do not affect anyone and still have to be a part of the problem for no given reason. Although a police officer’s proper response is to use deadly force upon someone, there should be other alternatives or ways they can use before going into deadly force and possibly cause someone to lose their live. I certainly do understand that there are certain situations where a cop is coming across someone that is pointing a gun or knife at them and approaching towards them. So therefore them using deadly force would possibly be the right thing to do if they have too, but before using deadly force they should at least try deploying tasers or using bean bag guns to attempt in taking them

The use of Deadly Force by Police Officers has increased throughout Country, this has cause public outrage as people have demanded that there be changes in the Police Departments throughout the United States. Many citizens do not know that goes on thought the mind of a Police Officer, they are risking their own lives to protect the citizens around them. In order for a Police Officer to use Deadly Force there are many factors that are required in order for the Officer to engage in deadly force.
Police use discretion through weighing the costs and benefits of each situation (Wilson, 1968). The helpfulness of their choice is much more important than obeying their duty or moral. Thus, when normal force is explained it is done under the pretense of justifiably. To recap, normal force is simply the force used under police discretion that is neither legally taught nor brutal (Hunt, 1985). Normal force is justified by taking responsibility for their actions, yet denying they were wrong because of situational or abstract events. At other times officers use excuses for normal force and recognize their use of force as inappropriate. They will recall emotional or psychological states as a reason for such inappropriate actions.
