Juvenile Corrections In the United States, the juvenile correction system was established to have the best intentions to help juvenile delinquents change their delinquent behavior by using rehabilitation and punishment. The use of rehabilitation allows the juvenile correction system to treat the needs of an individual juvenile delinquent with a variety of services and programs to help the juvenile delinquent change his or her behavior. Whereas the use of punishment allows the juvenile delinquent to be discouraged from committing criminal activity, both do hold the juvenile delinquent accountable for his or her actions. This paper will also discuss to what extent should the public opinion determine sentencing policies. Rehabilitation Vs. Although rehabilitation and punishment’s purposes are different, they are similar in the role they play in the juvenile justice system. Throughout the years, it has been shown that using rehabilitation has reduced rates of recidivism, so if education and training were not offered in facilities than rates would not reduce (MacKenzie). Rehabilitation and punishment have become more combined into facilities throughout the years. Therefore, facilities should combine rehabilitation and punishment because both work well together to change criminal behavior and punish. The adult system’s shifts leaked into the juvenile system, causing an increase in incarcerations even when delinquency rates were declining at the time. Juvenile reform legislations prompted more compulsory sentencing and more determinate sentences for juveniles, lowering of the upper age of juvenile jurisdiction, considerable ease in obtaining waivers to adult court for juvenile prosecution, and made it easier to gain access to juvenile records as well. Furthermore, it led to greater preoccupation with chronic, violent offenders, which in turn led to a redirection of resources for their confinement. Thereby, the absence of reliable criteria for identifying such offenders tends to stereotype all delinquents and is more likely to raise the level of precautionary confinements. Juvenile delinquency is a relatively new phenomenon. For this reason, society’s reactions and solutions to the problem of delinquency are also modern developments. The United States developed the first youth court in 1899 and is now home to many new and formerly untested methods of juvenile rehabilitation and correction. One of many unique programs within the Juvenile Justice system, boot camps are institutions designed to keep delinquent juveniles out of traditional incarceration facilities and still provide a structured method of punishment and rehabilitation. Boot camps developed in the early 1990s and quickly proliferated throughout the nation. Specifically, they are “…short-term residential programs modeled after military basic training facilities” (Meade & Steiner, 2010). Designed with the goal of reducing recidivism and preventing violent offenses, boot camps target non-violent individuals under the age of 18 and typically exclude already violent offenders. In theory, boot camps apprehend juveniles while they are committing minor delinquency and prevent more-serious crime by “giving the juvenile offender a more optimistic, community oriented outlook” (Ravenell, 2002). Fundamentally, boot camps have four central purposes; rehabilitation, punishment, deterrence, and cost control (Muscar, 2008).
A growing number of probation officers, judges, prosecutors as well as other juvenile professionals are advocating for a juvenile justice system which is greatly based on restorative justice. These groups of people have been frustrated by the policy uncertainty between retribution and treatment as well as unrealistic and unclear public expectations. As a primary mission, the balanced approach or policy allows juvenile justice systems together with its agencies to improve in their capacity of protecting the community and ensuring accountability of the system and the offenders . Therefore, this paper considers how restorative justice reduces referrals of juveniles to criminal and juvenile justice systems and gives a proposal on the implementation of restorative justice in the community together with a number of recommendations. For instance, preliminary research reveals that application of restorative justice in schools significantly reduces school expulsions, suspensions, and referrals to the criminal justice systems. Restorative justice programs are an alternative for zero-tolerance policies for juveniles or youths .
The inappropriate or unnecessary use of incarceration is “expensive, ineffective, and inhumane,” and initiates a “cycle of juvenile reoffending” (Bala et. al, 2009). A study conducted by Mann (2014) exemplifies this cycle of youth reoffending. The youth interviewed demonstrated that despite a stay in sentenced custody, the threat of future punishment was not enough to deter from future offences. Cook and Roesch (2012) demonstrate that youth have developmental limitations that can impair their involvement in the justice system; for example, not understanding their sentencing options properly or their competence to stand trial. Therefore, deterrence as a justification for youth incarceration is ineffective, as incarceration proves to be not a strong enough deterrent. Studies and anecdotes have shown that our modern approach, however, is ill-equipped to reduce crime or deal with chronic delinquents while at the same time protecting their due liberties. We now stand on the precipice of decision: How can we strike an appropriate balance in the juvenile justice system? Should we even retain a separate system for children at all? The adjustment from incarceration to society causes a series of problems, making rehabilitation difficult. During one of our class sessions we discussed the different areas within the criminal justice system. The topic of courts and sentencing specifically of juveniles was mentioned. As we get to know the inside students we learn some of their backstory of how they ended up at Joseph Harp Correctional Facility, many of them had their first contact with the criminal justice system as a juvenile. Several of the inside students expressed animosity toward the courts when it came to sentencing of juveniles. They thought that some of the ways juveniles are sentenced is too harsh.
"Too many Americans go to too many prisons for far too long, and for no good law-enforcement reason … Although incarceration has a role to play in our justice system, widespread incarceration at the federal, state and local levels is both ineffective and unsustainable. . . We need to ensure that incarceration is used to punish, deter and rehabilitate – not merely to convict, warehouse and forget"(Holder). Former Attorney General Eric Holder does not dispute that prisons play an important role in the justice system. He believes that along with punishing the inmate’s prisons should provide them with rehabilitation. With the already overpopulated prison system across the US there should be alternative for lesser nonviolent offences.
This paper will discuss the history of the juvenile justice system and how it has come to be what it is today. When a juvenile offender commits a crime and is sentenced to jail or reform school, the offender goes to a separate jail or reforming place than an adult. It hasn’t always been this way. Until the early 1800’s juveniles were tried just like everyone else. Today, that is not the case. This paper will explain the reforms that have taken place within the criminal justice system that developed the juvenile justice system.
In 1899, the nation’s first juvenile court for youth under the age of 16 was established in Chicago to provide rehabilitation rather than punishment. By 1925, following the Chicago model, all but two states had juvenile courts whose goals were to turn youth into productive citizens utilizing treatment that included warnings, probation, and training school confinement(Cox et al. 2014, p.2). Treatment lasted until the child was “cured” or turned 21. Although judges spoke with the offending children and decided upon the punishment, the lack of established rules and poor rehabilitation led to unfair treatment. In 1967 “ U.S. Supreme Court case of In re Gault held that juveniles were entitled to the same constitutional due process rights as adults, beginning a national reform in juvenile justice and the system was repaired to afford children many of the same rights that adults have in court” (Cox et al. 2014, p.4). Also, state legislatures passed laws to crack down on juvenile crime, as recently, states have attempted strike a balance in their approach to juvenile justice systems as research suggests that locking youth away in large, secure juvenile facilities is ineffective treatment towards different genders in which it doesn’t provide appropriate rehabilitation.
The goals of juvenile corrections are too deter, rehabilitate and reintegrate, prevent, punish and reattribute, as well as isolate and control youth offenders and offenses. Each different goal comes with its own challenges. The goal of deterrence has its limits; because rules and former sanctions, as well anti-criminal modeling and reinforcement are met with young rebellious minds. Introduction: Recidivism or, habitual relapses into crime, has time and time again proven to be an issue among delinquents, which thereby increases the overall juvenile prison population. This issue has become more prevalent than what we realize. Unless a unit for measuring a juvenile’s risk of recidivism is enacted and used to determine a system to promote effective prevention, than the juvenile prison population will continue to increase. Our court system should not only focus on punishing the said juvenile but also enforce a program or policy that will allow for prevention of recidivism. So the question remains, how can recidivism in the juvenile prison population be prevented so that it is no longer the central cause for increased juvenile delinquency? Simply put, we must create a means of measuring juvenile’s level of risk and in turn, form an effective rehabilitation program that will decrease their risk level for future recidivism.

Juvenile delinquency is one of the major social issues in the United States today. Juvenile delinquency, also known as juvenile offending, is when “a violation of the law committed by a juvenile and not punishable by death or life imprisonment” (Merriam-webster.com). Although we have one justice system in America, the juvenile system differs from the adult juvenile system. Most juvenile delinquents range from as low as the age of seven to the age of seventeen. Once the delinquent or anyone turns the age of eighteen, they are considered an adult. Therefore, they are tried as an adult, in the justice system. There are many different reasons why a child would commit crime, such as mental and physical factors, home conditions, neighborhood environment and school conditions. In addition, there are a variety of effects that juvenile justice systems can either bad effects or good effects. Finally there are many different solutions that can reduce juvenile delinquency. As a result, juvenile delinquency is a major issue and the likeliness of it can be reduced. In order to reduce juvenile delinquency there has to be an understanding of the causes and the effects.
