Justice is seen as a concept that is balanced between law and morality. The laws that support social harmony are considered just. Rawls states that justice is the first virtue of social institutions; this means that a good society is one structured according to principles of justice. The significance of principles of justice is to provide a way of assigning rights and duties in the basic institutions of the society and defining the appropriate distribution of the benefits and burdens of the society. According to Rawls, justice is best understood by a grasp of the principles of justice (Rawls, 1971). The principles are expected to represent the moral basis of political government. These principles indicate that humankind needs liberty and freedom so long as they do harm others. Rawls states that justice is significant to human development and prosperity. According to Rawls, the challenge of justice is to ensure a just distribution of primary goods that include powers and opportunities, rights and liberties, means of self-respect, income and wealth among others (Rawls, 2001). Rawls disputes the earlier predominant common source of injustice, the utilitarianism theory, which states that justice is best defined by that which provides the greatest good for the greatest number of people. The theory of utilitarianism ignores the moral worth of an individual. This theory does not take into consideration the minority. An example is the mistreatment of the Jews by the Nazi Germans (Rawls, 2001). Rawls states that you cannot reimburse for the sufferings of the distressed by enhancing the joys of the successful. Rawls theory of justice is idealistic because the original position cannot be forced upon individuals in the real world, instead individuals of the real world must put themselves into the original position. With so many self-interested human beings in our world, a society that completely honored the rights of their brethren is difficult to imagine, but events in our history when the disadvantages of the oppressed were finally fully realized by the privileged have proved that not only is altruism natural to us but a society who honors it will succeed. I will begin this paper by making clear that this is a critique of Rawls and his difference principle and not an attempt at a neutral analysis. I have read the Theory of Justice and I have found it wanting in both scope and realism. The difference principle proposed by Rawls, his second principle is the focus of my critique. While this paper will not focus solely on the second principle, all analysis done within this essay are all targeted towards the scope of influence that Rawls treats the second principle with.
The general concept of Rawls “original position” is that all social “Primary Good” should be distributed equally to individuals in a society, unless an unequal distribution favors those less fortunate. Rawls calls “the situation of ignorance about your own place in society the “original position (242).” Rawls’ theory is in direct response to John Lock’s principles on social contract, which states that people in a free society need to set rules on how to live with one another in peace. Rawls’ principles were designed to guard against injustices, which were inflicted upon society, with the help of John Stuart Mills Utilitarianism principle that individuals should act so as to maximize the greatest good for the greatest number. John Rawls’ Theory of Justice attempts to establish a fair and reasonable social account of social justice. To do this, he discusses two fundamental principles of justice, which if implemented into society, would guarantee a just and fair way of life. Rawls’ primary goal in designing the original position is to describe a situation that he believes would achieve the most extensive liberty and fairness possible to all the parties involved in his hypothetical social contract (Rawls, 1971). Rawls believes that in order to achieve this level of fairness, it must be assumed that the parties involved are situated behind a ‘veil of ignorance’ (Rawls, 1971). This veil of ignorance deprives all of the parties of all knowledge of arbitrary facts about themselves, about other citizens, from influencing the agreement among the representatives (Rawls, 1971). Rawl’s principles were found justified by visualizing real people forming a system of laws including the ramifications of a “justified complaint”. A justified complaint is an accusation by a member of society against another member of society. To have a system of justice the society must have means of answering the beckoning of the populace. If a society does not attend to the offense of its own people then it is not a true society. Society is based on the principle of a consensus unanimously choosing their governing rules and laws. However the limitations of a “justified complaint” are unclear depending on what the consensus agrees to. Though the one rule that must apply is the fact that a complaint must be made by a law abider to be a “justified complaint”.
