The goal of health policy is to protect and promote the health of individuals and the community. The United States is a very diverse and complex society. There are multiple individuals who provide input on significant health policy issues. Citizens look to government to identify and satisfy a variety of physical, economic, and psychological needs that extend well beyond the means for survival. The term federal regulation is used by the government to implement public policy. The process of rulemaking can be a long and extensive process. It is sometimes viewed as vital to the definition and implementation of public policy in the United States. This is broken down into two categories; agenda setting and the development of legislation. Managing human resources, and financials are part of the implementation phase of the public policymaking process. The most important point in understanding policy implementation, as part of the larger process of policymaking, is that it is primarily a management undertaking. It is important to realize the cyclical relationship between rulemaking and the operational activities involved with implementation of a law. This cyclical relationship means that experience gained with the operation of policies can influence the modification of rules or regulations used in the implementation phase. In a practical sense, this means that the rules promulgated to implement policies undergo revision sometimes extensive and continual revision and that new rules can be adopted as experience dictates. This characteristic of policymaking tends to make the process much more dynamic than it would be otherwise. Per Longest (2009), “Feedback from individuals, organizations, and interest groups experiencing the consequences of policies, combined with the assessments of the performance and impact of policies by those who formulate and implement them, influence future policy formulation and implementation. the activities involved in providing that protection. Such operational activities might include measuring and assessing dangers from substances in the environment or imposing fines as a means to prevent or restrict environmental pollution. According to Cornelius Kerwin, "Rulemaking is the single most important function performed by agencies of government Rulemaking refines, and in some instances defines, the mission of every government agency. In so doing it provides direction and content from budgeting, program implementation, procurement, personnel management, dispute resolution, and other important government activities" (Preface XI). This is the foundation for the book, Rulemaking. The whole text primarily revolves around this statement. Throughout the book Kerwin's central theme is that rulemaking is the single most important function that any government agency has within its possession. Much like other admin law books he discusses how those agencies with their rulemaking powers interpret legislation and proceed forward with making policy.
Instead, Congress often delegates to federal entities authority to craft rules and regulations needed to carry out the mandates of laws. In order to maintain oversight over the entities that Congress grants authority to, Congress has established a requirement to publish a notice in the Federal Register detailing their proposed rules. Interested parties are then allowed a time period to express their concerns over said methods.

2. Federal Regulation – the expansion of the federal government into almost all aspects of people’s lives
America is known for democracy, freedom, and the American Dream. American citizens have the right to free speech, free press, the right to bear arms, and the right to religious freedom to name a few. The Declaration of Independence states that American citizens have the rights including “life, liberty, and the pursuit of happiness.” America promises equality and freedom and the protection of their rights as outlined in the Declaration of Independence and the Bill of Rights. But with all the rights and freedoms that American citizens enjoy, there is one particular area where the United States seems to be lacking. That area is health care. The United States is the only industrialized nation that doesn’t have some form of legal recognition of a right to health care (Yamin 1157). Health care reform in the United States has become a major controversy for politicians, health care professionals, businesses, and citizens. Those in opposition to reform claim that health care is not a human right, therefore the government should not be involved. Supporters of reform believe that health care is most definitely a human right and should be available to everyone in the United States instead of only those who can afford it, and that it is the government’s responsibility to uphold that right.
The question of what is the government’s role in regulating healthy and unhealthy behavior is one that would probably spark a debate every time. Our nation’s current health in America is poor we have an epidemic of obesity, “More than one-third (34.9% or 78.6 million) of U.S. adults are obese.” (CDC, 2015) People are demanding better drugs, procedures, and technology which all cost money to research. In this day and age people want things to be done as fast as they can and want it when they want it. Healthcare is being misused, we use a method called defensive care to reduce chances other problems arise but cost more for tests that are not necessary. Now that every person is required to have healthcare it affects people in the middle class that make enough to sustain their families but not much more and they are now required to have healthcare make living life a struggle for them. Cost to manage a hospital are raising paying their workers more expensive technology, one thing that can really affect the cost of healthcare is, “Hospitals assume those costs as part of their legal duties to provide "charity care." (kavilanz, 2012) Hospitals are required to help people in need no matter what. The US needs to focus on preventative healthcare over healthcare. People live longer today but are living unhealthy, they eat food that is not good for them they smoke and live a life that is harmful to their health. Healthy People’s goals focus on the promotion of society’s health, as well as the prevention of diseases through preventative care and immunizations. Health care policy targets the organization, financing, and delivery of health care services. The reason for targeting these areas is for the licensing of health care professionals and facilities, to make sure there is protection of patients’ private health information, and there are measures of quality care, mistakes, malpractice, and efforts to control of health care cost (Acuff, 2010). There are several stages that one must take when creating a policy (see figure 1). The figure below shows the critical steps in the policy process. First, the problem must be identified, once the problem is identified potential policy solutions must be formulated, then the policy is adopted, and then implemented. After the policy is in place, an evaluation of the policy has to take place (This Nation, 2013).
Heath care is currently, and has been, a hot topic in politics and the average person's life today. Since Obama has come into office he has brought up the issue of providing every American with health care coverage while keeping costs low. Since his re-election, we have been faced with a healthcare reform that tears our country, and politicians, down the middle. The Patient Protection and Affordable Care Act, also known as “Obamacare,” is “A federal statute signed into law in March 2010 as a part of the healthcare reform agenda of the Obama administration. Signed under the title of The Patient Protection and Affordable Care Act, the law included multiple provisions that would take effect over a matter of years, including the expansion of Medicaid eligibility, the establishment of health insurance exchanges and prohibiting health insurers from denying coverage due to pre-existing conditions” (Affordable Care Act). The reform is meant to help those who cannot cover the costs of coverage due to low income, or no jobs, as well as those who have been denied because of pre-existing heath conditions; it is essentially there to help those ultimately in need. Unfortunately, Obamacare is not beneficial to those who are currently covered, typically known as the average American, as it it is not cost effective nor constitutional.
Health care laws and regulations influence the delivery of health care services in the United States. Health regulation and regulations agencies develop and enforce laws to protect and improve the access to affordable health care for all Americans. Regulatory agencies affect health care organizations, health care providers, drug and pharmaceutical companies, and health care research.
