Copyright and fair use laws are laws that allow for creators of works to have rights to their creations. But, they also allow the free use of works, in the effort to get your point across. Fair use can be defined as the doctrine that brief excerpts of copyrighted material may, under certain circumstances, be quoted verbatim for purposes such as criticism, news reporting, teaching, and research, without the need for permission from or payment to the copyright holder. This doctrine shows how the general public is available to reproduce copyrighted material without acquiring consent. While, this is true, we are only allowed to reproduce part of the information, not the entirety of the work. These can include news reporting, teaching purposes,
and research. But, fair use law allows creators to have rights over the ideas that they have created. Copyright, on the other hand, is defined as the exclusive legal right, given to an originator or an assignee to print, publish, perform, film, or record literary, artistic, or musical material, and to authorize others to do the same. Copyrights give creator's rights over their ideas. This ownership includes initial ownership, works for hire, and contributions to collective works. These copyrights allow the creators of general copyrights 70 year rights after the creator's death. The same goes for joint works. But, anonymous works grant rights for up to 95 years after the work’s creation. Copyrights can be registered in 3 locations: literary works in Texas, visual works in Virginia, and copyrights can be given online. Things that can be copyrighted include: Printed works, music or sound recordings, and websites or homepages. Included with copyrights, trademarks can be given. Trademarks are a symbol, word, or words legally registered or established by use as representing a company or product.
Putting concrete limitations and rules on what an artist can and cannot use when expressing their opinion of another artist’s work is unconstitutional. If we put a price on the freedom of speech, we place a fine on our liberties.
Lastly,music censorship also gives the impression that people are not mature or responsible enough to handle this type of music. Even with some kids listening to the music, there is no reason the censor it because chances are they have heard the words or phrases that are censored. There are people over 18 who can control what they are and aren’t listening too. Censoring the bad things in music protects kids from things they will learn anyway, and people have a right to listen to the kinds of music and things they listen to and watch.

In the article, We are Free to Be You, Me, Stupid, and Dead, Roger Rosenblatt argues for the people’s right to freedom of speech and expression, that is given by the U.S Constitution. Rosenblatt argues that freedom of speech is one of the many reasons the Founding Fathers developed this country. For this reason, Rosenblatt believes that we should be tolerant and accepting of other’s ideas and beliefs. Even if one does not agree with someone else, they need to be understanding and realize that people have differing opinions.
Many countries have adopted a fair usage policy within their copyright laws, ‘Fair dealing’ in United Kingdom law, ‘fair dealing’ in Canada and the ‘United States doctrine of fair use’ to name just a few. The purpose of these policies is to give exception to copyright infringement laws when information has been copied for the purposes of non-commercial research or study, or for the reporting of current events. A document published by the UK intellectual property office: ‘Exceptions to Copyright Law - Research’, states: “The law already permitted limited copying of some types of copyright material, such as books, for non-commercial research or genuine private study. The law has now changed so that all types of copyright works are covered.” The document explains that the amount being copied is limited by the legal application of “fair dealing” and copying the whole work would not constitute as ‘fair dealing’ in this case a licence or paid subscription would be needed. This case was taken up to the Supreme Court due to Heller’s argument stating that the government of the nation’s capital must obey the Constitution and the Bill of Rights because these texts are the supreme law of the land. Heller’s belief of injunction was certain, “at least one of the founding fathers said that there will be times when the State or Federal Government will overstep its bounds and will need to be put back into its place.” There has not been any lower court cases or any true precedent case besides Columbia vs. Heller for Drake vs. Jerejian. Drake vs. Jerejian seeks an end to the unjustified denial of carry permits by the State of New Jersey; and the unreasonable restriction for concealed carry permits citing “justifiable need” or “urgent necessity” for the issuance of a permit.
