California has one of the most dysfunctional and problematic prison system in US. Over the last 30 years, California prison increased eightfolds (201). California Department of Correctional and Rehabilitation (CDCR) does little to reform prisoners and serve as human warehouse rather than a correction institution. California's prison system fails the people it imprisons and society it tries to protect. In many cases, California's prison system exacerbates the pre-existing problems and aids in the formation of new problems for prisoners. This paper discuses the criminogenic effects of overcrowding, and reduction/elimination of programs and how it negatively affects California and the ballooning prison population and possible remedies.
Historical Factors
Starting in 1970s, there has been an upward adjustment to sentencing making punishment more punitive and sentencing guidelines more strict. Martinson's (1974) meta-analyzies reviewed over 200 studies and concluded that nothing works in terms of rehabilitating prisoners. Rehabilitating efforts were discontinued. The War on Drugs campaign in 1970s incarcerated thousands of non-violent drug offenders into the system. In 1865, 34.3% of prison population were imprisoned for drug violation. By 1995, the percentage grew to 59.9% (figure 4.1, 104). Legislation policies like the Third Strikes laws of 1994 have further the severity of sentencing. The shift from rehabilitation to human warehouse marks the end of an era of trying to reform individuals and the beginnings of locking inmates without preparation of their release. Program reduction and elimination
Basic education services are often not met. The literacy rate of inmates in California is at a seventh grade level (204).
The flaws of the prison system not only affect inmates and their families, but affect every Californian. It is ironic that prison are created to protect society, but it also an institution that hurts society. More of state budget is moved into maintaining the flawed prison system at the expense of education and social services. Ironically, money for education and social services aid in preventing criminal population.
These criminogenic effects are an endless cycle. The prison system in California are in dire need of correction. Early contact with the system is one of the risk factor in future offending.
Increased tensions during the 1960s in the context of the Civil Rights Movement started to cause an increase in crime, sparking a newfound belief in incarcerating the masses to prevent more crime from occurring. During the 1970s, the likelihood of being incarcerated increased for nearly every citizen, especially low-level offenders. Clear and Frost thoroughly explain that the Punishment Imperative in the 1980s was caused by changes in government “policies and practices associated with the increasingly ubiquitous War on Drugs” (31). Changes in sentencing guidelines, mandatory minimum sentences, and three strikes legislation were though to be initially helpful in decreasing the rate of incarceration, but they proved to do the exact opposite. Policies also regarding reentry into society, access to education, public housing, and child custody for ex-convicts continued to play a major role in the increase in incarceration because newly released convicts had an extremely difficult time reintegrating into society. When envisioning a prison, one often conceptualizes a grisly scene of hardened rapists and murderers wandering aimlessly down the darkened halls of Alcatraz, as opposed to a pleasant facility catering to the needs of troubled souls. Prisons have long been a source of punishment for inmates in America and the debate continues as to whether or not an overhaul of the US prison system should occur. Such an overhaul would readjust the focuses of prison to rehabilitation and incarceration of inmates instead of the current focuses of punishment and incarceration. Altering the goal of the entire state and federal prison system for the purpose of rehabilitation is an unrealistic objective, however. Rehabilitation should not be the main purpose of prison because there are outlying factors that negatively affect the success of rehabilitation programs and such programs would be too costly for prisons currently struggling to accommodate additional inmate needs.
Overcrowding in prisons may cause prisoners to not receive the rehabilitative curriculums that they want in order to be reintegrated into society. It is easy to turn a blind I when there is no direct personal experience. Mass incarceration is an issue that influences other issues within the correctional system. The more people under correctional supervision means, the more individuals who can potentially be sexually victimized or placed in solitary confinement. Both are issues within the correctional system. Moreover, studies have shown that sexual victimization and solitary confinement have adverse side effects on inmates. If any of these variables are going to change for the better, then policy needs to change. Those in society, especially those with power who can affect policy in the penal system need to see these issues as a major problem. Some of the proposed solutions to reduce the incarceration rate and not new ideas, but a change in approach. Heroux (2011), suggested possible policy solutions to reduce the mass incarceration. Some of these solutions are earlier release, a change in mandatory minimums, transfer to non-institutions facilities, the diversion from institutional facilities, and doing away with mandatory minimum laws. Mass incarceration has caused the prison’s populations to increase dramatically. The reason for this increase in population is because of the sentencing policies that put a lot of men and women in prison for an unjust amount of time. The prison population has be caused by periods of high crime rates, by the medias assembly line approach to the production of news stories that bend the truth of the crimes, and by political figures preying on citizens fear. For example, this fear can be seen in “Richard Nixon’s famous campaign call for “law and order” spoke to those fears, hostilities, and racist underpinnings” (Mauer pg. 52). This causes law enforcement to focus on crimes that involve violent crimes/offenders. Such as, gang members, drive by shootings, drug dealers, and serial killers. Instead of our law agencies focusing their attention on the fundamental causes of crime. Such as, why these crimes are committed, the family, and preventive services. These agencies choose to fight crime by establishing a “War On Drugs” and with “Get Tough” sentencing policies. These policies include “three strikes laws, mandatory minimum sentences, and juvenile waives laws which allows kids to be trialed as adults.
On an average nearly 688,000 prisoners are released back into society, and of which includes 433,000 prisoner's waiting for trial and convictions, and the remaining percentage of prisoner's are serving sentences for minor and non-violent crimes, although, in the attempt to ensure public safety. To begin, Mandatory minimum sentences result in prison overcrowding, and based on several studies, it does not alleviate crime, for example crimes such as shoplifting or solicitation. These sentencing guidelines do not allow a judge to take into consideration the first time offender, differentiate the deviance level of the offender, and it does not allow for the judge to alter a punishment or judgment to each individual case. It is undeniable that mass incarceration devastates families, and disproportionately affects those which are poor. When examining the crimes that bring individuals into the prison system, it is clear that there is often a pre-existing pattern of hardship, addiction, or mental illness in offenders’ lives. The children of the incarcerated are then victimized by the removal of those who care for them and a system which plants more obstacles than imaginable on the path to responsible rehabilitation. Sometimes, those returned to the community are “worse off” after a period of confinement than when they entered. For county jails, the problem of cost and recidivism are exacerbated by budgetary constraints and various state mandates. Due to the inability of incarceration to satisfy long-term criminal justice objectives and the very high expenditures associated with the sanction, policy makers at various levels of government have sought to identify appropriate alternatives(Luna-Firebaugh, 2003, p.51-66).
As California continues to struggle meeting budget deadlines, politicians focus on budget cuts affecting education, health care, social programs, and pensions. Part of balancing the state budget requires politicians to review all programs which are state funded; this includes analyzing the costs of “incarcerating people who pose no threat to public safety” (ACLU of Northern California). If California lawmakers come together and re-evaluate the correction system as a whole, state funding can be re-allocated back into our education programs, health care, social programs and others. Overcrowding in our state and federal jails today has become a big issue. Back in the 20th century, prison rates in the U.S were fairly low. During the years later due to economic and political factors, that rate began to rise. According to the Bureau of justice statistics, the amount of people in prison went from 139 per 100,000 inmates to 502 per 100,000 inmates from 1980 to 2009. That is nearly 261%. Over 2.1 million Americans are incarcerated and 7.2 million are either incarcerated or under parole. According to these statistics, the U.S has 25% of the world’s prisoners. (Rick Wilson pg.1) Our prison systems simply have too many people. To try and help fix this problem, there needs to be shorter sentences for smaller crimes. Based on the many people in jail at the moment, funding for prison has dropped tremendously.

The “Tough on Crime” and “War on Drugs” policies of the 1970s – 1980s have caused an over populated prison system where incarceration is policy and assistance for prevention was placed on the back burner. As of 2005, a little fewer than 2,000 prisoners are being released every day. These individuals have not gone through treatment or been properly assisted in reentering society. This has caused individuals to reenter the prison system after only a year of being release and this problem will not go away, but will get worst if current thinking does not change. This change must be bigger than putting in place some under funded programs that do not provide support. As the current cost of incarceration is around $30,000 a year per inmate, change to the system/procedure must prevent recidivism and the current problem of over-crowed prisons.
