While looking at research done in Scotland and Canada, Pre-sentence reports (PSR), which are noted as Social Enquiry Reports within Scotland, are considered to be a key and influential aspect within their Criminal Justice System and the decision process on the subject of sentencing a custodial or non-custodial sentencing. While the idea of PSR’s are simple, to provide the court with personal information about the offender, such as circumstances that proved to be such a challenge, that he or she had abnormally excelled and expressed the ability to change for the better, and or have demonstrated that they have had a faulty character that could proveproves that a harsher sentencing is appropriate, or any other relevant information that the report writer deemeds necessary for the court (Tata et all., 2008). Being that report writers (Pprobation officers) are supposed to be impartial while creating their report, which may mean revealing some information that could complicate or compromise their goal of an alternative sentencing, they are to use PSR’s as a “selling point” for the judge (Tata et all., 2008). Although it is true that the role of the PSR can be a very useful tool in the Criminal Justice SystemAlthough the usefulness of PSR’s have been becoming more effective and more and have become more popular since the 1990’s, there are obvious discrepancies in perspectives in what the report is supposed to achieve (Tata et all., 2008). These discrepancies of PSR within the judicial system can be proven to be heavily weighted on their interpretation, narratives, realism, and quality. But as will be discussed, there are major flaws in the Australian criminal justice system with issues focussing on three main concerns: (i) lenient sentencing in the criminal justice system particularly with white-collar and blue-collar crimes (i) recidivism and lack of support for offenders (iii) public safety concerns. This essay will examine issues with the Australian prison system, and explore the punishment of shaming and if it is an effective method in preventing general and specific deterrence using sociological frameworks and theories.
Criminological theories interpret the competing paradigms of Human Nature, Social Order, Definition of Crime, Extent and Distribution of Crime, Causes of Crime, and Policy, differently. Even though these theories have added to societies understanding of criminal behaviour, all have been unable to explain why punishment or treatment of offenders is unable to prevent deviancy, and thus are ineffective methods of control. The new penology is a contemporary response that favours the management of criminals by predicting future harm on society. However, all criminological theories are linked as they are a product of the historical time and place, and because of their contextual history, they will continue to reappear depending on the current state of the world, and may even be reinvented.

There is a lack of evidence to suggest that rehabilitation is neither an effective or non-effective sanction. The use of probation as a stand-alone sanction has decreased over the years with probation now being combined with more severe sentences. When combined with rehabilitative programs probation reduced crime outcomes by 16.7%. The common perception of the general public is that increasing the severity of sentencing will reduce crime, however empirical evidence suggest that this is not the appropriate response. Public dissatisfaction with sentencing in Tasmania is often due to a lack of knowledge and understanding.

We also have the responsibility to abide in an ethical manner. There are many grey areas in the social work and the code of ethics helps guide social workers to promote well-being and meet the needs for people. All though many professions follow similar ethical practices and promote human rights what sets us apart is are needed to promote social justice.
